ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No I No BACKGROUNDMUSTIFICATION: A portion of Arbor Creek 3`d Addition was partially constructed in 2007. The area west of Maclver Avenue was completed including paving the final wear course. The area east of Maclver Avenue had the watermain, sanitary sewer, and all services installed in 2007 as well. The construction of the streets, storm sewer, and sidewalk were left unfinished. Arbor Creek — Phase 2 consists of 27 single-family residential lots within the original Arbor Creek 3`d Addition, west of Maclver Avenue. All remaining improvements for Arbor Creek 3rd Addition — Phase 2 were constructed in 2014 with the exception of placement of the bituminous wear course which was required to wait until one freeze/thaw cycle and 75% buildout had occurred. The wear course was completed in the fall of 2015 and an initial acceptance walk-thru was conducted with City Staff, the developer, and contractor October 21, 2015. All remaining items have been successfully completed. Staff recommends that all public improvements be initially accepted as of October 28, 2015. Per the Developer's agreement for Arbor Creek 3rd Addition — Phase 2, the Developer warrants; 1. All public improvements, other than streets, within the plat as of the date of this resolution commencing the one (1) year warranty period from this date. 2. All public street improvements within the plat as of the date of this resolution commencing the two (2) year warranty period from this date. SUPPORTING DOCUMENTS: ❑ ATTACHED: ® NONE A. BUDGET INFORMATION FUNDING: I BUDGETED: ❑ YES M NO (NIA) ACTION TAKEN ❑ APPROVED AS REQUESTED ❑ DENIED ❑ TABLED ❑ OTHER (List changes) RESOLUTION NO. 2016-08 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR ARBOR CREEK 3RD ADDITION — PHASE 2. WHEREAS, the City Council approved the final plat of Arbor Creek 3rd Addition (the "plat") on January 10, 2005; and, WHEREAS, the City and Developer entered into a Developers Agreement October 8, 2013 for Arbor Creek 3rd Addition — Phase 2 and recorded with Wright County as Document #A1251670 regarding approval of the plat and installation of required public improvements within the plat; and, WHEREAS, all public street improvements, including bituminous base and wear course paving, curb and gutter, sidewalk, grading and erosion control have been completed; and, WHEREAS, all public utility improvements, including watermain and services, sanitary sewer main and services, and storm sewer have been completed; and, WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved plans within the plat; and, WHEREAS, an initial acceptance inspection of the public improvements within the plat was conducted on October 21, 2015 with City staff and the Developer, and all remaining items have been successfully completed; and, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA THAT 1. The City accepts all public improvements, other than streets, within the plat as of October 28, 2015 commencing the one (1) year warranty period from this date. 2. The City accepts all public street improvements within the plat as of October 28, 2015 thus commencing the two (2) year warranty period from this date. 3. Upon conclusion of the respective warranty periods and completion of a final acceptance inspection by City staff and satisfaction of any conditions of said final inspection, improvements lying within public easements and public right-of-way shall be come City property without further notice or action.
