02-01-95 PCMinutes of the City of Otsego Planning Commission Meeting, February 1, 1995. 8PM Roll cath Chair Carl Swenson Members: Dennis McAlpine, Ing Roskaft, Bruce Rask, Eugene Goenner, Mark Wallace, Jim Kolles. Alternate: Arleen Nagel City Staff: Elaine Beatty, City Clerk/Zoning Administrator, Judy Hudson, Deputy Clerk City Council Representative: Larry Fournier Absent: None Chair Swenson explained about the City Clerk and Zoning Administrator Elaine Beatty being more involved in the Planning Commission Meetings. Judy Hudson or Carol Olson will be taking minutes. 1. Chair Carl Swenson will call meeting to order. Chair Swenson called meeting to order at 8 PM. 2. Consideration of Minutes of 1/18/95. Ing Roskaft motioned to approve minutes. Eugene Goenner seconded. All in favor. Motion carried. 3 Continuation of Hearing to consider the following amendments regarding 4 reetw e i} inns: Zoning Administrator Beatty referred to City Attorney, Andy MacArthur's letter of January 26, 1995. Chair Swenson opened Hearing. No one from the audience spoke. Chair Swenson brought it back to the Commission. 1 An amendment to the solid waste Ordinance. specifically defining those street s_w�pings which are excluded from the definition of mixed municipal solid waste. Ing Roskaft motioned that Ordinance 94 be approved as presented by the staff. Seconded by Bruce Rask. All in favor. Motion carried. Discussion: Commission Member Roskaft asked if the sweepings off the county road will be picked by County. Beatty said yes the County will be responsible for the County roads. Bruce Rask asked if this just covers sand and not other material, will this cause a problem. Chair Swenson said it will be at the discretion of the City Engineer to solve problems. Mark Wallace was concerned with the sweepings from Minneapolis. Clerk Beatty said the Engineer will determine what type of testing and would review the results. 2. An amendment to the Zoning Ordinance addressing conditions of Land Filling Operations. (Note: Continued to have the Attorney clarify) Ing Roskaft motioned Otsego Zoning Ordinance 20-24-5A shall be amended as follows: Under no circumstances shall any such landfill operation be conducted or permitted of the contents of the landfill or any part hereof shall consist of garbage, animal or vegetable refuse, poisons, contaminants, chemicals, decayed material, filth, sewage or similar septic or biologically dangerous material, street sweepings not qualifying for exclusion from the definition of "Mixed Municipal Solid Waste" under the City Solid Waste Ordinance, or any other material deemed to be unsuitable by the City. Page 2 Discussion: Bruce Rask stated he had two visitors last week concerned about PCB's in the composting material from the County Facility. Elaine Beatty said this would be the composting material from the County to be used in the Park. Mr. Rask said the visitor was concerned about the contaminants in it. Clerk Beatty said the Engineer would determine if it is usable and a PCA Permit is needed. Councilmember Fournier said he would bring up these concerns to the City Council. 4 Any other Planning Commission Business Chair Swenson stated that according to the By-laws, Election of Officers are to be done at the first meeting in February. Chair Nominations: Bruce Rask nominated Carl Swenson. Seconded by Dennis McAlpine. Mark Wallace motioned to closed nominations. Seconded by Jim Kolles. Motion moved unanimously to elect Carl Swenson as Chair. Vice Chair nominations: Mark Wallace motioned to nominate Dennis McAlpine. Dennis McAlpine nominated Bruce Rask. Bruce Rask explained his term is up this year and therefore declined nomination. Dennis McAlpine nominated Eugene Goenner. Mark Wallace motioned to closed nominations. All in favor. Motioned carried. Elaine Beatty handed out paper ballots, counted the ballots and reported a tie. Beatty handed out ballots again, this time Arleen Nagel will abstain form voting. Clerk Beatty collected and counted ballots. Eugene Goenner received the majority ballots. Secretary nominations: Mark Wallace nominated Dennis McAlpine. Gene Goenner nominated Jim Kolles. Mark Wallace motioned to close nominations. Jim Kolles seconded. All voted favor. Nominations closed. Ballots were handed out. Clerk Beatty collected and counted the ballots. Dennis McAlpine was elected Secretary. Chair - Carl Swenson Vice Chair - Eugene Goenner Secretary - Dennis McAlpine Mark Wallace informed the commission that the Industrial Site Committee will be meeting Thursday, February 2, 7:00 PM. The minutes of the City of Otsego Planning Commission Meeting of February, 1995 Page 3 Chair Swenson ask Councilmember Fournier for a update on the annexation. Councilmember Fournier said that the Hearing is over and it is now up to the Municipal Board. He feels that we did a good job of presentation. Clerk Beatty explained that within 20 days we get a copy of the transcript. The attorneys will then have 10 days for submitting written comment. The Municipal Board will then review and hold public meetings. Elaine also briefly went over some of the highlights of the Hearing. Chair Swenson asked about the Wild and Scenic Ordinance. Zoning Administrator Beatty said it has been sent in and published in the paper and it should now be done. We had heard back from the DNR and sent in a Resolution. As soon as we hear from the DNR again regarding the Wild and Scenic Ordinance it should be officially adopted. Chair Swenson brought up Planning Sessions: Councilmember Fournier would like to see everyone attend at least one session and the City Council will support paying for these classes. Chair Swenson thought that since it has been such a long time everyone should go to the basic one. Ing Roskaft was concerned about the cost to the City since he has been to several of the basic sessions. Chair Swenson feels it will be helpful to the group and there are always changes in the law. Chair Swenson said to let Clerk Beatty know and she will sign them up. The Basic Workshop on February 23 - Mark Wallace and Carl Swenson will attend. The Basic Workshop on April 6 - Larry Fournier, Ing Roskaft and Bruce Rask The Basic Workshop on April 1 - Arleen Nagel Councilmember Fournier explained to the Commission that our Professional Staff will not be attending the Planning Commission Meetings except for the more involved issues. 5. Adjourn Ing Roskaft motioned to adjourned. Seconded by Bruce Rask. All voted in favor.
