City Administrator Johnson stated that the redistricting information was recently released indicating that Otsego is now in two House districts. The north easterly part of the City east of State Hwy 101 south to 65th Street NE is in a different House district. Because of this, the City needs to divide into precincts. The Council discussed the ability to contest the new boundary and the effect redistricting will have on Otsego voters. The Council directed staff to report back on options to appeal the new House district boundary. Ms. Johnson stated that staff would present proposed precinct boundaries at the March 12, 2012, meeting, take Council input and adopt the new precincts on March 26, 2012. CIP Presentation. Staff reviewed the items carried over from the February 12, 2012, meeting. The Council agreed with Finance Director Groen's staff report to combine certain capital project reserve street improvement funds and directed that this item be added to the next City Council agenda. The Council reviewed City Engineer Wagner's reports on water storage analysis of the east and west water systems. The analysis showed significant benefit in retaining Water Tower #1. The benefit that justifies continued maintenance of the tower including exterior painting which is currently needed. The Council directed staff to begin the process solicit bids to paint the exterior of the tower in 2012 and to delay interior painting until the tower is put back on the system. The Council preferred option #3 for the west water system with the improvements being made in 2012 or 2013. City Administrator Johnson stated financing needs to be identified before the project could move forward. She stated staff would review financing options and report back to the Council. Staff reviewed street projects. The Council requested that staff approach Wright County to ask for assistance in funding the CSAH 39 improvements. The Council directed the City Engineer to bring back a feasibility study for the La Beaux Avenue Frontage Road project. Staff reviewed city facility projects. The Council stated they are in favor of moving city hall staff to the public works facility. Staff will continue to define costs for the public works build out and the roof and other maintenance items at city hall. The Council directed the City Engineer to provide a cost estimate for a scaled down parking lot to accommodate city hall staff at the public works building. Staff reviewed park projects. The park improvements will be discussed with the Parks and Recreation Commission on March 14. The Council directed staff to solicit quotes to complete the landscaping on the east side of Waterfront East Park. City Planner Licht and Mayor Stockamp will meet with the property owner regarding a trail from Queens to Riverpointe. The Council suggested the tennis courts be removed from the Special City Council Meeting February 27, 2012. Wildflower Meadows Park plan. The Council indicated that Darkenwald Park development is a priority. Ball fields and parking at Prairie Park were discussed. The Council directed staff to remove the purchase of Begin property from the CIP as the property is not needed for development of soccer fields. The Council directed staff to contact the lacrosse, football, and rugby associations to gage their interest in contributing to the development of soccer fields as the fields could be used for those sports. Staff reviewed public safety projects. The installation of two emergency sirens was moved to 2012. The balances of the projects were moved back to 2015 and 2016. 4. Any other items. CITY COUNCIL MEETING: 12 March 2012 FINDINGS: Based upon review of the application and evidence received, the City Council of the City of Otsego now makes the following findings of fact: A. Minnesota Native Landscapes is an existing business located at 8740 77th Street NE, adjacent to 1-94. B. The subject site is zoned A-2, Agriculture Long Ranger Urban Service District; Minneosta Native Landscapes is allowed as a permitted forestry, nursery, greenhouse or tree farm use. C. Uses within the A-1, Agriculture Rural Service District and A-2, Long Range Urban Service District are limited to one sign with an area not to exceed 64 square feet and a maximum freestanding height of eight feet. D. The applicant is requesting an amendment of the Zoning Ordinance to allow signs for forestry, nursery, greenhouse and tree farm uses the same as allowed properties within commercial and industrial districts. E. Consideration of the application is to be based upon (but not limited to) the criteria set forth by Section 20-3-25 of the Zoning Ordinance: The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: The Comprehensive Plan guides that their be a balance between the City's public safety and aesthetic basis for limiting signs and business identification needs. Forestry, nursery, greenhouse and tree farm uses are unique agriculture businesses that have operations and business identification needs similar to that of uses located in commercial and industrial districts. As such, content neutral sign allowances specific to these uses is consistent with the Comprehensive Plan as well as the City's economic development goals. 2. The proposed use's compatibility with present and future land uses of the area. Finding: The allowance of increase signage for forestry, nursery, greenhouse and tree farm uses within A-1 and A-2 District will not create compatibility issues with adjacent properties given the limited application of the proposed amendment. 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Finding: The use and any proposed signage would be required to comply with all other provisions of the City Code. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Finding: The proposed amendment will not affect traffic generation. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Finding: The proposed amendment will not affect the City's service capacity. F. The Planning Report dated 29 February 2012 prepared by the City Planner, The Planning Company LLC., is incorporated herein. G. Not more than one (1) double -sided freestanding sign. Sign area may not exceed one hundred (100) square feet each side with a maximum height of twenty (20) feet, except that for signs within the Freeway Corridor District, the sign area shall not exceed two hundred (200) square feet each side with a maximum height of fifty (50) feet. C. Wall, Canopy, or Marquee. Wall, canopy, or marquee signs shall be permitted on one facade fronting a public street, except in the case of a corner lot or through lot where wall signs may be installed on two facades fronting a public street. The area of individual signs shall not exceed one hundred (100) square feet, except that for signs within the Freeway Corridor Districts, the area of signs installed on the facade of a principal building fronting to a principal arterial roadway shall not exceed two hundred (200) square feet. Each core will need to measure the thickness of asphalt, the class 5, and the sand drainage base. Each asphalt core will need to have its density determined to ensure that proper compactive effort was completed when the asphalt was placed. 3) The plans need to indicate which services will be used and which will be abandoned in place. Each curb stop box abandoned must be lowered 1' below final grade using the riser to minimize the potential for future damage. A detail showing this must be included. 4) The preliminary plat must be signed by a licensed Professional Land Surveyor. 5) The erosion control sheet must show locations of silt fence and where each of the other erosion control items shown in the detail sheets are to be used 6) An estimated quantity sheet and cost estimate must be completed so as the City Engineer can determine an adequate escrow and financial security to the City from the developer as part of the re -plat. 7) The parking bays which exist north of Outlot A need to be removed and boulevard and curb and gutter installed. The City will not perpetually maintain or replace unwarranted parking. 8) Drain tile with individual lot connections for sump pumps must be installed along the rear lot line of Lots 5-9 of Block 1. 9) The reconfiguration of the storm sewer and storm ponds has been evaluated and determined to meet City standards. No. No. BACKGROUND/JUSTIFICATION: With the significant snowfall on 29 February 2012, it has been one of the first opportunities for snowmobilers to ride within the City. Asa result, the City received an emailed complaint from one resident regarding snowmobiles along 85th Street and Public Works staff reported snowmobiles having ridden on City trails. Snowmobiles are regulated by Chapter 8, Section 1 of the City Code. Operation of snowmobiles within areas designated on the adopted snowmobile map is limited to travel to/from established snowmobile trails at a maximum speed of 10 mph. Along City streets with curb and gutter, snowmobiles are required to ride along the shoulder of the street section. Information regarding snowmobile regulations is posted on the City's website and published annually in the Otsego View. Enforcement of the City Code would be the jurisdiction of the Wright County Sherriff's Office as part of their police protection services for Otsego. In continuing to allow snowmobiling within Otsego, an understanding was reached between the City Council and the Otsego River Riders Snowmobile Club several years ago. The Otsego River Riders are responsible to provide outreach and education to snowmobilers in Otsego as to the City's regulations. The Otsego River Riders maintain a website, host snowmobile events and conduct snowmobile safety classes making education of snowmobile regulations part of each activity. Otsego River Rider members also talk with other snowmobilers in the field or respond to complaints regarding snowmobiling in Otsego. Representatives of the Otsego River Riders committed to attending City Council meetings during the snowmobile season to address any comments, questions or concerns. In 2011, the Otsego River Riders secured a new trail from Odean Avenue to the CSAH 39/CSAH 42 area that would allow off- street access between residential neighborhoods and the City's commercial businesses including gas and restaurants. City staff contacted Otsego River Riders President Pat Hilden on Thursday, 1 March 2012 to relay that snowmobilers had been riding on City trails and along the boulevard adjacent to 85th Street. Mr. Hilden indicated that he would address this issue at the Club's regular meeting to be held that evening and also send out an email to all club members regarding where snowmobiles may be operated. 4_2 Mr. Hilden will attend the City Council meeting on 12 March 2012 if there are any questions or comments from the City Council members. Reviewing the adjacent city siren coverage and Xcel Energy siren coverage the two sirens were determined to be located at the CSAH 39 GRE/WH Electric Sub -station and along 70th St near the Nadala Avenue. The 70th siren is placed to cover the remaining area of the west sewer district not covered currently while allowing for proper spacing of future sirens to efficiently cover the remaining gaps. Three more future sirens will cover the city. Two of these are being discussed with St. Michael as partial shares as they are proposed on the border. We are researching the area south of the interstate to see if it is covered by an Xcel Energy siren. The addition of the two sirens for this year bring the parcel coverage in the city to over 95%. Last spring frost boils made the road impassable from time to time requiring extra hours to maintain the gravel road. The existing storm sewer system consisting of shallow ditches and small driveway culverts has filled and grown in and does not efficiently convey the storm water away from the road bed. The Council discussed La Beaux Avenue during the Capital Improvement Plan discussions and directed staff to bring the attached resolution to the Council. The proposed feasibility study will determine the best alternative to efficiently convey storm water to Otsego Creek and convert the road to a paved section for less day to day maintenance. That area of redistricting includes a population of 590 residents. Redistricting Challenge The City Council at their February 27th City Council meeting directed City staff to look into contesting the new legislative boundary splitting the City. I spoke with Brad Neuhauser an assistant of Gary Poser, the Director of Elections, at the Secretary of State's office; he stated the only way they would look at changing the decision is if there was some sort of technical error, an example would be a split building. He said there really is no option to change the boundary. 2012 Precinct options At the last election we had 6,688 registered voters; we currently have 7,023. There are several options. One is to have one large precinct and one small precinct with the majority of the registered voters still using the large precinct. The recommended option is to break up into three separate precincts and combine the polling location for precincts 2 and 3. The reasoning is that although Staff has done a good job managing the number of people at the last election, it got to be too big for one location. I feel with the redistricting changes of a new precinct this would be the best time to make the change to three separate precincts. If we don't do it this election, we will be splitting at it for the 2014 election. • 2012 is a Presidential election and we can expect a higher turnout than the last election. • State recommendation is 3,000 registered voters per precinct with no more than 15 minute wait time. The busy times during the last election we experienced a 20-25 minute wait in some sections. • Parking -staff has done a good job directing traffic and parking but it is very chaotic for this amount of people. If there would happen to be a snow storm, the parking situation would be challenging. • The distance voters have to walk from the parking area and within the Public Works Facility is difficult for the older voters which we have received comments on in the past. We do have a wheel chair available, but it has only been used once or twice. I would recommend going back to using City Hall as a polling place. This would eliminate the issues noted above. Proposed Precincts Attached is a proposed precinct map with three precincts prepared using the census blocks. Statute requires districts to be as nearly equal in population as possible. Statue 2046.14; subd. 2 allow us to have separate precincts with a combined polling place and use the same judges. The use of the same ballot counter for two precincts is limited to a combined total fewer than 2,500 registered voters. So we would still need separate ballot counters. Some suggested precinct polling locations are as follows: Precinct 1- City Hall is the recommended location. The Public Works Facility would be the second choice. Precinct 2 and Precinct 3 combined- Otsego Elementary. Statue 20413.16, 200.02, subd. 24; 20413, 16; 473.121 requires that the precinct polling place be located no more than one mile outside the precinct boundary. Equipment We currently have two M100 machines (ballot counters) and one Automark. If we were to go to three precincts, we will need to purchase 1 more ballot counter and 1 Automark machine. I received a quote from Elections Systems & Software in the amount of $5,385.00 each plus tax for the M100 machine and $4,340.00 each plus tax for the Automark. Wright County has said they are sympathetic to the city having to establish a new precinct and they would consider splitting the cost of both the M100 and Automark. I think this is a onetime offer and that we should take advantage of it at this election. We have 80 election booths that we can divide up accordingly for each polling place. 2 City Action Required The City has to establish precinct boundaries and polling places by April 3, 2012. At this time City staff needs direction on the number of precincts and locations. Staff recommends three precincts; precinct 1 to be held at City Hall and combing precincts 2 and 3 to be held at Otsego Elementary. With your direction staff will then bring back a resolution on March 26, 2012 for City Council approval.
