06-16-08 PCITEM 2_1 OTSEGO PLANNING COMMISSION MEETING OTSEGO CITY HALL JUNE 16, 2008 7 PM 1. Chair Black will call the meeting to order. Chair Black called the meeting to order at 7:00 PM. Roll Call: Chair Pam Black, Planning Commission Members: Richard Nichols, John Thelen, and David Thompson. Absent: Tammie Fallon, Doug Hackman and Jim Kolles. Staff: Mike Robertson, City Administrator; Dan Licht, City Planner; and Tami Loff, Deputy Clerk. Council: Mayor Larry Fournier, CM Heidner and CM Thorsted. 2. Consider the following minutes. 2.1. June 2, 2008 Planning Commission Meeting. Commissioner Thelen motioned to approve as written. Seconded by Commissioner Nichols. All in favor. Motion carried. 3. Planning Items: PUBLIC HEARING ITEMS: 3.1. Otsego Autocare: A. Conditional Use Permit (CUP) for a minor auto repair/tire store. B. Final Plat. City Planner Dan Licht presented the Planner's Report. Applicant, Sue Nelson, Otsego Autocare owner, agrees with the conditions. Deputy Clerk Tami Loff attested that all proper noticing, publishing and posting was done. Chair Black opened the Public Hearing at 7:12 PM. Commissioner Thelen asked about the color of building. Mr. Licht said that they are reviewing the exterior. Tom Brown, applicant, said that they have looked at a lot of different colors. They will come up with a color to meet city requirements. Chair Black opened for Public comment. Hearing no public comments Chair Black closed the Public Hearing at 7:14 PM. Commissioner Thompson motioned to approve a CUP allowing minor auto repair and the Shoppes at Great River Centre 2nd Addition Final Plat subject to the sixteen conditions listed in the Planner's Report. Seconded by Commissioner Thelen. All in favor. Motion carried. Planning Commission Meeting June 16, 2008. Page 2. 3.2. Zoning Ordinance amendment relating to a noncommercial sign exemption. City Planner Dan Licht presented the Planner's Report. Chair Black opened the Public Hearing at 7:20 PM. Kathy Roberts, 9823 Kadler Ave, Otsego Festival Committee, asked if this pertains only on election years. Mr. Licht said it's every year. Commissioner Thompson asked if there is a size limit on the signs. Mr. Licht said no. Mike Robertson said that there will be a 15 ft setback at street corners so sightlines are not blocked. Commissioner Nichols asked if it is a City Ordinance that requires the 15 ft setback. Mr. Licht replied yes. Chair Black opened for public comment. Rose Cassady, 8189 Packard Ave, Otsego Festival Chair, said that this will be great advertising for the Otsego Festival. They will probably have about 4-5 signs this year. Mayor Fournier said that Rose Cassady does a great job with the Otsego Festival. Chair Black closed the Public Hearing at 7:25 PM. Commissioner Nichols asked about non- commercial speech, does that mean no one can put up a sign in their yard other than this time. Mr. Licht said that there is another City Ordinance that would allow it. Commissioner Thompson motioned to approve as drafted. Seconded by Commissioner Nichols. All in favor. Motion carried. 3.3. Zoning Ordinance amendment relating to state licensed day care and residential care facilities. City Planner Dan Licht presented the Planner's Report. Chair Black opened the Public Hearing at 7:31 PM. Deputy Clerk Tami Loff attested that all proper noticing, publishing and posting was done. Mike Robertson said that the City has limited ability under State Law to regulate these facilities and the update was to bring the city in line with current State Law. Hearing no public comments Chair Black closed the Public Hearing at 7:32 PM. Commissioner Nichols motioned to approve as drafted. Seconded by Commissioner Thompson. All in favor. Motion carried. 4. Any other Planning Commission Business. 4.1. Update on Citv Council actions by Councilmember Heidner. CM Heidner updated the Commission on recent City Council actions. 4.2.
