05-02-05 PCITEM 2-7 OTSEGO PLANNING COMMISSION MEETING May 2, 2005 7 P OTSEGO CITY HALL 1. Chair Nichols will call the meeting to order. Chair Nichols called the meeting to order at 7 PM. Roll Call: Richard Nichols, Chair; Planning Commission Members: Pam Black, Doug Hackman, David Thompson, Tom Darkenwald, Tammie Fallon and alternates Troy Watring and John Thelen. Absent: Jim Kolles Staff: Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Administrator; Dan Licht, City Planner and Laurie Shives, Associate Planner. City Council: Mayor Larry Fournier; Councilmembers: Vern Heidner and Mark Thorsted. 2. Consider the following minutes: 2.1. April 18, 2005 Planning Commission Meeting. Commissioner Black motioned to approve. Seconded by Commissioner Watring. Voting For the Motion: Chair Nichols; Commission Members: Black, Thompson, Fallon, Watring and Hackman. Abstained: Commissioner Darkenwald (was not in attendance) Motion carried. 3. Planning Items: 3.1. Crimson Ponds West:(Public Hearing was closed 04-18-05) A. Rezoning from Agriculture to R-4 Residential Urban Single Family. B. Preliminary Plat. Chair Nichols stated that the Public Hearing was closed on April 18, 2005. Dan Licht presented the Planner's Report. David Hagen, representing the applicant, agreed with the conditions listed in the Planner's Report. Commissioner Black asked if the additional engineering information had been received. Mr. Licht replied the Developer's Engineering is still working to provide this information and most of this information comes with the Development Plan as part of a Final Plat. Commissioner Hackman asked if a condition should be added regarding the construction traffic route. He also stated he is comfortable with these lot sizes. Commissioner Black motioned to recommend to approve a Zoning Map amendment rezoning the subject site from A-1 District to R-4 District based on a finding that the request is consistent with the Comprehensive Plan. Seconded by Hackman. All in favor. Motion carried. Planning Commission Meeting of May 2, 2005. Page 2. Commissioner Darkenwald motioned to recommend to approve the Crimson Ponds West Preliminary Plat, subject to the 14 conditions with Condition No. 14 reading construction traffic shall use only Odean Avenue to access property and shall be prohibited from using Odell Avenue and Padget Avenue. Seconded by Commissioner Black. All in favor. Motion carried. 3.2. Public Hearing for Brian and Jacolyn Stellmach: A. Conditional Use Permit to allow relocation of a single family Home onto a lot within the City of Otsego. Laurie Shives presented the Planner's Report. Chair Nichols opened the Public Hearing at 7:17 PM. Judy Hudson attested that all proper noticing, posting and publishing was completed. She also noted for the record that Martie Carroll, a neighbor, called and stated her support for this Conditional Use Permit.. Hearing no public comments, Chair Nichols closed the Public Hearing at 7:19 PM. Commissioner Fallon asked if the City Streets are adequate to bring in this structure. Mr. Licht explained a security is posted for this reason. Commissioner Fallon motioned to recommend to approve the Conditional Use Permit, subject to the six conditions listed in the Planner's Report. Seconded by Commissioner Thompson. All in favor. Motion carried. 3.3. Public Hearing for Kevin Henry of Four H Properties: A. Rezone from I-1 to I-3 (Special Industrial District). B. Site and Building Plan Review for a building expansion. Laurie Shives presented the Planner's Report. Councilmember Heidner asked if there is enough room for ponding. Mr. Licht said it is a condition that a Storm Water Ponding Plan is provided. Chair Nichols opened the Public Hearing at 7:34 PM. Judy Hudson attested that all the proper noticing, publishing and posting was completed. Hearing no public comment, Chair Nichols closed the Public Hearing at 7:39 PM. Chair Nichols asked if the entire lot is paved. Mr. Licht said it is mostly gravel. Commissioner Black motioned to recommend to approve a Zoning Map amendment rezoning the subject site from I-1 District to I-3 District based on a finding that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Hackman. All in favor. Motion carried. Dan Licht reviewed the landscaping and said he is satisfied and recommended that Condition 4 be removed. Commissioner Thompson motioned to recommend to approve the building expansion of Metro Home Insulation, subject to the seven conditions listed in the Planner's Report deleting No. 4. Seconded by Commissioner Fallon. All in favor. Motion carried. 3.4 Public Hearing for Kittredge Crossings 10th Add. (cont'd from 4-18) A. Rezone from A-1 (Agriculture) to PUD District. B. Preliminary Plat consisting of 106 dwelling units. Dan Licht presented the Planner's Report. Planning Commission Meeting of May 2, 2005. Page 3. Judy Hudson attested that all the proper noticing, posting and publishing was completed. Lucinda Gardner, applicant, agreed with the City Planner's Report. She asked what is the definition for completion of the Commercial Plat. Chair Nichols opened for Public comments at 8:06 PM. Judy Hudson attested that all the proper noticing, publishing and posting was completed. Robin Faucald, 7524 Kadler, asked if Kadler Avenue is reconstructed she feels there are some hills that need to be removed and is concerned that her horse barn and house will be too close to Kadler. She also wanted to know where Streets A and C go in this plat. Ms. Faucald also asked if the sewer and water lines will still continue along the Creek. Mr. Licht replied that if Kadler Avenue is reconstructed it will be with 75 foot right-of- ways and if any buildings need to be removed the owner would be compensated. Drainage issues are subject to the City Engineer review and Mr. Licht explained the ponding requirements. Commissioner Darkenwald asked the developer if there has been any interest in commercial development. Lucinda Gardner said the Welch Companies will be doing the marketing and they have received a lot of interest. Dan Licht explained that this area was originally guided for Industrial. Farr Development proposed a more integrated use. The question is when has the developer fulfilled the requirements for Commercial and Industrial development. All the utilities have been put in. Chair Nichols commented that you need residential to get the Industrial and Commercial. Mike Robertson explained that the City Council didn't want to get caught where the developer does nothing for Industrial and Commercial. CM Heidner replied that the developer is sitting on a lot of investment and feels they want to sell the lots. Chair Nichols closed the Public Hearing at 8:30 PM. Commissioner Black motioned to recommend to approve a Zoning . Map Amendment rezoning the proposed plat from A-1 District to PUD District and a Development Stage Plan/Preliminary Plat for Kittredge Crossings 101h Addition based upon a finding that the request is consistent with the Comprehensive Plan and subject to the 14 conditions listed in the Planner's Report. Seconded by Commissioner Darkenwald. All in favor. Motion carried. 3.5 Public Hearing for the City of Otsego: A. Consideration for amending the Zoning Ordinance Section 37 regarding sign regulations regarding institution project sians and freeway corridor signs. Dan Licht presented the Planner's Report. Judy Hudson attested all the proper posting and publishing was completed. Chair Nichols opened the Public Hearing at 7:45 PM. There was no public comment. Commissioner Black asked if space is limited. Mr. Licht explained that given the size of the properties and the fact this is limited to only the first tier of properties along the highway there shouldn't be a problem. No off site signage is allowed. Commissioner Darkenwald asked if the new development coming in along CSAH 42 would be allowed freeway signs. Planning Commission Meeting of May 2, 2005. Page 4. Mr. Licht said the big box users would be allowed signs. Hearing no public comment, Chair Nichols closed the Public Hearing at 7:50 PM . Commissioner Thompson recommend to amend the Zoning Ordinance of the City of Otsego to provide project development signs for institutional uses and establishment of a freeway corridor sign district along TH 101. Seconded by Commissioner Darkenwald. All in favor. Motion carried. 4. Any other Planning Commission Business. 4.1. Update on Council actions by CM Heidner. Councilmember Heidner updated the Planning Commission on recent Council actions. 4.2. Update on future Planning Commission Agenda Items by Judy Hudson. Judy Hudson updated everyone on future Agenda Items. 5. Adjournment by 9 PM. Commissioner Thompson motioned to adjourn. Seconded by Commissioner Hackman. All in favor. Motion carried.
