RESOLUTION NO. 2015-45
RESOLUTION APPROVING RETAINER AGREEMENT WITH REINHARDT, WENDORF & BLANCHFIELD
WHEREAS, the law firm of Reinhardt, Wendorf & Blanchfield has commenced legal action on behalf of
municipalities in Minnesota and Wisconsin related to the effect on municipal wastewater treatment
plants of products referred to as flushable wipes; and
WHEREAS, the Council has received and had a chance to review information related to this proposed
class action lawsuit; and
WHEREAS, a number of Minnesota cities have joined in this litigation; and
WHEREAS, the City of Otsego's wastewater treatment facilities have been adversely affected by
flushable wipes; and
WHEREAS, participation in the litigation will be of minimal cost and inconvenience to the City, but may
allow it to recover compensation resulting from damage caused by said products; and
WHEREAS, the City Council has determined that it is in the best interests of the City and its citizens to
become a named plaintiff in the current litigation.
NOW, THEREFORE, BE IT RESOLVED as follows by the City Council of the City of Otsego, Wright County,
Minnesota:
1. The City Council hereby approves the attached Retainer Agreement with Reinhardt, Wendorf &
Blanchfield and authorizes and directs execution of the same by the appropriate officer(s) or
employee of the City of Otsego.
