ITEM 1.1VrIEM 1.1 OTSEGO PLANNING COMMISSION MEETING 4TSEG0 PRAIRIE CENTER February 4, 2013 7:00 PM Call to Order. Chair Black called the meeting to order at 7:00 PM. RollCall: Chair Pam Black; Commissioners: David Thompson, Richard Nichols, Aaron Stritesky, Brian Gerten, Tammie Fallon and Jim Kolles, City Council: CM Vern Fleldner, Staff: Daniel Licht, City Planner; and Tam! Loff, City Clerk. 1, Consider the following minutes: 1.1 Janua[y 7, 2013 Planning Commission Meeting. Comnilissioner Fallon motioned to approve as written. Seconded by Commissioner rite kr. All in favor. Motion carried. 2, Public Hearinci items: 2.1 Martin Farms Phase 2: A. Preliminary Plat. B, PUD -CUP for wetland buffer averaging and setbacks. City Planner Licht stated the PUD -CUP was noticed but is not needed and that the only application is for a Preliminary Plat. Representative for applicant Lennar; Joe Jablonski was present and agreed with the recommendations of the City staff report. City Clerk Loff attested that all the proper noticing, posting and publishing has been completed. Chair Black opened the Public Hearing at 7:14 PM. Sarah Coe, 12109 72 rd Street NE, said her and several of her neighbors have asked the applicant to look at keeping the berm in behind their properties. Chair Black asked if the berm is there currently. M. Coe said yes. City Planner Licht said along Lots 1-6, Block 2 and those to the north within Phase 1 drain to utlot B, it looks like dirt was constructed along that line being described as berm. City Planner Licht said there is no means for the City to a berm, It would be up to Lennar to submit those changes to the City for review. Emily Gilmore,, 12153 72nd Street NE, said she is not happy with the proposed back to back yards. She has asked the applicant to consider another option. Craig Cusick, 12169 72nd Street NE, said the land behind hire is elevated and with the addition of houses it will be blocking their view. Sarah Coe, 12109 72nd Street NE,, asked why these proposed houses where not on the official plat map at the County for residents to look at before purchasing their home. City Planner Licht said this is a multi -phase and the areas now being developed are recorded as outlots. Ms. Coe asked where residents would get information regarding the planned development. City Planner Licht said the information is in City files and that residents could call City staff. City Planner Licht reviewed the past planning and approvals for the overall area and said the original plans included on the east side of MacIver Avenue townhouses and on the west side high density housing which would include senior housing. Commissioner Gerten asked if the city should relook at the master plan along with Lennar. City Planner Licht stated that the Planning Commission and City Council would review possible modification to the development plan if there were a change in City requirements or policy. Commissioner Nichols asked if these proposed lots are smaller than the ones already existing. City Planner Licht said these lots are subject to the same 9,000 square feet minimum lot size requirement but that the Phase 2 lots must exclude non -buildable areas from that calculation. Commissioner Nichols asked if utilities could be extended to the east of Martin Farms to parcels currently outside of the sewer district. City Planner Licht said that would require a Comprehensive Plan amendment but that the Comprehensive Plan would discourage such action based on available undeveloped land and vacant lots within the current sewer district. Craig Cusick, 12169 72nd Street NE, said with the back to back homes it will change the property values. Mr. Cusick said there have been drainage issues and Lennar has installed a drain tile along the rear of the lot. Mr. Cusick said he is concerned with drainage after addition of these homes. City Planner Licht stated that the rear of the lots in Phase 1 is within a drainage area and wetland at the center of the block. Emily Gilmore, 12153 72nd Street NE, stated she hopes the Lennar will take a look at this. Chair Black closed the Public Hearing at 7:40 PM. Commissioner Gerten said on the City map it looks like all the lots have been subdivided. City Planner Licht said that all the lots in Phase I of Martin Farms have been final platted and are able to pull building permits. Commissioner Gerten asked about the unpaved streets to the north, City Planner Licht said that area is Arbor Creek 3rd Addition, is owned by Emmerich Development and they have final plat approval so that will not come back to the Planning Commission before construction can be finished. Commissioner Gerten asked about the lots along 75th Street? City Manner Licht said that area is also Arbor Creek 3rd Addition. Commissioner Gerten asked who is responsible for the drainage as the area is developing and if there is anything that can be added to the developer's agreement. City Planner Licht said the City accepts a security for grading and installation of the stormwater drainage system. An as -built grading plan is required for each lot after the house is constructed to ensure it complies with approved grading plan. After that point then any stormwater drainage issues are a City maintenance item. Commissioner Thompson asked if the eight foot rise is going to be takers down. City Planner Licht said the grading plans show the house elevations to be within two to three feed with a slope in each lot down to the center of the block. Commissioner Nichols said since Outlot B will hold both the existing and new drainage, has the City thought about revising the standards on how large an area is needed for stormwater ponding especially with the reoccurring wet springs. City Planner Licht said the City uses the 100 year flood elevation to determine the capacity of the stormwater basins. Commissioner Thompson motioned to recommend City Council approval of the Martin Farms Phase 2 Preliminary Plat subject to tete 14 conditions listed in the Planning Report. Seconded by Commissioner Stritesky. All in favor. Motion carried. City Planner Licht stated that the application will be considered at the City Cauncil meeting on February 11, 2013 at 7:00 PM. CM Heidner requested City Planner Licit talk to the City Engineer in advance of the City Council meeting regarding the drainage issues raised during the public hearing. 2.2 Amend the Zoning Ordinance reciarding buildinalype and construction. City Planner Licht presented the Planning Report. City Clerk Loff attested that all the proper noticing, pasting and publishing has been completed. Chair Black opened the public Hearing at 7:56 PM. Hearing no comments Chair Black closed the Public Hearing at 7:57 PM. Commissioner Nichols motioned to recommend City Council approval of an ordinance amending the building materials section of the Zoning Ordinance as presented. Seconded by Commissioner Kolles. All in favor. Motion carried. 3 3, Ur)date on City Council actions. CM Heldner updated the Commissioners on City Council actions. 4, date on future Planning Commission enda items, City Clerk Loff said there are no applications at this time and she will keep the Commissioners posted. 5, Adjourn.
