ITEM 3.2A 3.14.2016 MinutesITEM 3_2A OTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER MARCH 14, 2016 7:00 PM Call to Order. Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Jason Warehime and Doug Schroeder. Absent: Councilmember Tom Darkenwald. Staff: Lori Johnson, City Administrator; Ron Wagner, City Engineer; Andy MacArthur, City Attorney; Adam Flaherty, Finance Director and Tami Loff, City Clerk. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum. Mayor Stockamp stated Representative Eric Lucero is expected tonight to give an update. She said when he arrives the City Council will reserve time for him. 2. Consider agenda approval. CM Schroeder requested to move Item 3.3 for discussion to Item 11.1. CM Heidner motioned to approve as amended. Seconded by CM Schroeder. All in favor. Motion carried. 3. Consent Agenda. (Non -controversial items). 3.1 Approve Claims List. 3.2 Approve City Council Meeting Minutes. A. February 22, 2016 Meeting. REMOVED 3.4 Approve purchase of a Shouldering Disc from Diamond Mowers, Inc. 3.5 Adopt Resolution 2016-27 establishing State Aid street designation. 3.6 Received Commission Meeting Minutes: A. Parks and Recreation December 15, 2015. B. Parks and Recreation December 15 2015 Worksession C. Parks and Recreation January 19, 2016. D. Planning Commission February 1, 2016. E. Public Safety Commission February 9, 2016. F. Heritage Preservation Commission February 9, 2016. CM Heidner motioned to approve with removal of Item 3.3. Seconded by CM Schroeder. All in favor. Motion carried. 4. Public Hearings: 4.1 James Addition Street Improvement Project. A. Presentation by City Engineer. B. Public Comments. C. Close the Public Hearing. City Attorney MacArthur explained the process and noted the special assessment amount is an estimate amount that will change once the project cost is final. City Engineer Wagner presented the staff report for the project. Mayor Stockamp opened for Public Hearing at 7:12 PM. 1IPage 3/14/16 Kevin Rudek, 15160 85th Street NE, said he is confused on why he is being assessed; he further stated he is not the only one that uses this access. City Engineer Wagner said the appraiser hired by the city looked at secondary accesses and is recommending the $700 assessment for the secondary access. City Attorney MacArthur explained the appraisal process; stating the city doesn't do a full appraisal; the appraiser gives his general opinion. He further stated that if an individual doesn't agree with that appraisal, that you have the opportunity to appeal at the assessment hearing. Dean Lowe, 8957 Packard Avenue NE, said he has not seen one patch in this area in the past. Ken Lindquist, 8827 Packard Avenue NE, concern if do an overlay what will happen to the new overlay with all the new construction in the area and further stated he doesn't think this road is bad. City Engineer Wagner said it's 26 years old and leaving sections of the overlay undone would not be wise. Mark McCoy, 8841 Packard Avenue NE, said he agrees the street has not been patched at all and he has been there since 1998 and stated concern with the construction and the road. City Engineer Wagner said the overlay will increase the strength of the road. Earl Lieske, 15216 85th Street NE, asked why he is paying for the secondary access. He also questioned why some property along 85th Street aren't being assessed. City Engineer stated they don't have a secondary access. He also noted that 50 percent of the project is being paid by all tax payers. John Kornberg, 15159 87th Street NE, asked why there was never any maintenance on the street. City Engineer Wagner explained that the proactive street maintenance plan was implemented in the mid 2000's and at that point the road has deteriorated so just maintenance has been done. Mr. Kornberg stated last year was the first year he has seen any maintenance. Steve Schuck, 15170 88th Street NE, questioned the topsoil that will be used for the project. City Engineer Wagner said it will be good topsoil. Mr. Schuck said also they lose about four feet of their yard every season from the plow. Street Operations Manager Kevin Lamson will talk with the plow driver in that area. John Kornberg, 15159 87th Street NE, asked if the driveway cut out is included. City Engineer Wagner said yes. Mr. Kornberg also asked how long the assessment is. City Engineer Wagner said generally it is a 10 year assessment. Finance Director Flaherty said the interest rate is based off the market at the time. Mr. Kornberg further stated concern with the culvert on his property that is un-functional. City Engineer Wagner to meet with him on that item. Stephanie Campbell, 8738 Packard Avenue NE, questioned if the whole cul-de-sac or what sections will be overplayed. City Engineer Wagner reviewed the map. Mayor Stockamp closed the Public Hearing at 7:41 PM. CM Warehime asked about the concern from resident with heavy equipment on the new road. City Engineer Wagner said the overlay will increase the strength of the road about 50 percent. ' 4.2 Imposition of charges within the Above Standard Streetlight Service District. A. City Clerk attests to legal notice. B. Presentation by Finance Director. C. Public Comments. D. Close the Public Hearing. E. Approve Resolution 2016-29. City Clerk Loff attested that all the proper noticing, posting and publishing has been completed. Finance Director Flaherty presented. Mayor Stockamp opened Public Hearing at 8:03 PM. Hearing no public comments Mayor Stockamp closed the Public Hearing at 8:04 PM. CM Heidner motioned to approve Resolution 2016-29, imposing charges for 2016 within the above standard street lighting special service district. Seconded by CM Warehime. All in favor. Motion carried. 5. Community Development: 5.1 Riverpointe 6th Addition: (Resolution 2016-30) A. Planned Unit Development -Conditional Use Permit (PUD-CUP) allowing a lot without direct access to a public street. B. Preliminary and Final Plat for one single family lot. City Planner Licht presented the staff report. CM Heidner motioned to approve a preliminary/final plat and PUD-CUP for Riverpointe 6Ih Addition and adopt Resolution 2016-30 approving a development agreement. Seconded by CM Schroeder. All in favor. Motion carried. 5.2 Lahn: (Ordinance 2016-07) A. Zoning Map amendment rezoning from A-1 District to R-5 District. B. Planned Unit Development -Conditional Use Permit (PUD-CUP) and Preliminary Plat of 345 single family lots. City Planner Licht presented the staff report. Applicant, Paul Tabone, Lennar, was present and agreed with the staff report; he explained that about 5-10% of the project will be what they call the next generation style that will have mother in law suites, noting they are market driven. CM Heidner motioned to approve a planned unit development -conditional use permit (PUD-CUP) and a preliminary plat and Ordinance 2016-07 amending the zoning ordinance of the city of Otsego to provide for a change in zoning classification for land within the Lahn Preliminary Plat. Seconded by CM Warehime. All in favor. Motion carried. 7. Utilities: 7.1 Award bid for West WWTF Digester Project. AE2S Representative and lead engineer for the project, Scott Schaefer presented. He said the recommendation is the low bid from Gridor Construction. CM Heidner said in a past project the City had an issue with who was inspecting the construction; He asked how we will make sure it is not a problem again? . City Engineer Wagner said this project is different than the last project which was siding and roof of the facilities. City Administrator Johnson stated that the Council approved an inspection arrangement for the previous project with the engineering firm for the project and that engineering firm is no longer used by the City. AE2S Engineer Schaefer said another item to note is that the electrical subcontractor for Gridor Construction was indicated to be EIM, which is a subsidiary of AE2S Construction LLC (ACL). He 3 1 P a g e 3/14/16 said that AE2S and ACL are separate companies owned by Advanced Elements, Inc. He further stated that the City Attorney has reviewed and the attached supplemental representation and agreement was prepared. CM Schroeder asked how many other electrical bids were received. AE2S Engineer Schaefer said he doesn't have that information and that he will bring back to the City Council. CM Schroeder motioned to approve a contract with Gridor Construction for the base bid and three alternates totaling $1,465,400 for the West Digester project and approve an amendment 1 to the Owner- Engineer agreement pending the City Attorney review. Seconded by CM Heidner. All in favor. Motion carried. 7.2 East WWTF Oxidation Aeration Improvement. AE2S Engineer Schaefer presented. Update to the scope to $300-350,000. CM Schroeder motioned to direct AE2S to prepare public bid documents for the East WWTF Aerator process equipment pre -procurement and advertise for bids and to direct AE2S to prepare public bid documents for the East WWTF Aerator general construction and advertise for bids. Seconded by CM Heidner. All in favor. Motion carried. 8. Parks and Recreation: 8.1 Northwood Park. Parks and Recreation Director Demant presented the staff report. City staff is recommending the low bid from GL Contracting Inc. CM Heidner questioned he trail lighting. Parks and Recreation Director Demant said it will be average street lights similar to the one in Prairie Park. CM Heidner asked about lighting in the ball field. Parks and Recreation Director Demant said there will be a Ballard in the back and a push button can be added for timed lighting. CM Warehime questioned the proposed design of the park; he said there is no direct path to the ball fields and also questioned if the baseball diamond should be turned away from the parked cars. Parks and Recreation Director Demant said the diamond direction was discussed by the Park and Recreation Commission; the disadvantage is the balls then direct towards the houses. City Planner Licht also noted there is parking available along 77th Street. Mayor Stockamp asked on timing since the Parks and Recreation Commission have not seen this yet. Parks and Recreation Director Demant said the Commission will review this tomorrow night. CM Schroeder said the Commission did have a lot of input into the park concept as well. CM Schroeder motioned to approve GL Contracting including all alternates including any changes or recommendations by the Park and Recreation Commission after their review. Seconded by Mayor Stockamp. All in favor. Motion carried. 9. Public Works: 9.1 ; Consider Resolution 2016-31 Awarding Bid for 80th Street Project. City Engineer Wagner presented. City Staff is recommending the low bid by Burschville Construction, Inc. Mayor Stockamp motioned to approve Resolution 2016-31 accepting bid and awarding contract for City Project No. 15-07, 80t" Street NE Improvement to Burschville Construction, Inc. in the amount of $790,360.63. Seconded by CM Warehime. All in favor. Motion carried. 9.2 Consider Resolution 2016-32 E-8 School Interim Lift Station Plans. City Engineer Wagner presented. Mayor Stockamp said she has heard talk of two schools, has 4 1 P a g e 3/14/16 there been discussion on if this could handle two buildings. City Engineer Wagner said this would not be large enough to accommodate a High School as well as a Jr. High School. He further stated the district would need to increase size of pumps in the lift station or build the alternate. City Administrator Johnson said this will be conveyed to the school district in writing. CM Warehime motioned to approve Resolution 2016-32 accepting plans and specifications and ordering advertisement for bids for the City Project No. 16-06, West Otsego E-8 School Interim Lift Station and for the above information to be noted for the School District. Seconded by CM Schroeder. All in favor. Motion carried. 9.3 Consider 2016 Street Maintenance Plans and Specifications. City Engineer Wagner presented. CM Warehime motioned to approve plans and specifications and order advertisement for bids for City Project No. 16-05, 2016 Street Maintenance. Seconded by CM Heidner. All in favor. CM Warehime motioned to authorize City staff to request quotes for crack sealing and infrared patches. Seconded by CM Heidner. All in favor. Motion carried. 10. Administration: 10.1 Classification and Compensation Plan. A. Approve Request for Reclassifications Findings. B. Adopt Classification and Compensation Plan Administration. City Administrator Johnson presented Item 10.1A. CM Warehime motioned to accept the Requests for Reconsideration results from Springsted dated February 23, 2016. Seconded by CM Schroeder. All in favor. Motion carried. City Administrator Johnson presented Item 10.1B. Mayor Stockamp asked if this will go in the personal policy or where. City Administrator Johnson said it is a separate policy. CM Heidner said wording needs to be added that the City may choose to increase the number of steps noting the recent hire of the Utility Operator. City Administrator Johnson stated the City can hire at any step it chooses said language can be added to allow additional steps at the discretion of the Council. CM Schroeder motioned to approve the Classification and Compensation Plan Administration guidelines dated March 14, 2016 as presented with the change as discussed. Seconded by Mayor Stockamp. All in favor. Motion carried. 11. City Council Reports and Updates. 11.1 CC Special Pay for February. CM Schroeder said CM Warehime attended the Public Works Subcommittee meeting for him on February 23, 2016 and it was not included on CM Warehime timesheet. Mayor Stockamp motioned to add the PW Subcommittee meeting for February 23, 2016 to Councilmember Jason Warehime timesheet. Seconded by CM Schroeder. All in favor. Motion carried. CM Heidner motioned to approve the CC Special Pay for February as amended. Seconded by CM Schroeder. All in favor. Motion carried. 12. Staff Reports and Updates. 12.1 I94 Corridor Coalition Washington DC Trip. 5 1 P a g e 3/14/16 City Administrator Johnson said the cities of St. Michael, Albertville and St. Cloud are sending representatives to Washington DC to lobby for funding for the I94 Corridor in May. She said the cost is around $600 if any of the City Council is interested in attending. 12.2 Joint Fire Service Study Meeting, City Administrator Johnson is requesting a meeting with Springsted for the joint fire service on either March 22 or March 29. CM Schroeder motioned to call a Special Meeting on March 22, 2016 at 5:30 PM to be held at City Hall, 13400 90t" Street NE, for joint fire service study discussion with Springsted. Seconded by CM Heidner. All in favor. Motion carried. City Administrator Johnson said the City received an application for the Park and Recreation Commission. Mayor Stockamp called a Special Meeting on March 28, 2016 at 6:30 PM to be held at Prairie Center, 8899 Nashua Avenue NE, for Advisory Commission Interview. Seconded by CM Heidner. All in favor. Motion carried. City Administrator Johnson gave an update on Wagner SprayTech's receipt of $180,000 of Job Creation Funds from DEED. 13. Closed Session: Mayor Stockamp stated this portion of the meeting will be closed Pursuant to Minn. Stat. 13D.05, Subdivision 3, C.; this portion of the meeting will be closed for discussion on Purchase Agreement for Outlot A, Great River Centre Third Addition (PID 118-266-000010). The Council recessed for closed session at 9:33 PM. CM Warehime motioned to reopen the regular meeting at 10:05 PM. Seconded by CM Schroeder. All in favor. Motion carried. 14. Action from closed Session. CM Schroeder motioned to authorize execution of addendum to the Purchase Agreement between the City of Otsego and P & F Properties changing the closing date. Seconded by CM Heidner. All in favor. CM Schroeder motioned to adopt Resolution 2016-33 calling for a public hearing by the City Council on the proposed modification of the Development Program for development District No.1; and the proposed modification to the tax increment financing plan for tax increment financing District No. 1- Great River Centre.
