BACKGROUND/JUSTIFICATION:
The City of Otsego has initiated processing a preliminary and final plat to adjust the boundaries between
Lot, 1, Block 2, Otsego City Campus Addition, which includes the City Hall/Public Works facility, and the
parcel owned by Timothy and Kimberly Melcher to eliminate the irregular lot line between the two
parcels where the Melcher's property extends into the public works storage area. The proposed
preliminary/final plat will convey to the Melchers a parcel 20,109 square feet on the north side of their
lot and a parcel 17,475 square feet will be conveyed to the City from the west portion of the Melcher
lot. There is also 7,436 square feet of prescriptive easement for Napier Avenue at the front of the
Melcher property to be platted as right-of-way. The City is also processing a Zoning Map amendment
concurrent with the subdivision application such that the property attached to each lot is zoned
consistent with the existing zoning designation. The Planning Commission held a public hearing to
consider the applications on Tuesday, 8 September 2015 at 7:OOPM. There were no public comments
and no comments from the Planning Commission. The public hearing was closed and the Planning
Commission voted 5-0 to recommend approval subject as outlined in the attached findings of fact and
ordinance.

BACKGROUND
The City of Otsego has initiated processing a preliminary and final plat to adjust the boundaries
between Lot, 1, Block 2, Otsego City Campus Addition, which includes the City Hall/Public
Works facility, and the parcel owned by Timothy and Kimberly Melcher to eliminate the
irregular lot line between the two parcels where the Melcher's property extends into the public
works storage area. The proposed preliminary/final plat will convey to the Melchers a parcel

ANALYSIS
Zoning. The City property is zoned INS, Institutional District. The City Hall and Public Works
facility is allowed as a conditional use within the INS District. The change in lot lines does not
increase the intensity of the use of the City property and thus no amendment of the CUP is
required. The Melcher property is zoned A-1, Agriculture Rural Service District. The Melcher's
single family dwelling is a permitted use in the A-1 District. A Zoning Map amendment is being
processed to zone the parcels attached to the City property and Melcher property INS District
and A-1 District, respectively, so as to be consistent with the balance of the lots. The Zoning
Map amendment is to be considered based upon, but not limited to, the criteria established by
Section 20-3-2.F of the Zoning Ordinance:
1. The proposed action's consistency with the specific policies and provisions of the Otsego
Comprehensive Plan.
Comment: The Comprehensive Plan guides the City property for public uses and the
Melcher property for low density residential uses. Both properties are within the long
range urban service area and are served by individual on site utilities. The adjustment
of the boundary between the two lots is minor and does not affect the character or
principal use of either parcel, which is consistent with the Comprehensive Plan.
2. The proposed use's compatibility with present and future land uses of the area.
Comment: The proposed preliminary/final plat will not change the use of the City or
Melcher properties and is not expected to have any effect to surrounding rural
residential properties adjacent to the subject site.
3. The proposed use's conformity with all performance standards contained within the
Zoning Ordinance and other provisions of the City Code.
Comment: The proposed preliminary/final plat will comply with all applicable
requirements of the Zoning Ordinance and Subdivision Ordinance.
4. Traffic generation of the proposed use in relation to capabilities of streets serving the
property.
Comment: The proposed preliminary/final plat will not increase traffic generated by
the City or Melcher property and will not change the existing access of either property to
City streets.

5. The proposed use can be accommodated by existing public services and facilities and
will not overburden the City's service capacity.
Comment: The proposed preliminary/final plat will have no effect on public services, but
was initiated by the City so as to make more efficient utilization of its Public Works
facility.
Lot Requirements. The City parcel will be 30.23 acres and the Melcher property will be 2.39
acres as shown on the proposed preliminary/final plat, both of which exceed the minimum lot
area requirements of the respective INS District (five acres) and A-1 District (one acre). The
preliminary/final plat has no effect on the width of either lot. The preliminary/final plat also
has no effect on the existing principal or accessory buildings within each lot complying with
minimum setbacks.
Right -of -Way. The proposed preliminary/final plat includes dedication of right-of-way for
Napier Avenue fronting the Melcher property, which exists by prescriptive easement. The area
of the right-of-way is 7,436 square feet. Dedication of the right-of-way does not affect the
compliance of the Melcher lot with minimum lot area and width requirements or front yard
setback requirements of the A-1 District.
Easements. The proposed preliminary/final plat illustrates 10 foot wide drainage and utility
easements at the perimeter of each lot as required by Section 20-7-15 of the Subdivision
Ordinance.
Utilities. The City Hall/Public Works facility and Melcher home are each served by individual
on -site septic and well systems. The preliminary/final plat has no effect on these systems.
Grading. No site development work is planned as part of the proposed preliminary/final plat
and no grading plan has been prepared.
Park Dedication. No new lots are being created as a result of the preliminary/final plat so park
dedication requirements in Section 21-7-18 of the Subdivision Ordinance are not applicable.
Development Agreement. No development agreement is required as there are no public
improvements being installed with the proposed preliminary/final plat.
RECOMMENDATION
The proposed preliminary/final plat complies with the requirements of the Zoning Ordinance
and Subdivision Ordinance. Our office recommends approval of the applications as outlined
below.

CITY COUNCIL MEETING: 14 September 2015
FINDINGS: Based upon review of the application and evidence received, the Otsego City Council
now makes the following findings of fact:
A. The property is identified as PI Ds 118-246-002010 and 118-500-173401 within the City of
Otsego, County of Wright, State of Minnesota.
B. The properties lie within the Urban Service Expansion Area and are guided for public and low
density residential land uses by the 2012 Otsego Comprehensive Plan, as amended.
C. The properties are zoned INS, Institutional District and A-1, Agricultural Rural Service
District; the Zoning Map is proposed to be amended such that the boundaries of respective
zoning districts correspond to lot lines of the Otsego City Campus 2"d Addition
Preliminary/Final Plat.
E. The Planning Commission and City Council must take into consideration the possible effects
of the Zoning Map amendment with their judgment based upon (but not limited to) the criteria
outlined in Section 20-3-2.F of the Zoning Ordinance:

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
OTSEGO TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FOR LAND
WITHIN THE OTSEGO CITY CAMPUS 2ND ADDITION.
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. The official Zoning Map of the Otsego Zoning Ordinance is hereby
amended to change the zoning classification of the property legally as Lot 1 and 2,
Block 1, Otsego City Campus 2nd Addition, City of Otsego, Wright County, Minnesota.
Section 2. Lot 1, Block 1, Otsego City Campus 2"d Addition is hereby rezoned to
INS, Institutional District.
Section 3. Lot 2, Block 1, Otsego City Campus 2nd Addition is hereby rezoned to
A-1, Agriculture Rural Service District.
Section 4. The Zoning Map of the City of Otsego shall not be republished to
show the aforesaid rezoning, but the Zoning Administrator shall appropriately mark the
Zoning Map on file at City Hall for the purpose of indicating the rezoning hereinabove
provided for in this Ordinance, and all of the notations, references and other information
shown thereon are hereby incorporated by reference and made part of this Ordinance.
Section 5. This Ordinance shall become effective immediately upon its passage
and publication according to Law.
