11-18-02 PCCITY OF OTSEGO PLANNING COMMISSION MEETING NOVEMBER 18, 2002 8 P OTSEGO CITY HALL 1. Chair Nichols will call the meeting to order. Chair Nichols called the Planning Commission Meeting to order at Roll Call: Planning Commission Members: Ken Fry, Steve Schuck, David Thompson, Carl Swenson, Christian Mbanefo and alternate Pam Black and Chair Richard Nichols. Excused absence: Jim Kolles. Staff. Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Administrator and Dan Licht, City Planner. Council: Mayor Larry Fournier; Vern Heidner, Virginia Wendel, Suzanne Ackerman and Jerry Struthers. Also attending was Councilmember elect Dan Scharber. 2. Consider the following minutes: 2.1. November 4 2002 Planning Commission Meeting. Commissioner Black noted on Page 2 the word decreased should read deceased Commissioner Schuck motioned to approve the minutes as amended. Seconded by Commissioner Thompson. All in favor. Motion carried. 3. Plannin Items• 3.1. Applicant Land -'or Inc PUD Development Stage Plan for Lot 1 Block 2 Otsego Waterfront 3`d Addition to develop a 4.4 59 square foot restaurant Dan Licht presented the Planner's Report. Judy Hudson attested the proper noticing and publishing was done. Bob Fields, applicant, LandCor Construction, stated they are in agreement with staffs comments. Chair Nichols opened the Public Hearing for public comments at 8:09 PM. There were no public comments. The Planning Commission reviewed the building material. Hearing no public comments, Chair Nichols closed the Public Hearing at 8:11 PM. Commission Schuck motioned to recommend to approve a PUD Development stage plan for Outlot G of the Otsego Waterfront Addition, subject to the 7 conditions listed in the Planner's Report. Seconded by Commissioner Fry. All in favor. Motion carried. 3.2. Applicant LandCor Inc PUD Development Stage Plan for Lot 2 Block 2 Otsego Waterfront 3`d Addition to develop a 3,788 square foot Convenience Store with motor fuel facilities and a 3,1 S ware foot Car Wash. Chair Nichols opened the Public Hearing at 8:12. Planning Commission Meeting of November 18, 2002, cont'd. Page 2. Dan Licht presented the Staff Report. Judy Hudson attested all proper noticing and publishing was done. Bob Fields, applicant, showed on a overhead how they are proposing to change the orientation of the building. The pumps would be along Quaday Avenue and parking for trucks and trailers would be along the north edge. Mr. Fields feels this would allow better traffic flow and keep more traffic away from the residential area. Also, the car wash would function inside of the building. Chair Nichols opened the Pubic Hearing for Public Comments at 8:29 PM. Trish Regler, Riverview Liquorette, asked for clarification of location of this building in the plat. Mr. Fields pointed the location out to her. Commissioner Schuck questioned the Planner that the report is requesting no music and no advertising allowed on the PA system at the pumps but currently this is being done at other stations within the City. Dan Licht stated this would also apply to all current operations and the City will make them come into compliance. Commissioner Mbanefo asked how the change of orientation affects the setbacks. Mr. Licht replied there may be some flexibility from 42. PUD Districts have an allowance and this will be consistent along CSAH 42. Councilmember Heidner stated the sewage needs to be pretreated to residential standards. Mr. Fields said they are aware of this and have a reclaim station in the car wash. Commissioner Fry questioned if the noise from the car wash would affect the residential area. Mr. Field said all noise would be contained within the buildings. Hearing no further public comment, Chair Nichols closed the Public Hearing at 8:35 PM. Chair Nichols asked the Planning Commission if they have any objections to a 24-hour operation and if they wish to amend Condition No. 10. Commissioner Schuck motioned to recommend to approve a PUD Development Stage Plan for a convenience gas use on Outlot A of the Waterfront addition, subject to the 16 conditions listed in the Planner's Report amending Item 10 to read unlimited gas sales unless limited by City Council, car wash hours limited from 7 AM to 10 PM unless specifically limited by City Council. Seconded by Commissioner Swenson. All in favor. Motion carried. 3.3. Applicant LandCor Inc PUD Development Stage Plan for Lot 1 Block 1 Otsego Waterfront 3`d Addition to develop a 7,200 square foot Retail Store. Dan Licht presented the Planner's Report. Judy Hudson attested all proper publishing and noticing was done. Applicant, Bob Fields, will step the efface out at corner to give more character and more windows on the front and on the west and east ends (artificial glass/windows). They will also move the trash inside of the buildings. Chair Nichols opened the Public Hearing for Public Comment at 8:48 PM Trish Regler, Riverview Liquorette, asked about the setback from Church. Commissioner Schuck questioned if the addition of the windows would decrease the amount of brick. Mr. Fields said it would lower the brick to 18 inches. Mr. Licht explained that the false windows would give the building a larger retail appearance and the brick could extend up the columns. Commissioner Fry asked where the loading dock is located. Mr. Licht said the doors on the east are double doors and provide plenty of room for trucks etc., Commissioner Mbanefo questioned if this is a retail building under this application and approval would be given as a retail rather than a liquor store. Mr. Licht said the approval would be for a retail building. Commissioner Schuck asked if thought had been given to facing this retail building to the east. Mr. Fields said they had reviewed that and it had no appeal to them. Chair Nichols asked for any other public continents. Rudy Thibodeau asked if this retail building is meant as a single tenant or multi -tenant. Mr. Licht explained either single or multi wouldn't affect the function for this site and could be either. Hearing no further comment, Chair Nichols closed the Public Hearing at 8:55 PM. Commissioner Fry motioned to recommend approval of a PUD Development Stage Plan for a retail use on Outlot B of the Otsego Waterfront, subject to the twelve conditions listed in the Planner's Report. Seconded by Commissioner Black. All in favor. Motion carried. 4. Any other Planning Commission Business A. Update on Council actions by CM Heidner. Councilmember Heidner went over recent Council actions. 5. Adjournment by 10 PM Commissioner Schuck motioned to adjourn. Seconded by Commissioner Thompson. All in favor. Motion carried.
