11-02-09 PCITEM 2.1 OTSEGO PLANNING COMMISSION MEETING OTSEGO CITY HALL NOVEMBER 2, 2009 7 PM 1. Chair Black will call the meeting to order. Chair Black called the meeting to order at 7 PM. Roll Call: Chair Pam Black; Commissioners: Dave Thompson, John Thelen, Aaron Stritesky and Tammie Fallon. Absent: Richard Nichols, Jim Kolles and Brian Gerten. City Council: CM Vern Heidner and Mayor Jessica Stockamp. Staff: Dan Licht, City Planner; Mike Robertson, City Administrator and Tami Loff, City Clerk. 2. Consider the following minutes. 2.1. October 5, 2009 Planning Commission Meeting. Commissioner Fallon motioned to approve as written. Seconded by Commissioner Stritesky. Motion carried 4-0. Commissioner Thompson abstained. 3. Planning Items: PUBLIC HEARING: 3.1. Jeanette Carron: A. Zoning Map amendment to zone the subject site A-2 District. B. Preliminary and Final Plat approval of three (3) lots. C. Conditional Use Permit (CUP) for a lot less than 20 acres. City Planner Dan Licht presented the Planner's Report. Applicant Denise McAlpine asked if all houses that are sold in Otsego pay Park fees. City Planner Licht said only newly platted lots pay a onetime fee for each parcel. City Clerk Tami Loff attested that proper noticing, posting and publishing was completed. Chair Black opened the Public Hearing at 7:06 PM. Floyd Goenner, 8013 Nashua, said he has drain tiles in the ravine that runs south. City Planner Licht said there is a drainage and utility easement that covers that and the drain tile would not be affected by the proposed plat. Chair Black closed the Public Hearing at 7:08 PM. Commissioner Fallon motioned to approve a Zoning Map amendment rezoning the subject site from A-1 District to A-2 District based on a comment that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Thompson. All in favor. Motion carried. Commissioner Thompson motioned to approve a CUP and Preliminary/ Final Plat for the Carron Addition, subject to the nine conditions listed in the Planner's report. Seconded by Commissioner Stritesky. PUD -CUP to allow side yard setbacks of 10 feet to the principal building and five feet to an attached garage constructed on lots within Martin Farms. City Planner Dan Licht presented the Planner's Report. Chair Black opened the Public Hearing at 7:10 PM. Applicant Joe Jablonski, Lennar, said that condition #3 regarding exterior mechanical equipment being located in rear lots, is something they would like to continue working with Staff, on some walk outs it would be hard to put it in the rear yard and they would prefer the side yard. City Planner Licht said they can work with either the rear yard or side yard. City Clerk Tami Loff attested that proper noticing, posting and publishing was completed. Mr. Jablonski said there was a Martin Farms neighborhood meeting held and this plan was presented to those residents and they were excited that something was going to be done. Commissioner Thompson asked if there will be potential for two garages facing each other or will garages always be on the opposite side. City Planner Licht said they could face one another but there will always be a 15 ft setback, 5 on one side and 10 on the other side. Commissioner Thompson said some of these vacant lots are sold and do not have houses on them yet. He is concerned that with the change in setbacks people may not be getting what they thought. City Planner Licht said they did look at this and most of the lots are owned by builders and City Staff will work with Lennar to maximize the building separation when reviewing the grading plans. Commissioner Thelen asked Mr. Jablonski what it is about your houses that are different than what was proposed before. Mr. Jablonski said they would be a smaller footprint. Commissioner Fallon asked if the intention is to build and then sell or sell then build. Mr. Jablonski said they would like to have homes pre sold before they build but they will probably build some models. Chair Black closed the Public Hearing at 7:22 PM. Commissioner Fallon said she is not in favor of adjusting the setbacks unless there are more restrictions. Commissioner Thelen motioned to approve a PUD -CUP subject to the four conditions listed in the Planner's Report. Seconded by Commissioner Stritesky. Motion carried 4-1. Commissioner Fallon opposed. 3.3. Amendment of Section 21-7-18 of the Subdivision Ordinance regarding park and trail dedication requirements. City Planner Licht presented the Planner's Report. Because the Wright County Assessor has noted a large drop in land values there is a $480 decrease in park fees. City Clerk Tami Loff attested that proper noticing, posting and publishing was completed. Chair Black opened the Public Hearing at 7:30 PM. Planning Commission Meeting November 2, 2009. Page 3. Hearing no comments, Chair Black closed the Public Hearing at 7:31 PM Commissioner Thompson motioned to recommend the change of $2,600. Seconded by Commissioner Thelen. All in favor. Motion carried. 4. Any other Planning Commission Business. 4.1. Update on City Council actions by Councilmember Heidner. CM Heidner updated the Commission. 4.2. Update on future Planning Commission Agenda Items by Ta m i Loff. No meeting November 16th, 2009. 5. Adjournment by 10 PM. Commissioner Fallon motioned to adjourn. Seconded by Commissioner Thompson.
