10-04-99 PCCITY OF OTSEGO PLANNING COMMISSION MEETING MINUTES OCTOBER 4, 1999 - SPM 1. Chair Carl Swenson will call meeting to order: Chair Swenson called the Planning Commission Meeting to order at 8PM. ROLL CALL: Chair Carl Swenson, Patrick Moonen, Christian Mbanefo, Jim Kolles, Commissioners. Richard Nichols arrived late. Commissioners Arleen Nagel and Eugene Goenner - excused absence. Mike Robertson, City Administrator, Elaine Beatty, City Clerk/Zoning Administrator and Steve Grittman, Planner. Dan Licht, Planner - Absent Mayor Larry Fournier, Vern Heidner, Suzanne Ackerman, Mark Berning and Virginia Wendel Council Members. 2. Consideration of the Planning Commission Minutes of- A. fA. September 20, Monday, 1999 P C Meeting Chair Swenson noted there was a error in the minutes on page 1 and it should read September 27. JIM KOLLES MOTIONED TO APPROVE THE MINUTES WITH THE CORRECTION. CHRISTIAN MBANEFO SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 3. Hearing for applicants/owners Rudy JR Thibodeau and Margaret S Thibodeau 20120 Vance Street, Elk River MN for PID #118-038-001040 in Section 15, Twp. 121, Range 23. Legal description is Block 1, Lots 3 &4, Mississippi Shores 6TH Addition. Property address is 9100 Park Avenue NE. Request is as follows: A. Site and Building Plan Review B. Variance to allow less sideyard setback than required by Otsego's Zoning Ordinance. C. Conditional Use Permit/Planned Unit Development (CUP/PUD) Amendment Chair Swenson explained the Hearing and Elaine Beatty noted that the proper postings and mailing and publishing had been completed. Chair Swenson introduced Steve Grittman, Planner from NAC in Dan Licht's absence. Mr. Grittman reviewed the Planning Report prepared by Dan Licht of NAC. He said the PUD and performance standards are mostly met. A variance is for 10' setback which is less than the 20' required by ordinance. The shared parking with Tom Thumb was discussed. The Planners recommendation is amend the Zoning Ordinance if the Commission finds the variance is favorable as a hardship is hard to find. John Weicht - Representing Mr. Thibodeau as a builder/contractor spoke. He noted that Tom Thumb to the South has been granted a 10' variance as has the liquor store. He felt that the five requirements for a variance, nobody could meet them. He agreed with the planner that it is better to amend the ordinance than grant a variance. The adjoining properties have already been granted a variance. The parking lot was approved with the originall'viinn-E-Golf. He is asking to maintain the existing parking lot with CITY OF OTSEGO PLANNING COMMISSION MEETING OF OCTOBER 4, 1999 AT 4PM - PAGE 2 - addition of curb and gutter and would like that included. Re: The City Engineers letter - He said he met with John Harwood and was informed not to plan for water storage on site. He would like to keep the Park Avenue exit open as an important access during construction. Park does not have a high traffic volume. It is a negative impact to the business to loose that access. Chair Swenson noted the formal procedure for Hearing on the back of the agenda. HEARING WAS OPENED TO THE PUBLIC. Chair Swenson noted that Warren Phillips, Riverview Liquorette has left a message that he is in favor of Thibodeau's expansion. David Gilgenbach - Owner of the property to the West of Thibodeau's. His only question is the setback variance. Would it impact his property if he needed a setback on his building if he added on? He did not have a problem with Thibodeau's request. No one else spoke. BACK TO THE P.C. FOR DISCUSSION Mike Robertson - Noted that the Council reviewed the stormwater issues in that basin. As part of the Developers Agreement with Thibodeau a stormwater fee would be added, I anticipate which would address any stormwater issues. CM Heidner - Explained the report for stormwater in this area and that he feels the issues can be worked out in a Developers Agreement. Richard Nichols - Questioned the 10' variance setbacks that were granted. Steve Grittman was not sure, but felt they were granted under the County. Elaine Beatty - Noted the County had granted the two variances. Chair Swenson - Suggested that since we have several new Planning Commission Members, that we hold a Site Inspection of this property. After discussion of time of Site Inspection, the following motion was made: (Patrick Moonen noted he could not attend this Site Inspection.) CHRISTIAN MBANEFO MOTIONED TO CONTINUE THE HEARING FOR APPLICANTS/OWNERS RUDY THIBODEAU AND MARGARET THIBODEAU TO THE NEXT PLANNING COMMISSION MEETING OF OCTOBER 18, 1999 AT SPM TO ALLOW A SITE INSPECTION OF THE PROPERTY AT LOAM SATURDAY OCTOBER 9, 1999. JIM KOLLES SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. Discussion: Items to review at the Site Inspection is sideyard setback, drainage, size of building, location of access to Park Avenue (distance from corner). Rudy Thibodeau - Asked for a clarification on setbacks. He built under Wright County rules. He noted that a 10' variance was granted for the batting cages when built. The parking lot has been there for 10 years and he finds it hard to redesign when traffic has flowed well. Chair Swenson - Noted that when changes are made, existing problems are often reviewed and addressed. CITY OF OTSEGO PLANNING COMMISSION MEETING OF OCTOBER 4, 1999 AT 4PM - PAGE 3 - Mr. Thibodeau - Noted that he is on a tight schedule for this project and that any delay is a problem. Chair Swenson noted that this will be continued to October 18th at 8PM and the Council Meeting of October 25, 1999, so only is two week delay. John Weicht - Noted that they have a verbal agreement with Tom Thumb. CM Heidner noted he would like to see a written agreement at the Council Meeting. 4. Hearing for Applicants Orrin Thompson Homes 8421 Wayzata Blvd #300 Golden Valley, Mn. 55426 for owner Thomas Koerwitz PID #118-802-012400 described as unplatted land approximately 75.20 acres, most of the Northwest Quarter of Section 1, Township 20, Range 23. Property is located N of Co. Rd #36 (53RD ST NW) W of the new Otsego Wastewater Treatment Plant, and E of Autumn Woods Subdivision. Request is as follows: A. Rezone the above property from A-1 Agricultural (Rural Service Area) to R-4 Single Family Detached Homes to allow the platting of 39 -Lot Chair Swenson explained the request. Elaine Beatty noted that proper publishing, posting and mailings had been completed. Steve Grittman explained NAC's Report of September 28, 1999. He noted that Staff reviewed this as a concept stage plan. It is in the sanitary sewer district and is one of several City plats being considered. The proposed plat's effect on sewer capacity needs to be considered. Municipal water service is not available to the subject property. One suggestion was that the applicant could construct an independent well to serve this development and incorporate it eventually into the City's water system. Drainage needs more technical review. Concern - The sole access to the property is Co. Rd. #36 which is subject to seasonal flooding. This road is not part of the 5 -yr. County plan. If this is approved, several planning items are needed. (see NAC's Report). Lee Johnson - Orrin Thompson Homes. We are a division of U.S. Homes Corp., one of the largest builders in the country and well financed. Otsego is a great location, 101 access off of #94. It will be an exciting place to be for many years. We have a willing seller and access is excellent adjacent to a collector road, with a signalized intersection.. We would improve Co. #36 at access with right turn lane, etc. The access goes both ways, #42 and 101 is equal distance as #36 and 101. You can also go through Dayton and take #37 to 101. This site is developable and sewer is adjacent to the plant. Our timing coincides with the operational mode of the plant which is a logical place to start development. Water is not adjacent to the plant, but there are two alternatives. I would request the Council to bring the trunk water line further down 101 to increase development potential, with lateral extension the same place as sewer, or the developer would construct a well, holding tank, and treatment building. I am willing to work with either. For fire, police, etc., it is next to an existing neighborhood. The impact is not negative, as sewer is in that area already. It will add 25 million dollars to tax base. The plat would be low density because of the wetlands, 1.8 dwelling units per acre. Homes in $150,000 to $250,000 range. Our planning is for the preliminary plat to occur this winter, grading grading and utility work next summer, one year from now the construction of first homes would begin. A four to seven year project is planned. HEARING WAS OPENED TO THE PUBLIC BY CHAIR SWENSON. CITY OF OTSEGO PLANNING COMMISSION MEETING OF OCTOBER 4, 1999 AT 4PM - PAGE 4 - Tim Nuegents - 57TH ST, Autumn Woods resident (lot 18). Is all the water from your project going down to the lower valley? Answer: Most of the water goes East, part goes East-West and part West. Mr. Nuegents noted that there are four mound systems in the bottom of the meadow and when the Crow River floods water is 15' from our systems. I am concerned with flooding. Tom Koeiwitz - 18 years I have lived on this property. I have never missed a day of work because of flooding. We have 3 -different routes to get out when Highway #36 floods. It is not a big issue. The county will be motivated to fix the area if we build there. This will benefit the City w/no negatives. Grenings Subdivision to the North was approved, with no money from that for sewer and water and the development across from City Hall, has no money for sewer and water. Over one million of revenue will help offset the cost of the water treatment plant. This is a 25 million dollar project with no adverse affects to the City. It will help pay for sewer expansion and capacity is available now. U. S. homes are addressing issues of water. DISCUSSION BACK TO P.C. Mike Robertson - The recommendation to the developer was to apply for the concept plan because of the water and sewer issues that need to be resolved. The advantage of a concept plan for both sides is that not a lot of money is spent up front. There is a Park needed in the SE quadrant of the City and it has not been identified as to site. I have suggested that the planner work with the Parks and Recreation Commission for a concept plan in the area over the winter. Richard Nichols - Questioned X number of homes using current capacity. Are we going to stop plats based on these conditions? Mice Robertson Answered that will need to come from the City Council. CM Heidner - Noted that it is 3/4 of the way through the year and we have already used up the residential portion of the sewer capacity. We have reserved 20,000 to 30,000 gallons for Commercial and Industrial development. DISCUSSION BACK TO PUBLIC HEARING CLOSED BY CHAIR SWENSON Back to P.C. for discussion. None RICHARD NICHOLS MOTIONED TO APPROVE THE CONCEPT PLAN FOR ORRIN THOMPSON HOMES FOR KOERWITZ PROPERTY AS PRESENTED. PATRICK MOONEN SECONDED THE MOTION. MOTION CARRIED 3 to 2 PATRICK MOONEN, CHRISTIAN MBANEFO AND RICHARD NICHOLS VOTING YES AND CARL SWENSON AND JIM KOLLES VOTING NO DUE TO CONCERNS ABOUT PREMATURE DEVELOPMENT. This will be on the Council Meeting of October 11, 1999 - 6:30PM Discussion: Chair Swenson questioned Mr. Grittman about planning report and premature development. He said it is a concern and ideally they like contiguous development. It is a policy if you want to go outside service capacity. CITY OF OTSEGO PLANNING COMMISSION MEETING OF OCTOBER 4, 1999 AT 4PM - PAGE 5 - Jim Kolles - Feels it is premature to start development down by the plant. Cost to City is high for a well. He is not sure he can vote for Mr. Nichols Motion. Christian Mbanefo - Options were open and this is a concept plan. Even if concept plan is approved, they can still do other things. 5. Any other P.C. Business A. Update on Council action by CM Vern Heidner CM Heidner noted that the clubhouse for the golf course was approved as was Pheasant Ridge Plat and gave more information. Mike Robertson - Reviewed the City road projects progress, watertower and wastewater treatment plant/well/pumphouse projects. 6. Adjourn by IOPM RICHARD NICHOLS MOTIONED TO ADJOURN THE MEETING.
