RESOLUTION ORDERING PREPARATION
OF PLANS AND SPECIFICATIONS
A RESOLUTION ACCEPTING FEASIBILITY STUDY, WAIVING PUBLIC
HEARING AND DIRECTING PREPARATION OF PLANS AND SPECIFICATIONS
FOR THE IMPROVEMENT OF PROJECT NO. 03-08, FOR TRUNK UTILITY
IMPROVEMENTS TO THE FOLLOWING AREA KITTREDGE CROSSING.
WHEREAS, the City Council ordered the preparation of a feasibility study
for the improvement on the 21 ST day of April, 2003; and
WHEREAS, such feasibility study was prepared by Hakanson Anderson
Associates, Inc. and presented to the Council on the 23`d day of June, 2003; and
WHEREAS, the Petitioner, Darrel A. Farr Development Corporation have
waived the right to a Public Hearing; and
WHEREAS, the City Council has reviewed the feasibility study and declares
the improvement feasible, for an estimated cost of $695,000.00.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Otsego to hereby receive the feasibility report with an estimated total cost of
improvements of $695,000.00, waive the Public Hearing and order improvements.
BE IT FURTHER RESOLVED by the City Council to hereby direct the firm
of Hakanson Anderson Associates, Inc. to prepare the plans and specifications for
such improvement project.
BE IT FURTHER RESOLVED by the City Council to hereby require the
Petitioner, Darrel A. Farr Development Corporation, submit an escrow with the City
in the estimated amount of the cost of the Plans and Specifications ($20,000.00)
and agree to pay any costs in excess of that amount as per the City of Otsego and
Hakanson Anderson Associates, Inc. contract and, further, that the Petitioner
execute an Agreement with the City agreeing to pay any and all costs associated
with the construction of the project and waiving irregularities, hearing, and right of
appeal to have said amount assessed against real property owned by Petitioner.
