City Staff recommends approval of Resolution 2015-51 which orders a hearing for a proposed
assessment for a Packard Avenue Street Improvements between 60th St and 70th St.

BACKGROUND/JUSTIFICATION:
City Council authorized the preparation of a Feasibility Study to determine what needs to be completed
to remedy the issues, determine a cost estimate and allocate costs. A public information meeting was
held to present the study to the residents. City Council accepted the feasibility report and ordered plans
and specifications. City Council then ordered advertisement for bids and awarded the project. All
criteria are in accordance with MN State Statue 429 for projects with the potential for assessments.
Packard Avenue between 60th St and 701h St was improved this summer. Patching of severely
deteriorate portions of the street, a leveling course, a wear course and shouldering were completed.
Attached is a resolution ordering a public hearing on a proposed assessment for Packard Avenue Street
Improvements between 60th St and 70th St. The Public Hearing is scheduled for October 12th as part of
the regularly scheduled City Council Meeting.

RESOLUTION NO. 2015-51
RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT
WHEREAS, by a resolution passed by the Council on April 13th, 2014, the City
Clerk was directed to prepare a proposed assessment of the cost of improving Packard
Avenue from 60th Street to 70th Street included shouldering, patching, and bituminous
surfacing.
AND WHEREAS, the Clerk has notified the council that such proposed
assessment has been completed and filed in this office for public inspection,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OTSEGO MINNESOTA.
1. A hearing shall be held on the 12th day of October, 2015, in the Prairie
Center Council Chambers Hall at 7:00 P.M. to pass upon such proposed assessment
and at such time and place all persons owning property benefited by such improvement
will be given an opportunity to be heard with reference to such assessment.
2. The City Clerk is hereby directed to cause a notice of the hearing on the
proposed assessment to be published once in the official newspaper at least two weeks
prior to the hearing, and shall state in the notice the total cost of the improvement. The
clerk shall also cause mailed notice to be given to the owner of each parcel described in
the assessment roll not less than two weeks prior to the hearings.
3. The owner of any property so assessed may, at any time prior to
certifications of the assessment to the county auditor, pay to the city clerk the whole of
the assessment on such property, with interest accrued to the date of payment. No
interest shall be charged if the entire assessment is paid within 30 days from the date of
the adoption of the assessment. The owner may at any time thereafter, pay to the city
clerk the entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must be
made before November 15 or interest will be charged through December 31 of the
succeeding year.
