05-06-02 PCCITY OF OTSEGO PLANNING COMMISSION MEETING MAY 6, 2002 8 PM OTSEGO CITY HALL 1. Chair Nichols will call the meeting to order. Chair Nichols called the meeting to order at 8 PM. Roll Call: Chair Richard Nichols; Ken Fry, Patrick Moonen, David Thompson and Steve Schuck. Excused Absence: Carl Swenson, Jim Kolles Un -excused: Christian Mbanefo Staff. Mike Robertson, City Administrator; Judy Hudson, City Zoning Administrator/City Clerk and Dan Licht, City Planner 2. Consider the following minutes: 2.1. April 15, 2002 Planning Commission Minutes Commissioner Moonen motioned to approve. Seconded by Commissioner Fry. All in favor. Motion carried. 3. Plannin Items: 3.1. Conditional Use Permit to allow relocation of an existing single famil Home to a lot within Otsego (Applicant - Neal C Roessler) Chair Nichols opened the Public Hearing at 8:02 PM. Judy Hudson attested all proper publishing and noticing was done. Dan Licht presented the Planner's Report. Chair Nichols opened the Public Hearing for Public Comment. Gerald Gordon, 8389 Odell Avenue, stated support, as it will be a great improvement for the neighborhood. There was no other public comment. Chair Nichols closed the Public Hearing at 8:07 PM. Commissioner Moonen motioned to recommend to approve the Conditional Use Permit to allow relocation of an existing single family home to 14598 84`h Street NE (Lot 8, Block 1, Vasseur's Oak Grove Estate 2nd Addition) subject to the seven (7) conditions listed in the Planner's Report. Seconded by Commissioner Thompson. All in favor. Motion carried. 3.2. Lefebvre's Carpet: A. Administrative Permit to add on 1.3 acre to existine. B. Rezone detached portion of Parcel to B-3 District C. Building and Site Plan Review. Chair Nichols opened the Public Hearing at 8:08 PM. Judy Hudson attested all proper noticing and publishing was done. Dan Licht presented the Planner's Report. Steve Schuck arrived at this point. (8:10 PM) Planning Commission Meeting of May 6, 2002, cont'd. Page 2. Tim Smith, applicant, stated that back in 1994 it was thought that 93rd Street would be the Street that would go through. They would like to keep loading docks as shown. For landscaping, they plan on putting in rocks and shrubs and will work with Council and Staff on this. Mr. Smith requested that the Planning Commission approve this contingent upon these items getting done. Chair Nichols opened the Public Hearing for Public Comment. There was no public comment. Chair Nichols closed the Public Hearing at 8:20 PM. Commissioner Schuck asked if there is room for the loading docks on the east side of the building. Dan Licht replied the north side would be preferable. Chair Nichols asked if the Commission wants to table this until everything has been settled or take action. Commissioner Schuck motioned to approve a Zoning Map amendment rezoning that portion of PID 118-500-154302 subject to administrative subdivision from an A-1 District to B-3 District designation based upon a finding that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Moonen. Voting For the Motion: Commissioners Moonen and Schuck. Voting Against the Motion: Commissioners Fry, Thompson and Chair Nichols. Motion was defeated three (3) to two (2). Chair Nichols motioned to table this Item until additional information, as outlined in the Planning Report, is received. Seconded by Commissioner Fry. The applicant, Tim Smith, encouraged the Planning Commission to keep this process going by not tabling their request. He agrees with recommendations and will work with staff. Voting For the Motion: Commissioners Thompson, Fry and Chair Nichols. Voting Against the Motion: Commissioners Schuck and Moonen. Motion passed three (3) to two (2). 3.3. Otsego Waterfront West: A. PUD Development Stage Plan to develop a 22,300 square Foot restaurant. Chair Nichols opened the Public Hearing at 8:28 PM. Judy Hudson attested that the proper noticing and publishing was done. Dan Licht presented the Planner's Report. Bob Fields, applicant, went over the conditions listed in the Planner's Report. Condition 1. Will be done next week. Condition 2. Mr. Fields agrees with this Condition 3. Mr. Fields went over his redesign. Condition 4. They have made revisions to incorporate more masonry and will meet development standards. Condition 5. He agreed with this. Planning Commission Meeting of May 6, 2002, cont'd. Page 3. Condition 6. He is comfortable with the parking he has designed. Condition 7. Mr. Fields said he will work with staff under separate submittals. Condition 8. The City Engineer has these plans and is reviewing. Chair Nichols opened the Public Hearing for comment. There was no public comment. Chair Nichols questioned Conditions 4 and 6. Dan Licht replied the conditions can remain the same but the plans will need to be reviewed if approved. Regarding the fagade, there is flexibility in the PUD and if the Planning Commission feel they are moving in the right direction approval can be given. Mike Robertson agreed with Mr. Licht's recommendations and said the applicants are good at working with staff s suggestions. Chair Nichols opened for public or applicant comments. Rick Schroeder, a owner of Blackwoods, stated he is a landscaper and that Blackwoods landscaping will be beautiful. Chair Nichols questioned why there is only one set of bathrooms and would that be enough. Mr. Schroeder replied they are large bathrooms. Chair Nichols closed the Public Hearing at 9:04 PM. Commissioner Schuck motioned to recommend to approve a PUD Development Stage Plan for Blackwoods Restaurants, subject to the nine (9) conditions listed in the Planner's Report. Seconded by Commissioner Fry. All in favor. Motion carried. 4. Any other Planning Commission Business. A. Update on Council actions by CM Wendel. CM Wendel gave a update of the recent Regional Transportation Meeting and also the meeting with the Parrish Avenue residents. 5. Adjournment by 10 PM. Commissioner Moonen motioned to adjourn.
