05-17-04 PCITEM 2-1 OTSEGO PLANNING COMMISSION MAY 17, 2004 7 P OTSEGO CITY HALL 1. Chair Nichols will call the meeting to order. Chair Nichols called the meeting to order at 7:02 PM. Roll Call: Chair Richard Nichols; Pam Black, Steve Schuck, David Thompson Alternates: Doug Hackman, Tammie Fallon, and Tom Darkenwald. Excused Absence: Jim Kolles and Carl Swenson. Staff. Michael Robertson, City Administrator; Judy Hudson, City C1erk/Zoning Administrator and Dan Licht, City Planner. Council: Mayor Larry Fournier; Councilmembers: Vern Heidner, Jerry Struthers and Virginia Wendel. 2. Consider the following minutes: 2.1. April 19, 2004 Planning Commission Meeting. Commissioner Schuck motioned to approve the minutes. Commissioner Black seconded. All in favor. Motion carried. 3. Planning Items: PUBLIC HEARINGS: 3.1. Prairie Oaks 1. Rezoning from A-1 District to R-3 Residential District. 2. Preliminary Plat for 11 residential lots. Dan Licht presented the Planner's Report. The applicant has requested that the accessory building on Lot 3, Block 1, remain, as they will be building their home there very soon. Mr. Licht recommended to amend Condition No. 5 adding at the end unless Principal structure is built within one year from the date of Final Plat approval. The applicant, Scott Rodby, agreed with the conditions and said he was willing to redo the building to match City requirements. Judy Hudson attested all proper noticing and publishing was completed. Chair Nichols opened the Public Hearing at 7:10 PM Nancy Nelson, 14604 92nd Street, adjacent to this development. She asked if her yard will be restored after the cul-de-sac is removed and how soon will this project start. Dan Licht explained that her yard will be restored and it will be several weeks until grading starts. Clayton Jurrens, 14509 92"d Street, requested that the cul-de-sac remain and not be a through street. Mr. Licht explained that this street has always been platted as a through street since the current cul-de-sac is over the allowed 500 feet. Hearing no other public comments Chair Nichols closed the Public Hearing at 7:16 PM. Commissioner Black motioned to recommend approval of a Zoning Map amendment rezoning the subject site from A-1 District to R-3 District based on a finding that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Thompson. All in favor. Motion carried. Planning Commission Meeting of May 17, 2004. Page 2. Commissioner Schuck motioned to recommend to approve the Prairie Oaks Preliminary Plat subject to the nine conditions listed in the Planner's Report amending Condition No. 5. Seconded by Commissioner Black. All in favor. Motion carried. 3.2. Clarence Schumacher: 1. Conditional Use Permit (CUP) to allow relocation of a single Family home on a lot within Otsego. Dan Licht presented the Planner's Report. Judy Hudson attested that the proper publishing and noticing was completed. Chair Nichols opened the Public Hearing at 7:27 PM. Hearing no comments Chair Nichols closed the Public Hearing at 7:28 PM. Commissioner Black motioned to recommend to approve a Conditional Use Permit for relocation of an existing building to a lot within the City, subject to the seven conditions listed in the Planner's Report. Seconded by Commissioner Fallon. All in favor. Motion carried. 3.3. Waterfront East: 1. PUD Development Stage Plan for the Otsego Waterfront East. The applicant, Bob Fields of LandCor Companies, presented the revised plans. Judy Hudson attested all proper noticing and publishing was completed. Chair Nichols opened the Public Hearing at 7:38 PM. There were no public comments. Chair Nichols motioned to continue the Public Hearing to June 7, 2004. Seconded by Commissioner Schuck. All in favor. Motion carried. 3.4 Quaday Addition: 1. Preliminary Plat for a PUD General Development Plan/CUP Conditional Use Permit to allow a shared driveway and lots without direct access to a Public Street. Dan Licht presented the Planner's Report. Judy Hudson attested all proper noticing and publishing was completed. The applicant, Clem Darkenwald, requested the Planning Commission table this item to the June 7, 2004 Planning Commission Meeting. Chair Nichols opened the Public Hearing at 7:45 PM. George Sebeck, 8116 River Road, questioned the existing driveway to Lot 1, Block 2, as he feels this driveway currently sits on his property. Both Dan Licht and Mike Robertson explained that issue is outside of this plat and is between the property owners. Dan Licht noted that future access to this property would have to come from Quaday Avenue. Chair Nichols motioned to continue the Public Hearing to the June 7, 2004 Planning Commission Meeting. Seconded by Commissioner Schuck. Voting For the Motion: Chair Nichols, Commissioners: Schuck, Thompson, Black, Hackman and Fallon. Abstained: Commissioner Darkenwald. Motion carried. Judy Hudson attested that the proper noticing and publishing was completed. Chair Nichols opened the Public Hearing at 7:55 PM. Hearing no public comments, Chair Nichols closed the Public Hearing at 8:05 PM. Commissioner Schuck recommended approval of the draft amendment adding Condition E that a second access may incur additional costs or assessments. Seconded by Commissioner Black. All in favor. Motion carried. 3.6. Consideration of amending Section 20-37-3.A.3 of the Zoning Ordinance (signs) regarding temporary message signs and special message signs. Dan Licht presented the Planner's Report. Judy Hudson attested all proper noticing and publishing was done. Chair Nichols opened the Public Hearing at 8:07 p.m. Scott Ziessman, 9175 Quaday Avenue NE, owner of Fantastic Sams. Mr. Ziessman requested better enforcement of illegal signage in Otsego and requested that portable signs be allowed and to increase the allowance of banners. Keith Franklin, Albertville, requested to allow portable signs as they have a high success rate in advertising and are high in demand. Mr. Franklin asked to continue the Public Hearing to give him time to work with business owners on a new proposal. Virginia Wendel, Otsego, asked for temporary signs to be allowed for chartable groups. Hearing no further comments, Chair Nichols closed the Public Hearing at 8:57 PM. After a lengthy discussion Chair Nichols said the issue is what to do with portable signs. He supports passing this Ordinance and see what happens. Commissioner Schuck agreed and suggested requiring multiple tenant buildings to have a changing message sign for their tenants. Commissioner Black noted on Page 2, Item E.3. the wording or their designated responsible party was left off and should be put back in. Commissioner Thompson motioned to approve amending Section 20-37-3.A.3 of the Zoning Ordinance (signs) regarding temporary message signs and special message signs including amending Item E.3. by adding or their designated responsible party. Seconded by Commissioner Schuck. All in favor. Motion carried. 4. Any other Planning Commission Business. Commissioner Thompson requested to look at requiring a minimum size for garages for town homes. 4.1. Update on Council actions by CM Heidner. Commissioner Heidner updated the Planning Commission on recent Council actions. 4.2. Update on future Planning Items by Judv Hudson. Clerk/Zoning Adm.
