ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: State Statues require that transactions, typically contracts or large purchases, between the City and a business in which a Council Member has a financial interest be formally acknowledged and authorized by the governing board. Metro Appliance Recycling, owned by Council Member Warehime, is a vendor of the City; thus this request. Periodically, the City needs to dispose of recyclable and other items that either are no longer usable or have been collected from road ditches and other public areas owned by the City. It is most convenient and cost effective to dispose of those items at a vendor with a location close to City facilities. Metro Appliance Recycling is within the Otsego city limits and is able to meet the City's disposal needs for many items. The amounts paid to Metro Appliance Recycling are small and sporadic based on the volume of items picked -up by the Public Works Department or recycled by the IT Department. The City Council acknowledged the transactions with Metro Appliance Recycling previously when Council Member Warehime joined the Council, and he has consistently abstained from voting on matters related to Metro Appliance Recycling. Motion to approve Resolution 2015-53 Regarding Ongoing Transactions Between City of Otsego and Metro Appliance Recycling BUDGET INFORMATION FUNDING: BUDGETED: X ❑ YES N/A ❑ NO ACTION TAKEN ❑ APPROVED AS REQUESTED ❑ DENIED ❑ TABLED ❑ OTHER (List changes) COMMENTS: CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO. 2015-53 RESOLUTION REGARDING ONGOING TRANSACTIONS BETWEEN CITY OF OTSEGO AND METRO APPLIANCE RECYCLING WHEREAS, the City of Otsego (CITY) occasionally has to dispose of recyclable or other materials; and WHEREAS, Metro Appliance Recycling (METRO) is the sole vendor supplying such services within the CITY; and WHEREAS, a sitting Otsego City Council Member is the owner of Metro Recycling; and WHEREAS, the prices charged by METRO are as low as or lower than other similar services within the general area; and WHEREAS, the disposal of recyclable and other materials from time to time by CITY is an ongoing need that occurs from time to time and payments are usually minimal; and WHEREAS, it is not feasible or practical to enter into separate contracts and acquire Council approval for each such transaction which are more in the nature of standard ongoing small purchases of supplies and services. NOW, THEREFORE be it resolved by the City Council of the City of Otsego, Minnesota as follows: That the City Council hereby authorizes and approves ongoing payments for recycling and disposal services from METRO for nominal amounts as the need for such services is determined by City staff. That the City Council hereby retroactively approves all such payments made to METRO prior to adoption of this Resolution. ADOPTED this 28t' day of September, 2015 by the Otsego City Council.
