04-05-04 PCITEM 2-1 OTSEGO PLANNING COMMISSION April 5, 2004 7 P OTSEGO CITY HALL 1. Chair Nichols will call the meeting to order. Chair Nichols called the meeting to order at 7:00 PM. Roll Call: Richard Nichols, Chair; Planning Commission: Pam Black, Steve Schuck, Doug Hackman, Tammie Fallon, David Thompson and Jim Kolles. Alternate: Tom Darkenwald (left at 8:05 PM). Excused absence: Ken Fry, Carl Swenson Staff: Judy Hudson, City Clerk/Zoning Administrator; Mike Darrow, Assistant City Planner Council: Mayor Larry Fournier, Councilmembers: Vern Heidner, Virginia Wendel and Jerry Struthers. 2. Consider the following minutes: 2.1. Planning Commission Meeting of March 15, 2004. Commissioner Thompson noted that it was him that nominated Commissioner Black for Vice Chair. Commissioner Schuck motioned approval as amended. Seconded by CM Black. All in favor. Motion carried. 3. PlanningItems: ems: PUBLIC HEARINGS: 3.1. Cindy Schmitz: A. Rezoning from A-1 District to A-2 District. B. Conditional Use Permit to create a lot less than 20 acres. Mike Darrow presented the Planner's Report. Cindy Schmitz, applicant, stated she agrees with the conditions. Judy Hudson attested all proper noticing and publishing was done. Chair Nichols opened the Public Hearing at 7:05 PM. There were no public comments. Commissioner Schuck questioned if the Engineer's request for a 33 -foot right-of-way should be stated in Condition No. 3. Staff explained it is included in Condition No. 1. Hearing no public comments, Chair Nichols closed the Public Hearing at 7:08 PM. Commissioner Schuck motioned to approve a Zoning Map amendment rezoning the subject site from A-1 District to A-2 District based on a finding that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Thompson. All in favor. Motion carried. Commissioner Schuck motioned to approve a CUP allowing an A-2 District lot size less than 20 acres and a width less than 450 feet, subject to the 6 comments listed in the Planner's Report. Rezoning from Agriculture to R-6 Residential Townhouse, Quadraminium and Low Density Multiple Family District. B. Preliminary Plat within a Shoreland Overlay District. Mike Darrow presented the Planner's Report. Judy Hudson attested all proper noticing and publishing was done. The applicant, Heritage Development, was not in attendance. Chair Nichols opened the Public Hearing at 7:16 PM Jerry Kurtti, neighboring property questioned Lambert Avenue. CM Heidner explained the developer needs to purchase land from him for this street. Commissioner Schuck questioned the future right in and right -out. CM Heidner explained that 70th Street won't be upgraded to a County Road for several years. Hearing no other public comments, Chair Nichols closed the Public Hearing at 7:21 PM. Commissioner Hackman motioned to approve a rezoning the area of the subject site from A-1 District to R-6 District as being consistent with the policies of the Comprehensive Plan. Seconded by Commissioner Kolles. All in favor. Motion carried. Commissioner Black motioned to approve the Preliminary Plat for Heritage Development subject to the 13 conditions listed in the Planner's Report. Seconded by Commissioner Schuck. All in favor. Motion carried. 4. Any other Planning Commission Business. 4.1. Temporary Sign Ordinance. Mike Darrow presented the Planner's Report. The Planning Commission suggested using Owner or Manager in Section 6.E.3. In 3.1). and 6.1). they suggested one is private and one is public. Also for the electronic message signs, they feel the intent of the ordinance is not to have flashing signs and the ones that update at night would be okay. The Planning Commission requested staff to make the changes and bring back before setting a date for the Public Hearing. 4.2. Consideration of allowing more than one access to large parcels. Mike Darrow presented the Planner's Report. The Planning Commission were concerned with people building an accessory building and then saying they have a demonstrated need for a second access. Also confusion on how many accesses would be allowed, why is 450 feet used. They also suggested differences between curb and gutter and the lots that don't have curb and gutter. For the County Roads, add City and County Engineer review. 4.3. Update on Council actions by CM Heidner. CM Heidner updated the Commission on recent council actions.
