Chair Carl Swenson called the Planning Commission Meeting to order at 8:00 PM.

2. Consideration of the Planning Commission Minutes of April 16,1197:
Richard Nichols moved adoption. Ing Roskaft seconded. All in favor. Motion carried.
3 HEARING for Charles Klein 8045 Ochoa Avenue NE, Otsego, MN 55330
PID # 118-037-001140 described as Lot 14., Block 1, Walesch Estates, Second
Addition in Section 21, Township 121 Range 23, Wrighto un y, MN. Request is as
_follows:
A Conditional Use Permit to allow relocation of a home (move in to replace
single wide mobile home,)
Mr. Kirmis - Mr. Charles Klein requested a CUP to allow a relocated singe family
residence. Property is zoned R-3, Res. Immediate Urban service area. Driveway surface
requirements are to be in accordance with existing ordinance or pending amendment. NAC
recommends approval of the requested building relocation contingent upon the fulfillment
of ten conditions in report dated May 15, 1997, which Mr. Kirmis read. Larry Koshak,
City Engineer, had recommendations in letter dated May 19, 1997, wetlands need to be
delineated, septic tank drainfield setback requirements need to be met. Also
recommended the movers be responsible for any damage to the streets.
Chair Swenson opened the Hearing to the public for any questions or comments. None
Brought discussion back to the Planning Commission.
Richard Nichols - Regarding Hakanson Anderson's letter dated May 19, 1997, had
questions on septic systems that don't meet current wetland setbacks.
Mr. Kirmis - Typically a CUP request with a non -conforming septic system is an issue for
the Building Official or City Engineer. In this case the applicant plans to upgrade his
system.

Eugene Goenner - Did not feel the mover should be responsible for road damage because
the road is in such poor condition there.
Mr. Kirmis - Mover is responsible for road damage. This is always the case just hasn't
gotten into the reports before. Recommended adding a condition that there is no adverse
impact. State permit may require insurance be in place to correct any damage.
Elaine Beatty - In the past the mover has been required to be licensed and bonded.
Eugene Goenner recommended adding the word excessive to the Engineers report.
Chair Swenson - Asked the applicant if he wished to comment.
Charles Klein - He will be having a new mound septic system put in by Dan Reed. The
mover is licensed and bonded and does carry insurance. Also, he can provide any other
information the city may need.
Chair Swenson closed the Hearing.
RICHARD NICHOLS MOTIONED APPROVAL OF CUP REQUEST WITH 11
CONDITIONS OF NAC'S REPORT AND RECOMMENDED CHANGE TO
ENGINEER'S REPORT ADDING "EXCESSIVE" DAMAGE. ING ROSKAFT
SECONDED. ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
This will be on Tuesdays City Council Meeting May 27, 1997, 6:30 PM.
A Conditional Use Permit to allow more than one Residential Driveway
(curh cu) for a singe farnily dwell
Mr. Kirmis - Gregory and Linda Strommen have requested approval of a CUP to allow for
a second curb cut for their lot located south of 85th and west of Palmgren Avenue NE.
Access to the detached garage via the property's existing curb cut would present
significant difficulties due to the location of a well and tree within the front yard of the lot.
The City Engineer, in letter dated May 19, 1997, expressed concern with obstruction in
the flow line of the ditch, possible precedent being set. The City Engineer objects to the
second curb cut. (see attached) The ordinance does allow a second driveway with a
CUP. NAC recommends approval of the CUP request to allow a second curb cut subject
to 4 conditions listed in NAC's report dated May 12, 1997, which Mr. Kirmis read.
Chair Swenson opened the hearing to the public for questions and comments. None

Richard Nichols asked the applicant if there was a culvert under the existing driveway and
if the proposed garage could be accessed.
Mr. Strommen - Yes there is a culvert, but if pulling a trailer it wouldn't make the turn
with the well and a tree so close.
Chair Swensnon - The City Engineer commented that it violates the subdivision overlay
plans.
Mr. Kirmis - Didn't see this as a major impact, however, if sewer comes they will be
responsible for those costs.
Richard Nichols - This would be the first 2nd curb cut, but there are limits to how close
you can get to a well. He wouldn't object to allowing the 2nd curb cut..
Eugene Goenner - There is 17 feet from the ditch to the well. It appears could make that
corner without a second curb cut. Could the paving be deleted?
Mr. Kirmis - Accessory buildings housing mowers etc. do not require a driveway,
however, vehicular accesses require paving.
Richard Nichols - This is a newer development. Allowing the second curb cut with the
driveway paved would be best.
Arleen Nagel - Item #3, Recommendations, The proposed driveway is surfaced in asphalt.

amendment?
Mr. Kirmis - Except on gravel roads. It is intended to bring developments to current
standards. Since 1992 if development is platted it needed to be paved.
CM Berning - At the last City Council meeting it was brought to our attention that any
upgrade (septic system, deck, etc.) over $2,500.00 a driveway upgrade is needed. This
seems extreme.
Eugene Goenner - Could it be required that the second curb cut be placed in such a way
that at the time of re -subdivision it would become their driveway?
Mr. Kirmis - It would be appropriate to consider where the second house would be built.
Also asked if applicant intended to pave the driveway.
Mr. Strommen - Yes.
Chair Swenson - Went back to public for comment. None. Closed public hearing and
brought discussion back to the Planning Commission.

ARLEEN NAGEL VOTING IN FAVOR. EUGENE GOENNER OPPOSED.
EUGENE GOENNER MOTIONED TO AMEND - CURB CUT BE PLACED
CONDUCIVE TO SUB -DIVISION OF THE LOT. ARLEEN SECONDED.
AMENDMENT FAILED 4 TO 2 WITH EUGENE GOENNER AND ARLEEN
NAGEL IN FAVOR AND CARL SWENSON, RICHARD NICHOLS, ING
ROSKAFT, AND BILL JONES, OPPOSED.
This will be on the City Council Agenda June 9, 1997, at 6:30 PM.
A Conditional Use Permit to allow more than one detached private garage
or accessory structure for each single fanny dwelling,
Mr. Kirmis - Read applicants request for approval of a CUP to allow more than one
detached accessory structure. The applicant requests constructing a 832 sq ft (26 x 24)
detached garage. Presently there is a 1,008 sq ft detached accessory garage and a 64 sq ft
utility shed on R-3 zoned property. NAC recommended approval of applicants request
with five (5) conditions which he read. The City Engineer issues were that the applicant
continue using the existing driveway and that the proposed building does not change the
drainage patterns.
Chair Swenson - Opened the Hearing to the public and asked if anyone wished to be
heard. No one did. Brought discussion back to the Planning Commission.
CM Berning asked if Item # 2, 3, and 4, under Recommendation are required.
Mr. Kirmis - Whatever is decided by the City Council regarding the amendment will apply.

Mr. Kirmis - Attached is a draft amendment which would allow building relocations for
newly constructed homes assembled off site via administrative permitting rather than CUP.
Potential adverse impacts may be satisfactorily addressed through the existing
performance standards and security requirements. See Memorandum dated May 5, 1997.
ING ROSKAFT MOTIONED JULY 2, 1997 BE SET FOR HEARING. RICHARD
NICHOLS SECONDED THE MOTION. ALL IN FAVOR. MOTION CARRIED.
7 Any Other Planning Commission Business:
CM Berning gave Sewer update. The next joint sewer meeting will be at Dayton at
7:OOPM, May 28, 1997. Also there meeting with Darkenwalds regarding sewer and water
on June 3, 1997. The City met with two developers on May 13, 1997. The City has not
received a proposal yet.
