1. CHAIR SWENSON WILL CALL TO ORDER:
Chair Carl Swenson called the meeting to order at 8PM.
ROLL CALL:
The following Planning Commission Members were present:

2 Consideration of Minutes of 3/2/94
ING ROSKAFT MOTIONED. DENNIS MCALPINE 2ND TO APPROVE AS
PRINTED. MOTION CARRIED UNANIMOUSLY.
Chair Swenson noted that this has been continued a couple of times to add more
information to the layout.
Bob Kirmis said NAC has recommended approval with the following 10-Conds:
1. The off-street parking lot provides required adequate handicap parking stalls (1- 25
stalls reserved for the handicapped).
1. Per Ordinance requirements, the off-street parking lot and associated driveway is
surfaced in asphalt, concrete, cobblestone, or paving bricks.
3. A perimeter curb is provided around the perimeter of the park facility's off-street
parking area.
4. Off -Street parking areas are striped in accordance with Ordinance provisions.
5. Any lighting issued to illuminate athletic fields or off-street parking areas are arranged
to reflect light away from adjacent residential uses and public rights-of-way.
6. Any new singn erected for the proposed park comply with applicable provisions of the
City Sign Ordinance.
7. If applicable, a joint parking arrangement with the City Hall parking lot is approved
subject to the following conditions:
a. The joint parking arrangement be terminated upon the construction of
active park functions (i.e., softball, soccer, etc.).
b. On-site off-street parking be provided at such time as active
park functions are constructed.
8. An access easement is obtained to allow park access to be achieved through the five
acre City Hall property. This item should be subject to further comment by the City
Engineer.

9. The City Engineer provide comment/recommendation in regard to grading and
drainage issues.
10. Comments from other City Staff.
The Hearing was open to the public. No one wished to be heard.
It was brought back to the P.C. for comment.
Swenson commented on parking. Some discussion of the parking lot was had.
Goenner worried about the need arising and the City Hall parking overflowing.
Hall activities would be in the evening. The ballfields would be used more in the daytime.
Parking on Nashua would be a problem.
If we take the approach we are going to make it work we will have options.
Swenson asked if anyone else wished to comment either way.
Dennis McAlpine commented about concern about the handicapped. I have seen other
establishments use a parking ramp and path for getting to fields.
Swenson discussed using crushed rock or blacktop.
Ing Roskaft voiced concern about the parking lot and said if we build the fields and
forstall the parking lots, they may not get built.
Discussion of other communities not having paved parking at their ballfields was had.
The City Hall being filled and parking overflow was discussed. The distance people have
to walk to the ball park was a concern. Much more discussion was had.
As a City we can't treat it any differently than the VFW.
BRUCE RASK MOTIONED TO APPROVE THE CUP WITHIN THE INS DIST
ZONING FOR THE CITY HALL TO ALLOW RECREATIONAL USE. .
DENNIS MCALPINE SECONDED THE MOTION. MOTION CARRIED
UNANIMOUSLY.

I HEARING ON THE MINING ORDINANCE FOR THE CITY OF OTSEGO.
Swenson asked if the proper publications have been made. Beatty replied Yes.
Larry Koshak gave a report on the updated Mining Ordinance.
He said they had presented it to the PC. The Ord will repeal Ord 99. This Ordinance will
be substituted. Corrections are noted on Pg 2, The definition of minor excavation.
(Larry Koshak read change).
The change was based on discussion at the P.C. Meeting.
Pg 3, The item #C, in Sec. X 1-4 is the excavation by Fed., State, Co or City Government
was discussed. The Atty made a change on Pg 4, Item B3 ,A3 where he asked for the
name address and phone no of the record holders and those in possession or vendees of
contract for deed to cover addtional people that might be involved in the ownership.
Pg 13, Item #4 at the top of the page the written right of entry which cannot be terminated
for one year etc. was added.
Page 14 YJ -7A The Atty added this portion:
Should the operator for whatever reason continue operations (etc.)

Item C he added at the end of that sentence " It shall be unlawful (etc).
At the end he incorporated the section (Page 26 X 1- 1 S) He incorporated this to include
provision for civil penalties.
Section three continues, those are the additions that we have presented to you. That
concludes our report.
Chair Swenson opened the Hearing to the Public. No one wished to be heard. Hearing
was closed. It was brought back to the P.C. for comment.
Discussion was had on how many cubic yards of dirt can be removed without a permit.
50 Cubic Yards. Larry Koshak said they can remove more with a building permit. The
school is a typical example. Carl Swenson asked if it is even over 500 yds?. Mr Koshak
said that is the interpretation.
Goenner - Wouldn't that leave a big loophole? For someone who would want to remove
a hill, they get a builidng permit and want to remove a hill so they put in a building. Ing
Roskaft said he thought the building permit would be the control with that.
Much more discussion was had of mining permits and landfilling.
Larry Koshak talked about plats and what is required for grading plans etc.,
and site plan for each building plan, unless it is a plat that has been previously approved.
Ag work on a farm, the requirements are not as critical.
ROSKAFT MOTIONED THAT THE PROPOSED AMENDMENT TO THE CITY
OF OTSEGO MINING ORDINANCE #9 BE APPROVED. ARLEEN NAGEL
SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY.
THIS WILL BE ON THE 28TH OF MARCH AGENDA AT 7:30PM.
More discussion was had on School and Farm Operations and what they needed to get a
permit for hauling dirt filling and mining.
5 CONSIDER A DATE TO HOLD THE HEARING ON THE WETLAND ORD.
Otsego is the LGA and has to show the wetlands are protected. Our Ordinance covers
everything the rules cover. Most of the language is exactly the same, formatted the same
as the rest of the Ordinances the City has. This will protect the Wetlands in the City of
Otsego and make sure none are lost. There are 24 exempted uses and the Ordinance
proposes to handle those on a CUP basis. Any questions asked Carl Swenson? The.
request is for a Public Hearing. Swenson asked what would be an appropriate date for
hearing? Mr Koshak said the act is in force. The Ordinance allows us to put it in the
Ordinance for the City. Every piece of property that is altered has to have a wetland
clearance.

MOTION.. MOTION CARRIED UNANIMOUSLY.
6 ANY OTHER PLANNING COMMISSION BUSINESS,
RON BLACK said on the Council Meeting Mon. night the Historic Preservation
Ordinance was referred to the PC for Hearing. It would establish a Historic Preservation

Committee in Otsego. The Commission would be established, an examination would be
made to see if any area in the City would fit in. If it does there is possible funding
available to establish a historic site. The council would like the PC to review this draft
ordinance. The Planning Commission will be furnished copies of the draft Historical
Ordinance. .
Ron Black asked if the P.C. would set a hearing for this on May 4th as well?
Mr Kirmis said changes could be ironed out before the Hearing.

COMMISSION ORDINANCE HEARING ON MAY 4, 1994 AT 8PM. BRUCE
RASK SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY.
BRUCE RASK - questioned the sewer pumping certificate and where you bring it.
Beatty said bring it to the City Hall. It will be put in the property file.
Discussion was had on the Planning Commission at their spare meeting time start
reviewing the Zoning Ordinance and recommend any changes to the Council. Ron Black
said he will discuss this with the Council and let them know if there is any problem in
doing this.
