09-18-06 PCITEM 2.1 OTSEGO PLANNING COMMISSION MEETING OTSEGO CITY HALL SEPTEMBER 18, 2006 7 PM 1 Chair Nichols will call the meeting to order. Chair Nichols called the meeting to order at 7:00 pm. Roll Call: Chair Richard Nichols; Commission Members: Pam Black, Tom Darkenwald, Doug Hackman, Dave Thompson, Tammie Fallon, Jim Kolles. Troy Watring, Alternate. Staff: Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Administrator; Daniel Licht, City Planner and Tami Loff, Administrative Assistant. Council: Mayor Fournier, Councilmembers Vern Heidner and Mark Thorsted. 2 Consider the following minutes. 2.1. August 7, 2006 Planning Commission Meeting. Commissioner Black motioned to accept the minutes as presented. Seconded by Commissioner Hackman. All in Favor. Motion carried. 3. Planning Items: PUBLIC HEARINGS: 3.1. Riverbend North: A Zoning Map amendment rezoning from R-1 District to B-3 District. Commissioner Darkenwald stepped down for Items 3.1 and 3.2. Dan Licht presented the Planner's Report. Judy Hudson attested that proper noticing, posting and publishing was completed. John Darkenwald, Darkenwald's Riverbend Company II, agreed with Planner's Report. Chair Nichols opened the Public Hearing at 7:17 pm. Hearing no public comment, Chair Nichols closed the Public Hearing at 7:19 pm. Commissioner Hackman questioned the date and wording of Item 2 in decision 2. Mr. Licht explained the wording. Commissioner Black asked when the road construction work in that area will be done. Mike Robertson replied that the work is scheduled to be done next year. Commissioner Black motioned to approve a Zoning Map amendment rezoning land to be included within the Riverbend North Preliminary Plat to B-3 District based on a finding that the request is consistent with the Conprehensive Plan. Seconded by Commissioner Hackman. All in favor. Motion carried. B PUD-CUP/Preliminary Plat. Commissioner Fallon motioned to approve the PUD-CUP/Preliminary Plat and concept plan for Riverbend North subject to the eleven conditions listed on the Planner's report. Judy Hudson attested that proper noticing, posting and publishing was completed. Chair Nichols opened the Public Hearing at 7:29 pm. Hearing no public comments, Chair Nichols closed the Public Hearing at 7:30 pm. Chair Nichols asked if Item 10, Decision 2 could be removed from Planner's Report. Dan replied that could be removed. Commissioner Black motioned to approve a Zoning Map amendment rezoning land to be included within the Riverbend South Preliminary Plat to B-3 District based on a finding that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Fallon. All in favor. Motion carried. B PUD-CUP/Preliminary Plat. Commissioner Thompson motioned to approve the PUD-CUP/Preliminary Plat and concept plan for Riverbend South subject to the fourteen conditions listed on Planner's Report, deleting Item 10. Seconded by Commissioner Hackman. All in favor. Motion carried. 3.3. Anoka Equine: A Zoning Map amendment rezoning portions of the subject site from A-1 District and I-2 District to B-3 District. Dan Licht presented the Planner's Report. Kevin Voller, Anoka Equine, agrees with the Planner's Report. Judy Hudson attested that all proper noticing, posting and publishing was completed. Chair Nichols opened the Public Hearing at 7:40 pm. Commissioner Darkenwald was concerned with the access being limited to right-in/out only and questioned where most of the traffic would come from. Mr. Voller replied that most come in on west bound 70th Street from Highway 101. Most of the traffic will exit through Queens. Chair Nichols asked if the arena is open to public. Mr. Voller's response was no. Commissioner Hackman asked if the gravel should be a concern for the drainage ponds. Mr. Licht replied that the drainage ponds are designed for this and that the City Engineer hasn't raised any concerns. Hearing no public comments, Chair Nichols closed Hearing at 7:45 pm. Commissioner Black motioned to approve a Zoning Map amendment rezoning the subject site to B-3 District to accommodate in-place expansion of an existing building and consolidation of existing properties consistent with the Comprehensive Plan. Seconded by Commissioner Fallon. All in favor. Motion carried. B Preliminary Plat. Commissioner Thompson motioned to approve a Preliminary/ Final Plat and Site Plans subject to the six conditions listed in the Planner's Report. Seconded by Commissioner Kolles. All in favor. Motion carried. Planning Commission Meeting September 18, 2006. Page 3. 3.4. Wright -Hennepin CUP: A. CUP for Electric Distribution Substation. Dan Licht presented the Planner's Report. Judy Hudson attested that all proper noticing, posting and publishing was completed. Judy Hudson had heard from resident Darlene Lenz, 5900 Ochoa, she wants to make sure that there is enough screening. There is also a concern that this will effect the wetlands. Chair Nichols opened Public Hearing at 8:01 pm. Bill Sausser, 14650 60th St, owns property next to this site. He doesn't think this site is big enough and stated that he would like the engineer out to remeasure. Mr. Sausser checked with a realtor and feels this will effect his property value and he would like Wright- Hennepin to find a different location. Mr. Sausser also stated that he just received this notice two week ago. Mr. Licht replied that it meets all set backs, that the City has to give 10 days notice for hearings and that these uses are given preference under state law. Wayne Bauerschmidt, Wright -Hennepin Electric, said that they have tried to minimize the impact. Mr. Bauerschmidt said that site is 125 feet deep and 40 feet from 60ti" Street and that there are red flags out to identify the wetland boundary. Chair Nichols questioned the landscaping in the boundaries. Mr. Licht said that they are able to plant in the buffer. Commissioners are interested in having evergreen shrubs as screening along the south fence line. Councilmember Heidner asked about the structures. Mr. Bauerschmidt stated that the transmission tower will be 65 feet tall and the equipment buildings will be 55 feet tall Chair Nichols asked if this site is set up for expansion if necessary. Mr. Bauerschmidt replied that this will be an adequate size for a number of years. Commissioner Darkenwald asked why they choose this site. Mr. Bauerschmidt said that the transmission tower is right on the south side of 60th Street, it is a good location for future load setting and it would have minimal impact. Gerard Zachman asked about page 4 in the Planners Report about deed restrictions. Mr. Licht replied that is based on being smaller than 20 acres in an A-1 zone. Commissioner Hackman asked when they are planning on planting. Mr. Bauerschmidt replied next year they plan on doing the grading and landscaping at the same time. They will have class 5 brought in to help control the weeds. Total construction of the project will take 2 to 3 months. Hearing no other comments Chair Nichols closed the Public Hearing at 8:44 pm. Commissioner Darkenwald motioned to approve a CUP for an electric substation within an A-1 District, subject to the 7 conditions listed along with Condition 8. Grade land by October ist, 2007 and condition 9. Provide evergreens subject to staff review and have City Engineer double check setbacks. Seconded by Commissioner Black. All in favor. Motion carried. 3.5. Comp Plan Amendment: A Amendment of the Comprehensive Plan regardina future land uses northwest of CSAR 42 and 85t' Street. Dan Licht presented the Planner's Report. Judy Flemmer, 15165 95th, owns 10 acres guided for low density and commercial wants to know how the proposed Comprehensive Plan amendment will effect their assessment. Dan said it will not affect assessment. Chair Nichols closed the Public Hearing at 9:00 pm. Commissioner Thompson motion to approve an amendment to the Future Land Use Plan in accordance with Exhibit C based on a finding that the action is consistent with the policies of the Comprehensive Plan. Seconded by Commissioner Darkenwald. All in favor. Motion carried. 3.6. Zoning Text Amendment: A Amendment of the Zoning Ordinance related to building _materials allowed for buildings accessory to public uses. Dan Licht, presented the Planner's Report. Judy Hudson attested that the proper noticing, posting and publishing was completed. Chair Nichols opened the Public Hearing at 9:06 pm. Chair Nichols questioned if the Star News is the only paper that we send our notices to. Judy Hudson said yes. Chair Nichols closed the Public Hearing at 9:08 pm. Commissioner Thompson motion to approve a Zoning Ordinance amendment regarding allowed accessory building materials as drafted with corrections made to section 2 in the Planners Report filling should be changes to filing. Seconded by Commissioner Fallon. All in favor. Motion carried. 4 Any other Planning Commission Business. 4.1. Update on City Council actions by Councilmember Heidner. Councilmember Heidner updated the Commission on recent Council actions. 4.2. Update on future Planning Commission Agenda Items by Judy Hudson. Judy Hudson said there are no planning items. 5 Adjournment by 10 PM. Commissioner Darkenwald motioned to adjourn. Seconded by Commissioner Fallon. All in favor. Motion carried.
