04-01-02 PCCITY OF OTSEGO PLANNING COMMISSION MEETING APRIL 1, 2002 8 P OTSEGO CITY HALL 1. Chair Nichols will call the meeting to order. Chair Nichols called to order at 8 PM. Roll Call: Chair Richard Nichols; Commission Members: Ken Fry, Christian Mbanefo, Steve Schuck, Carl Swenson, Patrick Moonen, Jim Kolles and David Thompson. Councilmembers: Mayor Larry Fournier, Vern Heidner, Virginia Wendel and Jerry Struthers. Staff. Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Administrator; and Dan Licht, City Planner. 2. Consider the followiniz minutes: A. March 19, 2002 Meeting. CM Schuck noted that Patrick Moonen should be added to the Roll Call. CM Schuck motioned to accept the minutes as amended. Seconded by Commissioner Swenson. All in favor. Motion carried. 3. Planning Items: 3.1. Public Hearing for the Comprehensive Plan. Chair Nichols opened the Public Hearing at 8:01 PM. Dan Licht presented the Planner's Report. Judy Hudson attested all proper publishing was done. Chair Nichols opened for Public Comment. Kevin Conway, representing David Eide of Midwest Landscapes. Mr. Conway presented Exhibit A. requesting 20 acres guided for commercial use and remaining 32 acres Medium Single family residential. The letter also requests a Mixed Use designation. Floyd Roden, 8337 LaBeaux Avenue and Don Weidenbach, LaBeaux Avenue, presented Exhibit B requesting their properties be included in the new sewer and water service area along with Alena DeCandia of Riverwood Inn & Conference Center. Keith Vetsch, 8023 Kadler Avenue, requested the northern 40 acres of his property also be included in the sanitary sewer service area as the rest of his property is. He also requested to allow residential rather than all industrial. Randy Kartsenson, 13664 80'h Street. He objected to the location of the sewer plant feeling it is too close to his house as he has a feedlot next door and now a sewer plant to the south. Dan Licht explained Otsego does not currently have a Mixed Use Designation because it has such a vague definition but that the City would look at a Concept Plan showing a mixed use and would respond accordingly. Dan also explained the line between the Sanitary Sewer Area and Rural Residential Preserve is based on the watershed district. In response to changing the Sewer Service Area it would take a request for a Comprehensive Plan Amendment and a Sewer Facilities Study to determine pipe size for any new sewer expansion. Chair Nichols asked for any additional Public Comments. Nancy Anderson, 9031 Mason Avenue, asked what kind of time frame Urban Service Area Reserve to develop and would it receive sewer before Rural Residential. Dan Licht replied the Sewer Service Area is estimated to take 10 to 15 years to develop. The biggest limitation is sewer capacity. The Urban Service Area would receive sewer first unless otherwise requested or there is septic failure. Larry Ambachan of Ground Development asked if current zoning would remain until otherwise requested. Dan Licht replied that is correct. Chair Nichols closed the Public Hearing at 8:31 PM. Chair Nichols motioned to recommend adoption of the Comprehensive Plan Update Draft dated March 28, 2002 as written. Seconded by Moonen. All in favor. Motion carried. 3.2. Public Hearing for Darlene Solberg, A. Conditional Use Permit to build an addition on to an existing Single-family residence located in the 100 -Year Floodplain. Chair Nichols opened the Public Hearing at 8:35 PM. Judy Hudson attested all proper publishing and noticing was done. Dan Licht presented the Planner's Report. The applicant, Darlene Solberg, 9912 Parrish Avenue, asked for approval of her Conditional Use Permit. She stated as she read the NAC Report concerns were raised as to what can be done to properties along Parrish Avenue such as septic systems replaced and asked what are her options. Mike Robertson explained the City Council has authorized the City Staff to pursue Federal Grant money. A Public Information Meeting will be set for this month to explain and answer questions for the Parrish Avenue residents. Dan Licht said the entire area within the 100 Year Flood. No one wants to claim responsibility for the dike. Flooding puts sewer into the river and holding tanks are not a option in the flood plain. He said the City needs to take a long-term look at this area. Planning Commission Meeting of April 1, 2002, cont'd. Page 3. Chair Nichols opened the Public Hearing for public comment. Mark Thiltgen 10003 Parrish Avenue stated the Parrish Avenue residents are concerned with what they can do with their homes, either selling or fixing up. Earl Dehmer, Parrish Avenue, stated he met with Jerry Olson last year and Jerry told him he couldn't add on to his house. He said he had his sewer inspected by the City and was told it was in bad shape and now he hears he can't upgrade. He needs more space. Mike Robertson explained that this is why the Information Meeting will be held to try and answer these questions. Chip Martin, Parrish Avenue, said he lived here for 34 years. He feels residents are trying to improve their homes and feels some of the restrictions are beyond reality. Planning Commission Discussion. Chair Nichols asked about the requirement to upgrade the sewer systems. Dan Licht said it is a County Ordinance. CM Heidner explained the City didn't have a choice complying with the County Ordinance. The County records the deeds and septics need to be in compliance before the deed gets recorded. Dan also explained the Flood Plain requirements are imposed by the Federal Government. Chair Nichols asked for any other Public Comments. Earl Dehmer, 10029 Parrish Avenue, asked if the dike is listed as temporary. Dan Licht explained the Army Corp of Engineering classified it this way and they won't maintain it. Chair Nichols closed the Public Hearing at 9:05 PM. Commissioner Mbanefo motioned to recommend approval of the Conditional Use Permit to allow expansion of a legal non -conforming single family dwelling to improve its livability as provided for by Section 20-15-3.E. subject to the conditions listed in the Planner's Report. Seconded by Commissioner Fry. All in favor. Motion carried. 3.3. Continuation of Public Hearing for Cascade II and LandCor. A. Rezoning from Agricultural A-1 to PUD District. B. PUD General Development Plan. C. Preliminary Plat. Commissioner Schuck motioned to reopen the Public Hearing at 9:08 PM. Seconded by Commissioner Kolles. All in favor. Motion carried. Dan Licht presented the Planner's Report. Bob Field, representing LandCor Construction. Cascade III was the original applicant and since that time they have been taken over by Otsego Land Company LLC of which LandCor is a partner. Mr. Field's stated they have signed a number of Purchase Agreements with users and they want to move very quickly on construction. Mr. Field's went over the timing of construction: Otsego Waterfront West Construction Start Construction Finish Roads and infrastructure Spring 2002 Blackwood's Bar & Grill, Banquet Center Spring 2002 Fall 2002 Otsego Waterfront West Retail/office Summer 2002 Late fall 2002 Three Story Bank Building Summer 2002 Late fall 2002 Fuel station/convenience store car wash Summer 2002 Winter 2002/03 Motel Fall 2002 Spring 2003 Mr. Field's said the 30 acres lying east of 101, will incorporate of a more downtown street concept similar to what Eagan, Blaine, and Maple Grove have done. They have been very successful, we will have more main street parking and more true two story buildings with more of Boardwalk type users. Chair Nichols opened for Public Comments. Chance Nelson, 9193 Parrish Avenue, stated concern with traffic as they live right across the street from this development. He also asked about traffic and streetlights with concern of the glare going into their lot. Mr. Fields replied they have hired a Consulting Engineer to conduct a Traffic Study. He feels a traffic signal will be needed at Park Avenue. They are planning on constructing berming so the wash of the headlights can't go across the street into the neighborhood. Also, the design of the lights will project into the parking lot. Judy Hudson noted for the record that Mike Yoakum, 15703 93`d Circle NE, called her and stated he has no issue with this project. Planning Commission Discussion: Commissioner Fry stated he is concern with the traffic on Parrish Avenue as it is so often backed up at the bridge. Mike Robertson said he has discussed this with the Elk River Engineer and they have no plans for any improvement in downtown Elk River. Mike feels the signal light at Park Avenue can be controlled to accommodate the local traffic. Commissioner Fry asked if the closing of the medium on CSAH 39 will affect the Church and Bank. Councilmember Heidner said the Church and the Bank have known all along that County Road 39 will eventually be closed. Their main entrance is off of 88d' Street. Chair Nichols asked for additional public comment. There was none. Chair Nichols closed the Public Hearing at 9:54 PM. Chair Nichols stated he would like to see shared parking as to cut down on the asphalt. Commissioner Mbanefo asked who would have responsibility for the median on CSAH Planning Commission Meeting of April 1, 2002, cont'd. Page 5. 39. Mr. Fields said they work with the County and they would if requested. Commissioner Kolles asked about direction of drainage. Mike explained the runoff goes south under CSAH 39 to outlot east under 101. Commissioner Schuck motioned to recommended approval of the rezoning to PUD District, PUD Development Stage Plan, and Preliminary Plat subject to the conditions listed in the Planner's Report. Seconded by Commissioner Swenson. All in favor. Motion carried. 4. Any other Planning Commission Business. A. Update on Council actions by CM Heidner. CM Heidner updated the Commissioner on recent Council action. 5. Adjournment by 10 PM. Commissioner Moonen motioned to adjourn. Seconded by Commissioner Schuck. All in favor. Motion carried.
