03-34CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO. 2003-34 RESOLUTION ACCEPTING DONATION OF CERTAIN LANDS WHEREAS, F.O.A. Partnership, a Minnesota general partnership owns certain lands located within the City of Otsego which have been proposed for platting as PLEASANT CREEK FARMS; and WHEREAS, F.O.A. Partnership desires to donate a certain lot to the City of Otsego without conditions; and WHEREAS, F.O.A. Partnership has requested that the City execute appropriate resolutions necessary to achieve the required documentation of the transaction for tax purposes; and WHEREAS, the legal description of the property is LOT 1, BLOCK 1 PLEASANT CREEK FARMS according to the plat on file and of record at the Recorder's Office, Wright County, Minnesota; and WHEREAS, it is the desire of the City of Otsego to accept F.O.A. Partnership's generous donation to the City of the subject property. NOW THEREFORE BE IT RESOLVED: 1. That the City of Otsego accepts F.O.A. Partnership's donation of the subject property. 2. The City acknowledges that the value of the subject property is as follows one million dollars ($1,000,000.00). The determination of value is based upon the following: the Developer's appraisal of the value of the land (approximately 22 acres) at $50,000.00 per acre. Said valuation generally conforms with information conveyed to the City regarding recent land transactions in that area of the City. 3. That the Mayor and City Clerk are authorized to execute any required documentation necessary to effect the transfer of the subject property to the City conditioned upon F.O.A. Partnership providing the following to the City: A. Marketable title, unencumbered by liens of any nature, and evidenced by title insurance or title opinion; and B. Warranty deed transferring the property to the City without condition. C. Allowing the City Engineer or Project Engineer to enter upon the property and make any necessary inspections to ascertain that the lot is suitable for the City's needs.
