09-02-03 PCCITY OF OTSEGO PLANNING COMMISSION MEETING SEPTEMBER 2, 2003 8 P OTSEGO CITY HALL 1_ Chair Nichols will call the meeting to order. Chair Nichols called the meeting to order at 8 PM. Roll Call: Chair Richard Nichols; Commission Members: Pam Black, Steve Schuck, Carl Swenson, Ken Fry, David Thompson. Alternates: Doug Hackman, Tammie Fallon. Staff: Mike Robertson, City Administrator; Judy Hudson, City Clerk; Dan Licht, City Planner City Council: Mayor Larry Fournier; Councilmembers: Vern Heidner and Jerry Struthers 2. Consider the following minutes: 2.1. August 4, 2003 Planning Commission Meeting_ Commissioner Black motioned approval. Seconded by Commissioner Fry. All in favor. Motion carried. 3. Planning Items: PUBLIC HEARING FOR THE FOLLOWING: 3.1. Scott and Shelley Meneley A. Conditional Use Permit to allow relocation of an Accesso Ky Building. Dan Licht presented the Planner's Report. Judy Hudson attested the property noticing and publishing was done. Applicant, Scott Meneley, stated that he has started to remove some of the buildings and is starting to clean up his property. Chair Nichols opened the Public Hearing at 8:08 PM. There were no public comments. Commissioner Schuck asked if there were any issues with any other conditions. Mr. Meneley said there were none. Hearing no public comments Chair Nichols closed the Public Hearing at 8:09 PM. Commissioner Schuck motioned to recommend approving the Conditional Use Permit for the proposed relocation of an existing pole building to 9115 Nashua Avenue subject to the 8 conditions listed in the Planner's Report. Seconded by Commissioner Swenson. All in favor. Motion carried. 3.2. Carl and Joy Swenson: A. Amendment to the PUD/CUP to make existing barns conforming structures and allow for renovation under R -C District. Commissioner Swenson requested to be excused from this Public Hearing, as this is his property and application. Dan Licht presented the Planner's Report. The applicant, Carl Swenson, stated he agrees with all the conditions in the Planner's Report. Planning Commission Meeting of September 2, 2003. Page 2. Judy Hudson attested all noticing and publishing was done. She also stated she received a phone call from Linda Magnuson, who lives near this property and stated she has no objections to this proposal. Chair Nichols opened the Public Hearing at 8:18 PM. Tom Wacker, 9852 James Avenue, said his two concerns would be changing the architectural look and if any building would be used for a business, otherwise he supports this project. Matt Rohrer, 10054 Jandel Avenue, asked if the shaded barn on the sketch plan represents the large white one barn and he also asked if the barns would be used for businesses. He supports the project, as he doesn't want to see the large barn removed. Carl Swenson said it is not the large barn. Dan Licht explained that there won't be any business located in the barns and that the Conditional Use Permit runs with the property. Hearing no other public comments, Chair Nichols closed the Public Hearing at 8:23 PM. Commissioner Fry motioned to recommend to approve a PUD -CUP amendment to allow for four detached accessory structures with a floor area not to exceed 9,500 square feet for Lot 4, Block 1 of Mississippi Pines based on a finding that preservation of the existing barns is consistent with the intent of the Comprehensive Plan and R -C District, subject to the 3 conditions listed in the Planner's Report. Seconded by Commissioner Schuck. All in favor. Motion carried. 3.3. Patrick and Carolyn Jansen: A. Conditional Use Permit to allow relocation of a Home. Commissioner Swenson rejoined the Planning Commission. Dan Licht presented the Planner's Report. Judy Hudson attested all noticing and publishing was done. The applicant, Pat Jansen, stated they agree with all the conditions. Chair Nichols opened the Public Hearing at 8:29 PM. There were no public comments. Commissioner Black asked if all the neighboring homes all have a 35 foot setback. Dan Licht didn't know but all new homes must comply with current requirements. Hearing no public comments Chair Nichols closed the Public Hearing at 8:30 PM. Commissioner Black motioned to recommend to approve the CUP to allow relocation of an existing single family dwelling to Lot 9, Block 1, Vasseur's Oak Grove Estates 2nd Addition is consistent with the requirements for building relocations as outlined within the Zoning Ordinance subject to the 8 conditions listed in the Planner's Report. Seconded by Commissioner Fry. All in favor. Motion carried. 3.4. Wayne and Diane Tor erg son: A. Conditional Use Permit to allow relocation of a Home. Dan Licht presented the Planner's Report. Diane Torgerson, applicant, stated that the attached structure to the back of garage will not be coming to their property and she agrees with all of the conditions. There were no public comments and Chair Nichols closed the Public Hearing at 8:40 PM. Commissioner Schuck motioned to recommend to approve the CUP for a relocation of an existing single family dwelling to Lot 16, Block 2, Vasseur's Oak Grove Estates 3rd Addition is consistent with the requirements for building relocations as outlined within the Zoning Ordinance subject to the 8 conditions listed in the Planner's Report. Seconded by Commissioner Swenson. All in favor. Motion carried. 3.5. Otsego West LLC: A. Rezone from Agricultural to R-4 Residential. B. Preliminary Plat to develop 144 Single Family Lots. Dan Licht presented the Planner's Report. Scott Dahlke, Project Engineer, asked the reason for removal of the one lot. Dan Licht explained the issue is that there would be 2 corner lots and there would be two butt lots. Scott Dahlke asked if the City could require that Lots 1, 2 and 3 of Block 9 be required to be orientated to face Avenue A and therefore keep all the lots. He stated he agrees with all of the other conditions. Judy Hudson attested all proper noticing and publishing was done. Chair Nichols opened the Public Hearing at 8:53 PM. Brad Hackenmueller 67`h Street, stated his only concern was the mailing, which did not include the details of this report, and his home will have 10 homes facing it. Commissioner Schuck asked if the access on east should be relocated. Dan Licht replied it will be. City Administrator Mike Robertson said that stormwater ponds when located in the back yards can create problems, and that he likes stormwater ponds on outlots. Mr. Licht replied the Ordinance leaves it open to either option. John Kolles, 7009 McAllister Avenue, was concerned with the stormwater, that if it goes southeast it goes to the Praught land and then back into the Otsego Creek. He also asked about sewer going along 67`h Street. Hearing no further public comments Chair Nichols closed the Public Hearing at 9:08 PM. Commissioner Hackman asked about paving 67`'' Street. Dan Licht said there is no timeline and it will be gravel until the Kolles property is developed. Commissioner Schuck motioned to recommend to approve a Zoning Map amendment rezoning the subject site from A-1 District to R-4 District based upon a finding that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Fry. All in favor. Motion carried. Commissioner Schuck motioned to recommend to approve the Otsego West Preliminary Plat, subject to the 9 conditions listed in the Planner's Report adding Condition 10 that Lots 1, 2, 3 of Block 9 must orientated to face the street or remove the center lot. Seconded by Commissioner Black. All in favor. Motion Carried. Planning Commission Meeting of September 2, 2003. Page 4. 4. Any other Planning Commission Business. A.
