06-05-00 PCCITY OF OTSEGO PLANNING COMMISSION MEETING JUNE 5, 2000 - 8PT1 MINUTES 1. Chair Swenson will call the Planning Commission Meeting to order. Chair Swenson called the meeting to order at 8PM. ROLL CALL Planning Commission: Chair Carl Swenson, Richard Nichols, Patrick Moonen, Steve Schuck, Christian M'Banefo and Ken Fry, 1st Alternate. Jim Kolles arrived at 8:05 and Eugene Goenner, 2nd Alternate arrived at 8:07PM. Arleen Nagel - Excused absence Staff. 1\/Iichael Robertson, City Administrator, Elaine Beatty, City Clerk/Zoning Administrator, and Dan Licht, City Planner. City Council: Mayor Larry Fournier, `'ern Heidner and Suzanne Ackerman, Council Members. 2. Consideration of the Planning Commission Minutes of: A. Monday, May 15, 2000 - 8PM RICHARD NICHOLS MOTIONED ADOPTION OF THE MAY 15, 2000 PLANNING COMMISSION MINUTES AS WRITTEN. STEVE SCHUCK SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 3. HEARING for Owners Arlvn & Judith Baiari. 7121 Kadler Avenue NE (Otsego Monticello, Mn. and Applicant Bauerly Brothers, Inc. 4787 Shadowwood Drive NE Sauk Rapids, Mn., 56379. PID#'s involved are 118-800-273401 (41.17 Approx. Acres) and #118-800-274400 (27.34 Approx. Acres) all in Section 27, Township 121, Range 24, Wright County, City of Otsego, MN. This property is located West of Kadler Ave. N.E. and N. of 70TH ST N.E. and N of I-94. Request is as follows: A. Rezone from A-1 (General Agricultural, Rural Service Area) to I-2 (General Industrial District) the entire 41.17 and 27.34 approximate acres. B. Amend the Zoning Ordinance to create an Interim Use Permit. C. An Interim Use Permit to allow a temporary industrial structure. D. Conditional Use Permit to allow outside storage in an I-2 District. E. Site and Building Plan Review F. Subdivision Chair Swenson introduced the Hearing and Elaine Beatty noted that the proper publishing, postings and mailings were completed. Dan Licht - Reviewed the Planning Report dated May 31, 2000. He noted that approving a temporary building is a policy decision for the Planning Commission and City Council to make. CITY OF OTSEGO PLANNING COMMISSION MEETING MINUTES OF JUNE 5, 2000 - 8PM - PAGE 2 - Arlyn Bajari, 7121 Nadler Ave. - Owner of this land and he has talked with NSP and they have removed their easement across this parcel. Dan Licht - Informed Mr. Bajari that we need a copy of a written release of this NSP easement from NSP. Brian Bauerly, Bauerly Bros., Applicant - His issues are the height requirement they want the P.C. to consider changing the silo height to 50', because that is it's height. He noted that there are 58 trees along the roadway between the site and road. He wanted these trees to be considered as screening instead of installing a berm. Mr. Bauerly noted that Bauerly's are buying all of this property and they have the engineers working on the rest of the plat. They have finished the wetland delineation and topos. By July they hope to have the plat ready to come before the Planning Commission. 1\/Ir. Bauerly noted his concern with the 12 month period for the interim use permit. If possible he would like it extended to 18 months. This would give him the summer season to remove farm buildings and have time to erect a permanent facility (Steel building with a masonry front and totally enclosed conveyor and silo). Chair Swenson explained the formal hearing procedure and, OPENED THE PUBLIC HEARING No public input Discussion went back to the Planning Commission. Richard Nichols - Questioned if this cement plant use is compatible with the long term use. 1\/Ir. Licht noted that this use is allowed in the Industrial District. Mr. Nichols - Asked Mr. Bauerly why the temporary structure, and not a permanent one? Nk.Bauerly answered that they want time to build a building and do it right. 11/Ir. Nichols - Questioned what the tax base increase would be with a temporary structure? Answer: Minimal. He also questioned the benning requirement and did not feel that there was a visual impact now with I-94. Mr. Bauerly - Noted that he would use a berm for stormwater purposes and noted that the plant is to be placed behind existing trees. Hearing brought back to the public. No public input. HEARING CLOSED by Chair Swenson Discussion back to Planning Commission. RICHARD NICHOLS MOTIONED TO RECONIVIEVD APPROVAL OF ZONING ORDINANCE AMENDNIENT TO SEC. 20-68.4 TO ESTABLISH INTERIM USE PROVISIONS FOR TEMPORARY STRUCTURES AS A PRINCIPAL USE WITHIN THE I-2 DISTRICT BASED UPON A FINDING THAT THE ACTION IS CONSISTENT WITH THE PURPOSE OF SAID DISTRICT AND THE POLICIES OF THE COMPREHENSIVE PLAN. STEVE SCHUCK SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. CITY OF OTSEGO PL.4NNING COMMISSION MEETING MINCTTES OF JUNE 5, 2000 - SPM - PAGE 3 - RICHARD NICHOLS MOTIONED TO RECOM LEND APPROVAL OF AN ORDINANCE REZONING THE SUBJECT SITE FROM A-1 TO I-2 DISTRICT BASED UPON A FINDING THAT THE ACTION IS CONSISTENT WITH THE PURPOSE OF SAID DISTRICT AND THE POLICIES OF THE COMPREHENSIVE PLAN. PATRICK MOONEN SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. RICHARD NICHOLS MOTIONED TO RECOMMEND APPROVAL OF THE INTERIM USE PERMIT CUP SUBJECT TO A - K OF STAFF REPORT DATED MAY 31, 2000, WITH ITEM A CHANGED TO 18 MONTHS FROM 12 MONTHS AND ITEM B CHANGED FROM 35' TO 50'. JIM KOLLES SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. It was noted that this item will be on the June 12, 2000 6:30PM Council Agenda. 4. Discussion Re: Type of building material Dan Licht explained the building materials memo of May 31, 2000 - Section 20.17.4 of the ordinance, Pages 1 - 5 to the Planning Commission. After discussion it was decided that Dan Licht had enough information from the discussion of the Planning Commission to revise the ordinance and bring it back to the Planning Commission. 5. Dan Licht will conduct Planning Commission Training and Orientation (See Attached) Dan Licht reviewed his outline for Planning Commission Training and Orientation A. B and C. and the Planning Commission generated some discussion. This will be continued on another light agenda starting with item D. Subdivision Ordinance. 6. Anv other P.C. Business Mike Robertson - Asked the P.C. if they wanted to change the July 3, 2000 P.C. Meeting or leave it as is. Richard Nichols and Gene Goenner noted they will be gone that week.
