Chair Swenson called the meeting to order at 8PM. The
minutes of 4/7/93 will be considered at the next Planning
Commission Meeting.
Planning Commission present were as follows:

AGENDA ITEM #3= Hearing for Diane Hillyard for consideration
of a Conditional Use Permit to allow a relocated single
family residence to lie upon an existing lot of record within
the City. Specifically, the applicant wishes to locate a
brick built single family residence upon Lot 15, Block 1 of
Vasseurs Oak Grove Estates_ The said residence would replace
a manufactured home which currently exists upon the lot. In
conjunction with the Conditional Use Permit, the applicant
has also requested a Conditional Use Permit to allow a two
bedroom single family dwelling to measure less than 940
square feet in area (relocated residence measures 900 square
feet in size).
Swenson explained how the Hearing would be handled. He
asked if proper publications and notifications had been
mailed and posted.
Beatty answered yes they had.
Kirmis explained NAC's Report of 4/12/93 and the
relocation CUP to allow a 900 Sq Ft Size (Not 940 Sq Ft
Required). The home is a rambler which appears to be in good
condition, built in 1985. The dwelling would replace the
existing manufactured home (single wide). As far as
compatibility, the area is common to manufactured homes
(single and double wide). The building would be painted to
match the existing structure. The residence has been
appraised at $75,000.00. The mobile home existing at
$45,000.00 apprasial. (See page #2 of NAC's Report of
4/12/93). Kirmis stated that the curb cuts are an issue. Two
driveways are proposed. We feel two cuts are not necessary
to the efficient functioning of the site (City Engineer
agrees) .
NAC recommends approval of the CUP and undersized single
family dwelling. See Pg #2&3 of NAC 's Recommendations (A -L )
Kirmis read. In addition the City Engineer has provided a
few conditions.

bedrooms, drainfield location be West of proposed
drainfield.
Swenson said at this time we normally open it to the
public, but since there is no one but the applicant here, we
will close the Hearing and bring it back to the Planning
Commission.
Goenner - The City Engineer has requested relocation of
the septic system. If the existing one is found to be in
working order, can they use it? (Building Inspector would
determine that).
McAlpine brought up the well and septic.
Kirmis said we leave that in the hands of the Engineer
typically.
Black - Is this a 1-A lot? Hillyard answered, it is 2-
1/2 acres. Why would we want to have only one driveway?
Unless 87TH is reconstructed and then is a problem with too
many curb cuts. What difference does it make. She has the
pole building on one side and the house on the other. Some
discussion was had on this.
Roskaft - Said if the lot was divided it would be 125' x
200'.
Black feels the existing building is being accessed by
the driveway.
Wallace - If we are going to do that, don't we need
another CUP request? It already has two driveways.
The proposed drive will be on the East side of the lot.
The garage will stay where it is.
Roskaft feels that the drives are grandfathered in.
There are culverts under both drives.
Swenson asked if anyone is ready to make a motion.
Roskaft motioned to allow a Conditional Use Permit to
allow a two bedroom, single family dwelling less in area than
940 square feet, subject to the conditions of NAC's Report
of 4/12/93. Goenner seconded the motion. Motion carried
unanimously.
Roskaft motioned to allow a Conditional Use Permit for a
building relocation subject to the conditions of NAC's Report
of 4/12/93 and (K) That two proposed driveway accesses, be
allowed, because they are already there and have culverts
under the driveway. McAlpine seconded the motion. Motion
carried unanimously.
Wallace - brought up the septic system. Should we have
that as a condition? The Building Inspector and the Engineer
will handle that.
Kirmis said that the report was written that the second
drive way was proposed (not there), but if it was there, I
believe it would hold grandfather rights.

recommend to the Council that we write our recommendations in
a letter. Any comments?
Nagel - Asked what are the recommendations? As she was
not here.
Swenson read the recommendations from John Harwood's
letter. He then asked if there were any questions or
comments?
Kirmis - Based on his experience, the City Shoreland
Ordinance meets or exceeds that of the County.
Roskaft - Motioned to make a recommendation to the
Council to draft a letter to the County. Wallace Seconded.
Motion carried unanimously.
Swenson asked if there was any other Planning Commission
Business?
Goenner - Said last Summer or Fall Osterbauer came in
and asked for rezoning of his property. He said he would
build his driveway next the property line. He has moved the
driveway more towards the middle of the field. We should
remember this in the future when people ask for this kind of
a request.
Roskaft motioned to adjourn t e meeting. McAlpine
seconded the motion. Motion carr ed unanimously.
