02-01-99 PCCITY OF OTSEGO PLANNING COMMISSION/CITY COUNCIL MEETING MONDAY, FEBRUARY 1, 1999 - 8PM MINUTES 1. Chair Carl Swenson will call meeting to order: Chair Swenson called the meeting to order at 8PM. ROLL CALL: Chair Carl Swenson, Richard Nichols, Arleen Nagel, Patrick Moonen, Jim Kolles, Gene Goenner, Bruce Rask and Christian Mbanefo, Alt. from the Planning Commission. Mayor Larry Fournier, Vern Heidner, Virginia Wendel, Suzanne Ackerman and Mark Berning, Council Members. Elaine Beatty, City Clerk/Zoning Administrator and Dan Licht, City Planner from Staff. CM Heidner introduced the new members Bruce Rask, reappointed, and Patrick Moonan, newly appointed to the Planning Commission. Chair Swenson added 5.A. Election of Officers to the agenda. 2. Consideration of the Planning Commission Minutes of: A. P.C. Minutes of Monday, January 4,1999 B. P.C./CC Workshop of Wednesday, January 20,1999 RICHARD NICHOLS MOTIONED TO ADOPT THE PLANNING COMMISSION MINUTES OF MONDAY, JANUARY 4, 1999 AS WRITTEN. GENE GOENNER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. ARLEEN NAGEL MOTIONED TO ADOPT THE MINUTES OF THE P.C./CC WORKSHOP OF WEDNESDAY, JANUARY 20,1999 AS WRITTEN, GENE GOENNER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 3. Continue Review of Accessory Building for the Large Lot unsevered Development(With undated information from NAC) Dan Licht, City Planner gave an explanation of the amendments to the Zoning Ordinance proposed in his memo of January 27, 1999. He noted that this was brought back for comment from the group to see if this is what was intended. Richard Nichols asked in the No Sewer District, why is it 1500 sq. ft maximum? He did not feel it was a very large difference. Mr. Licht explained they could have two buildings. More discussion of what was intended and the large size of one building was the problem trying to be solved. Virginia Wendel asked if farms and hobby farms are exempt? Hobby farms are not exempt was the answer. Much more discussion of what the maximum size of the accessory building should be and possibly a problem if a large lot with a large building is next to a small lot. Mayor Fournier - Our goal was to allow accessory buildings large enough so we did not get CUP's. More discussion of two accessory buildings and what maximum size or equal size. Chair Swenson - I am looking for a consensus, as we have a hearing scheduled. Mayor Fournier liked more than 1500 sq. ft. maximum size. Bruce Rask didn't feel we had to change what is currently proposed. Christian Mbanefo - Questioned if someone built a larger accessory building and then subdivided, how would that work? Dan Licht - Explained it would become non- conforming at that point. More discussion of size and setbacks of accessory buildings. Richard Nichols - We have not turned anyone down, so why are we worried about it? One building we approved was 2400 sq. ft. My inclination is to leave it as is, except deleting the maximum size in the Rural Service Area. Dan Licht - Suggested that we change the Rural Service Area back to the way it was. Over five acres they could have two structures. Under five acres they could only have one structure. More discussion of building size connected to lot size. Virginia Wendel - I would rather see larger accessory buildings with the junk inside. Richard Nichols - Some people with larger buildings would still have junk outside. Mark Berning likes the way the proposed ordinance is written and felt pole buildings should be allowed in the Rural Service Area, because many of the existing 2-1/2 acre lots currently have pole buildings. Chair Swenson asked if there is agreement with Marks suggestion? Suzanne Ackerman and Virginia Wendel agreed. Gene Goenner proposed in the no sewer district the accessory building to be 1200 sq. ft instead of 1500 sq. ft. (Which would allow 1200 sq. ft and 800 sq. ft detached and 1000 sq. ft attached accessory building). Bruce Rask was concerned with us formerly saying that we did not want more than 2,000 sq. ft of accessory building, now we are changing to say we can have three accessory buildings on every tax parcel. We were against garage forward homes, now we are saying two detached accessory buildings and an attached garage. More discussion of allowing more accessory space under the new ordinance and less CUP's. Bruce agreed with the 1200 sq. ft and 800 sq, ft accessory building sizes. Richard Nichols - Likes the 1500 sq. ft building size and feels that in the Rural Service Area it should be larger. Virginia Wendel - Have we had a lot of people looking for 1200 to 1500 sq. ft size accessory buildings? Answer - Yes. More discussion. It was decided that the Chair would take a vote with show of hands No Sewer - Urban Service District 1500 sq. ft 7 - votes (approved) 1200 sq. ft 5 - votes Rural Service District Gene Goenner said pole buildings and number of structures the only issues. More discussion. CITY OF OTSEGO PLANNING COMMISSION/CITY COUNCIL MEETING MONDAY, FEBRUARY 1, 1999 - SPM - PAGE 3 - Dan Licht read the current farm and hobby farm definition and proposed amendment on ten acres and larger pole buildings are allowed. More discussion if pole buildings should be allowed on smaller lots. The last column for the Rural Service Area of Page 2 they decided to go section by section and vote on it. 1 through 5 was OK'd as written approved by all. the 6th and last one they voted on the wording as follows: "5.0 acres or more" - 3 voted for "Greater than 5 acres" - 8 voted for (wording approved) 4 Continue Review of Zoning Ordinance Update: Feedlots (with updated information from NACI Dan Licht explained that they tried to simplify at the last meeting and the changes in NAC's Memo of January 27, 1999. He had obtained information from Wright County and the Department of Agricultural. Discussion of farm definition. Christian Mbanefo asked if the percentage to be used for farming income would be over 50%? Gene Goenner said that work units are used by agricultural as a measurement for farms. Virginia Wendel - How are farm animals regulated? Richard Nichols - Did not understand what is the carrot with registration? In the Urban Service Area we don't allow registration. It was answered that if you register you can get the 1000 ft buffer all around your property. Gene Goenner - Item #I the regular number of animals currently and the maximum number under MPCA Permit. What number will we take? Is it how many you have on the day you register? Dan Licht - It may be beneficial to use MPCA's maximum guidelines. Mr. Goenner said his understanding is the maximum number of animals the buildings can hold. You could get an interim permit for your intent. More discussion of how to determine animal units. Mr. Heidner wondered if people may be overestimating registration numbers of their size? Discussion of the minimum of 10 animal units used in Otsego's Ordinance possibly being changed to 50 under MPCA regulations. Mayor Fournier asked what number of AU did we use? Dan Licht - The existing animal units plus the maximum number allowed by MPCA and we tied it to the building size. The farm definition change to "greater than 10 acres" from "10 acres or more". HEARING: RICHARD NICHOLS MOTIONED TO SET MONDAY, MARCH 1, 1999 AT SPM AS A HEARING DATE FOR THE PROPOSED AMENDMENTS TO THE FEEDLOT ORDINANCE. BRUCE RASK SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 5. Any other Business A. Carl Swenson - Chair VICE CHAIR: Arleen Nagel nominated Gene Goenner for Vice Chair. Bruce Rask seconded the motion. Gene Goenner - Declined the nomination. Richard Nichols nominated Bruce Rask for Vice Chair, Arleen Nagel seconded the motion. Motion carried. Bruce Rask said he would try, but felt it may be a problem. Bruce Rask nominated Richard Nichols as Vice Chair. Richard Nichols declined nomination. Gene Goenner motioned that nominations be closed. Richard Nichols seconded the motion.
