03-05-12 PCITEM 7_7 OTSEGO PLANNING COMMISSION MEETING OTSEGO CITY HALL MARCH 5, 2012 7 PM Call to Order. Chair Black called the meeting to order at 7:00 PM. Roll Call: Chair Pam Black; Commissioners: David Thompson, Tammie Fallon, Brian Gerten and Aaron Stritesky. Absent: Jim Kolles and Richard Nichols. City Council: CM Vern Heidner. Staff: Daniel Licht, City Planner; and Tami Loff, City Clerk. 1. Consider the following minutes. 1.1 February 21, 2012 Planning Commission Meeting. Commissioner Fallon motioned to approve as written. Seconded by Commissioner Stritesky. All in favor. Motion carried. 2. Public Hearing: 2.1 Kittredge Crossings 6t" Addition: A. Preliminary plat and PUD/Development Stage Plan to replat 70 townhouse unit lots and common open space as 28 single family lots. B. Vacation of existing drainage and utility easement. City Planner Licht presented the Planning Report. Representatives for applicant Shelard Group, Inc.; Jacob Wert and Marty Campion were present and agreed with the staff report recommendations. City Clerk Loff attested that all the proper noticing, posting and publishing has been completed. City Clerk Loff stated for the record she received a call from residents Troy & Megan Gutzwiller, 7473 Kahler Court NE, who said they approve of the proposal and they would rather see single family over townhomes. Chair Black opened the Public Hearing at 7:10 PM. Michelle Oliveira, 7490 Kahler Court NE, said that she rather see single family homes than townhomes. Her concerns are if there is going to be any additional cost to the existing residents, she doesn't want to see the houses sit unfinished and she is also concerned with weeds. City Planner Licht said there will be no additional costs to the existing residents. City Planner Licht said that builder has 180 days from which the building permit is issued to complete exterior work. City Planner Licht said that property maintenance is addressed by the City Code and is actively enforced. David Anderson, 7243 Kittredge Cove NE, said his house was supposed to be a row house at one time but the builder ran out of money and never finished it. City Planner Licht said that City staff has talked with Mr. Anderson on this issue and explained that Mr. Anderson owns a townhouse on a unit lot. Planning Commission Meeting March 5, 2012. Michelle Oliveira, 7490 Kahler Court NE, asked what Outlot B will be. City Planner Licht said it is to be a stormwater basin. Applicant Engineer Mr. Campion said the proposed pond is in the same general location as the existing pond but going to be slightly reconfigured. Luis Oliveira, 7490 Kahler Court NE, said he is concerned with the open pond and the kids in the neighborhood. Mr. Campion said the pond is designed to have water in it but has gradual slopes along the perimeter. City Planner Licht said that the development is required to have the pond by State law. Alisha Ely, 7300 Kahler Circle NE, said she is worried having undeveloped or unfinished projects. Mr. Campion said that the current developer Shelard Group, Inc. has been maintaining the property and that any undone building they took back from the original developer has been completed and sold. Mr. Campion said they only have control over lots they own. Ms. Ely also has concern on what kind of home goes in. Mr. Campion said that the developer would expect something similar to the north but they don't have a builder identified yet. Brian Dancer, 7327 Kalland Circle NE, said he has concern with the condition of 70th Street and also that there are no sidewalks or paths. City Planner Licht said that the City is aware of 70th Street's condition. City Planner Licht said that this is a border street owned by both the City of Otsego and the City of Albertville and that Otsego has not been able to get an agreement with the City of Albertville to fix this street. CM Heidner said four years ago Otsego was willing to go ahead with an agreement and is still willing to work with Albertville. Michelle Oliveira, 7490 Kahler Court NE, asked if the stormwater pond will fill the whole outline of the map shown. City Planner Licht said that map shows the contours of the pond. Ms. Oliveira asked how far off 70th Street is the pond. Mr. Campion said that the edge of the normal water is 30 feet from the road. Michelle Oliveira, 7490 Kahler Court NE, asked if the developer is looking at the other proposed townhomes. Mr. Wert said that at this time they are only proposing to replat Kittredge Crossings 6th Addition and have not considered changes to other areas within Kittredge Crossings that they own. Commissioner Gerten asked if there should be any worry of previously put in gas lines. City Planner Licht said the gas lines would be on the public right of way. Commissioner Thompson asked how many feet between the sidewalk and the boulevard. Mr. Campion said he is not sure if in the property line; it is within the right of way. City Planner Licht said that City staff intends that most of side walk would be within the right away. Commissioner Thompson said there is no sidewalk on the inner line. City Planner Licht said correct. Fil Planning Commission Meeting March 5, 2012. David Anderson, 7243 Kittredge Cove NE, asked what the speed limit is on 70th Street because there are no speed limit signs. Mr. Anderson also said that the grass was only cut two times last year. City Planner Licht said that City staff will check with the City Engineer on the speed limit and reply to Mr. Anderson. City Planner Licht said regarding the grass mowing that there was a change to the City Code that allows a property with more than one acre to have taller grass provided the noxious weeds are controlled. City Planner Licht said they still are required to mow a buffer zone next to developed lots. Chair Black closed the Public Hearing at 7:44 PM. Commissioner Thompson motioned to approve the PUD Development Stage Plan/ Preliminary Plat and easement vacation for Kittredge Crossings 10th Addition subject to the eleven (11) conditions listed in the planners report dated March 1, 2012. Seconded by Commissioner Stritesky. All in favor. Motion carried. 2.2 MN Native Landscapes: A. Application to amend Section 37 regarding signs for forestry, nurseries,, green houses and tree farm uses. City Planner Licht presented the Planning Report. Applicant Joe Schaffer with MN Native Landscapes said he is looking for more exposure and that he agrees with staff report and recommendations. City Clerk Loff attested that all the proper noticing, posting and publishing has been completed. Chair Black opened the Public Hearing at 7:51 PM. Commissioner Gerten asked if there is example of signs requested. City Planner Licht said some examples would be Trudell Trailers and Midwest Landscapes.
