05-18-09 PCITEM 2.1 OTSEGO PLANNING COMMISSION MEETING OTSEGO CITY HALL MAY 18, 2009 7 PM 1. Chair Black will call the meeting to order. Chair Black called the meeting to order at 7:03 PM. Roll Call: Chair Pam Black; Commission Members: Tammie Fallon, David Thompson and John Thelen. Commissioner Jim Kolles arrived at 7:06 PM. Absent: Richard Nichols, Doug Hackman and alternate Brian Gerten. City Council: CM Thorsted. Staff: Dan Licht, City Planner, Mike Robertson, City Administrator and Tami Loff, City Clerk. 2. Consider the following minutes. 2.1. April 6, 2009 Planning Commission Meeting. Commissioner Thompson motioned to accept the minutes as written. Seconded by Commissioner Fallon. All in favor. Motion carried. 3. Planning Items: PUBLIC HEARINGS: 3.1. Peggy Johnson: A. Conditional Use Permit for commercial recreation within an A-1 District. City Planner Daniel Licht presented the Planner's Report. The applicant had no comments. City Clerk Tami Loff attested that all proper noticing, publishing and posting was completed. City Planner Licht said he received a call from St. Michael School District with questions on use. Chair Black opened the Public Hearing at 7:09 PM. There were no public comments. Commissioner Thelen asked the difference between a Conditional Use Permit (CUP) and Interim Use Permit (IUP). City Planner Licht said a CUP is an approval that runs with the property and IUP is similar but the city has the ability to establish an end date for the use. Commissioner Thelen asked if there anything to prevent Mrs. Johnson from getting other animals such as tigers. City Planner Licht said that is addressed in the first condition, only allowing animals defined as domestic animals or farm animals. Chair Black closed the Public Hearing 7:15 PM. Commissioner Thompson motioned to approve a CUP allowing commercial recreation subject to the eleven conditions listed in the Planners report. Seconded by Commissioner Thelen. All in favor. Motion carried. Planning Commission Meeting May 18, 2009. Page 2. 3.2 Amendment of the City Code: A. Regulation of pawn shops and second hand goods dealers. B. Minimum lot area requirements and platting of stormwater drainage basins, wetlands and wetland buffers. C. Allowance of more than one driveway from a public street to single family lots within the R-1, R-2 and R-3 Districts. City Planner Daniel Licht presented the Planner's Report. City Clerk Tami Loff attested that all proper noticing, publishing and posting was completed. Chair Black opened the Public Hearing at 7:26 PM. Commissioner Thompson said regarding the minimum lot area for stormwater ponds, how many have we approved this way. City Planner Licht said Crimson Ponds is the only development that platted the ponds separate. In other developments they are established as easements. Commissioner Fallon said regarding the allowance of more than one driveway, on improvements to the streets are they assessed double for two driveways? City Administrator Robertson said in the past the city used a unit assessment instead of footage or driveways. Hearing no public comments Chair Black closed the Public Hearing at 7:41 PM. Commissioner Thompson motioned to approve amendments to the Zoning Ordinance and Subdivision Ordinance as presented. Seconded by Commissioner Kolles. All in favor. Motion carried. 4. Any other Planning Commission Business. 4.1. Update on Citv Council actions by Councilmember Thorsted. Council Member Thorsted and City Administrator Robertson updated the Commission. 4.2. Update on future Planning Commission Agenda Items by Tami Loff. No items for June. 5. Adjournment by 10 PM. Commissioner Fallon motioned to adjourn. Seconded by Commissioner Thompson. All in favor.
