01-18-00 PCCITY OF OTSEGO PLANNING COILMISSION MEETING MINUTES TUESDAY, JANUARY 18, 2004 - SPM 1. Chair Swenson will call the Planning Commission Meeting to order. Chair Swenson called the meeting to order at 8PM. ROLL CALL: Planning Commission: Chair Carl Swenson, Richard Nichols, Patrick Moonen, Arleen Nagel, Jim Kolles, Steve Schuck, Commissioners and Ken Fry, 2ND Alternate. Christian Mbanefo, absent. Staff: ',N/like Robertson, City Administrator, Elaine Beatty, City Clerk/Zoning Administrator, and Dan Licht, City Planner .City Council: Mayor Larry Fournier, CM Heidner, 2. Consideration of the Planning Commission Minutes of- A. fA. December 6, 1999 - $PM (Attached) ARLEEN NAGEL MOTIONED TO APPROVE THE DECEMBER 6, 1999 PLAiNNLNG COMMISSION MINUTES. STEVE SCI-IUCK, SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 3 HEARING for Owner Ralph LaVedure 5743 Juneau Lane, Plymouth, Minnesota 55446 for PID #118-500-352200 and #118-500-341102 located on 70TH Street NE, West of State Highway #101 in Sections 34 and 35, Township 121, Range 23, County of Wright, State of Minnesota. Legal description is on file at the City Clerk's Office 8899 Nashua Avenue NE, Otsego, MN. Applicant is John Jackels; AJE Companies, 10738 Hanson Blvd. NW, Coon Rapids, Mn. 55433. Property is located South of the Otsego Nater Tower Site. Request is as follows: A. A Conditional Use Permit to allow Mining in an A-1 (General Agricultural - Rural Service Area) Chair Swenson - Stated the request. EIaine Beatty - Noted that the proper posting, publication and mailings were completed. Larry Koshak - reviewed the Staff Report for Mining Permit #7. (See attached report dated January 11, 2000). Mr. Koshak noted that there is 33 Acres on the mining site. He emphasized the items deficient, but still needed. The Engineering items are solvable said Mr. Koshak, but he does not recommend that this be on the Council Agenda uad the deficient items are addressed and reviewed. Dan Licht, Otsego City Planner reviewed the Planning Report dated January 11, 2000. (See attached report). Mr. Licht read information of the Planning Commissions possible actions from his memo of January 18, 2000. Dave Putnam, 710 East River Road, Anoka MN. spoke. He said they are Civil Engineers and Land Surveyors. The plans for mining the 33 acre site is that 1.3 million cubic yards of material are to be removed. They have reviewed the Mining Ordinance. Screening has been addressed with a 35' wide buffer around the property. They would like to excavate topsoil and use it for berms to provide screening and do the necessary excavating. There are four or five phases of excavation and it would be the fourth phase before they get close to the Northern Natural Gas Line. He felt it gave them time to work with the Gas Company. The East property line is probably a future street. They are showing it to demonstrate how our mining project can interface CITY OF OTSEGO PLANNING COMMISSION MEETING MI_NUTES OF JANUARY 18, 2000 (TUESDAY) - PAGE 2 - with it as well as a inter -site roadway connection into the property to the South. Witivn the mining stages, they are proposing stormwater ponds to contain the runoff and sedimentation and infiltration into the soil. CHAIR SWENSON OPENED THE PUBLIC HEARING. No one spoke. Planning Commission comments and questions: CM Heidner asked the approximate elevation of the gas pipe. T\/1r. Putnam - Not specific but two to five feet deep. Richard Nichols asked to see the January- 18th Report from the Planner. He asked if this was strictly a CUP for mining? Mr. Licht - Answered yes. Administrator Robertson noted that a homeowner to the West of the proposed project was unable to attend the hearing, but was questioning if the berm would have stormwater runoff. Engineer Koshak noted that the site would be self contained. As the dirt is mined, the runoff would go into ponding on site. There would be no more runoff off site then there is currently. Chair Swenson brought the continents back to the Public. No one spoke HEARING WAS CLOSED BY CHAIR SWENSON. Comment was brought back to the Planning Commission Ken Fry - Asked if West of where they want to mine they are proposing a 30` berm and if the berm caused a run-off problem, what can we do? Engineer Koshak -The Ordinance allows the City Staff to intervene if erosion and sedimentation is not being properly handled. The developer is aware of runoff and can use hay bales and use other erosion control methods. A letter of credit needs to be prepared in an amount to restore the area. The City can pull the letter of credit if needed. RICHARD NICHOLS MOTION TO RECOXE<•1E.ND APPROVAL OF THE CONDITIONAL USE PERMIT SUBJECT TO THE SEVEN CONDITION IN THE STAFF REPORT OF JANUARY 18, 2404. PATRICK MOONEN SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. The Planning Commission agreed that this would not be on the Council Agenda until the requested revisions are completed, reviewed and confirmed by the City Engineer. 4. HEARING for Owner C/D Holder Norman Carlson/Ilene Thackeray. 18685 W. Bobcat Road, Casa Grande, Az. 85222 and C/D owner Charles Klein, 8045 Ochoa Ave. NE, Otsego, MN. Applicant is Dwain Pearson, 5782 Naughtor Avenue, Rogers, 1XIinnesota 55374. Property ID is #118-032-001130. Legal description is Lot 13, Block 1, Vasseur's Oak Grove Estates in Section 21, Township 121, Range 23, Wright County, 1XIinnesota. Property- is zoned R-2 Residential (Large Lot) and located on Packard Avenue between 81ST and 82ND Streets. Request is as follows: A. Conditional Use Permit to allow relocation of an existing home. Chair Swenson explained the request. Elaine Beatty noted that the proper publication, postings and mailings have been completed. He noted that a security is required to be posted with the. City. He also noted that Staff recommends, approval subject to the five conditions of the Planning Report. Dwain Pearson, 5782 Naughtor Avenue, Rogers, Mn. 55374, Applicant - Asked regarding the security, what would it entail? Planner Licht - It is based on potential damage. Administrator Robertson - The security is higher when there is an existing home_ that must be removed. It is based on the valuation of the building being moved in. The highest letter of credit we have had is $5,000.00. CHAIR SWENSON OPENED THE PUBLIC HEARING. No one spoke. CHAIR SWENSON CLOSED THE PUBLIC HEARING. PATRICK MOONEN MOTIONED TO RECOMMEND APPROVAL OF THE CGNDITIONAL USE PERMIT TO ALLOW RELOCATION OF AN EXISTING HOME AND INCLUDED THE CONDITIONS LISTED IN THE STAFF REPORT DATED JANUARY 11, 2404. ARLEEN NAGEL SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. This request will be on the January 24, 2000, 6:30PM City Council Meeting Agenda. 5. Any other P.C. Business A. Update on Council Action by CM Fern Heidner CM Heidner explained Council information and noted that he is re- appointed to the P.C. again, with CM Wendel as alternate. Administrator Robertson - There are 8 -building permits issued in Crimson Ponds Subdivision. These are our first building permits with municipal sewer and water so a picture was taken of the big event for the newsletter. 6. Adjourn by 1OPM RICHARD NICHOLS MOTIONED TO ADJOU"R1N THE P.C.
