RESOLUTION NO. 2001-33
RESOLUTION APPROVING VACATION OF PORTION OF A ROAD
IN THE CITY OF OTSEGO, COUNTY OF WRIGHT- PARSON AVENUE N.E.
WHEREAS, the City of Otsego has received a request to vacate the above-described
roadway from one of the affected property owners, Pulte Homes of Minnesota, Inc.;
and
WHEREAS, the Otsego City Council, on its own motion, ordered a public hearing
on the proposed vacation; and
WHEREAS, those portions of the road to be vacated are described as follows:
That part of Parson Avenue N.E., as originally laid out and traveled in the City of
Otsego, which lies northerly of the northerly right of way line of 70`h Street N.E.
(CSAR No. 37) and lying westerly of the southwesterly right of way line of
Quaday Avenue N.E., as originally laid out and traveled.
WHEREAS, the City Council has determined that vacating said portion of Parson
Avenue N.E. would be in the public interest; and
WHEREAS, the City of Otsego having considered the testimony in favor and
opposed to vacating that portion of the road so described; and
WHEREAS, the City Council ordered a public hearing and meeting to act upon said
proposed vacation at 6:30 p.m. on the 29`h day of October, 2001, at the Otsego City
Hall; and
WHEREAS, all legal requirements regarding giving notice have been satisfied; and
WHEREAS, the Town Board did meet on the 29th day of October, 2001, at the
Otsego City Hall and heard all parties interested therein, and;
WHEREAS, it now appears to the Otsego City Council that such portion of said
roadway serves no useful purpose;
NOW, THEREFORE, the City Council of the City of Otsego, Wright County,
Minnesota, hereby orders:
1. That the portion of that town road located in the City of Otsego, Wright County,
Minnesota, described as follows:
That part of Parson Avenue N.E., as originally laid out and traveled in the
City of Otsego, which lies northerly of the northerly right of way line of
70 Street N.E. (CSAH No. 37) and lying westerly of the southwesterly
right of way line of Quaday Avenue N. E., as originally laid out and
traveled.
is hereby vacated.
2. The City Council hereby determines that vacation of said road shall cause no damage
to any abutting or nearby property owners and therefore no damages are awarded to
any such property owners.
Motion for adoption of resolution by Vern He idner seconded by

October, 2001.

NOTICE OF COMPLETION OF PROCEEDINGS
VACATION OF A PORTION OF A ROAD
The City of Otsego, Wright County, Minnesota, did on the 291h day of October 2001, by
resolution duly passed, vacate that portion of a roadway located in the City of Otsego
described as follows:
That part of Parson Avenue NE as originally laid out and traveled in the City of Otsego,
which lies northerly of the northerly right of way line of 70`h Street NE (CSAH No. 37)
and lying westerly of the southwesterly right of way line of Quaday Avenue NE as
originally laid out and traveled.
All City Council Members voted in favor of the resolution.
