ITEM 3.2B 2.25.2013 MinutesOTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER February 25, 2013 7:00 PM Call to Order. Mayor Jessica Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heldner, Jason Warehime, Doug Schroeder and Tom Darkenwald. Staff: Lori Johnson, City Administrator; Andy MacArthur, City Attorney; Ron Wagner, City Engineer and Tam! Loff, City Clerk. City Planner Daniel Licht arrived at 7:21 PM. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum. Patric Connelly, 8620 Palmgren Avenue NE, said he was cited for an unlicensed vehicle and was assessed in the amount of $3,100. Mr. Connelly said he found a letter from the City in his newspaper holder was not aware of this of citations prior to this. He also said the letter had the wrong spelling of his name and the wrong property identification number. Mr. Connelly is asking the City Council to amend the assessment. City Administrator Johnson said City staff has spoken with Mr. Connelly and the City Planner is working on gathering the information. She stated staff will work with Mr. Connelly and bring back to the City Council on March 11 if necessary. CM Darkenwald asked the date on the letter. Mr. Connelly said March 22, 2012. CM Darkenwald asked when it was postmarked. Mr. Connelly said March 22, 2012. The City Council directed Mr. Connelly to work with City staff. Heather Eldem, New River Medical Center Representative, gave a hospital update. Pat Hilden, 7094 O'Dell Avenue NE, Otsego River Riders Snowmobile club, gave an update. 2. Consider agenda approval. City Administrator Johnson requested to add schedule the Board of Equalization meeting and Change of Classification for Finance Assistant II position under staff updates. CM Warehime asked on item 3.7 if a deposit is required. Councilmember Schroeder said yes. CM Heidner motioned to approve as amended. Seconded by CM Schroeder. All in favor. Motion carried. 3. Consent Agenda. (Non -controversial items . 3.1 Approve Claims List. 3.2 Approve City Council Meeting Minutes. A. February 11, 2013 Meeting. 3.3 Received Commission Meeting Minutes. A. Planning Commission January 7, 2013. B. Police Commission January 8, 2013. C. HPC January 8, 2013. D. Parks & Recreation Commission January 9, 2013. 3.4 Approve Resolution 2013-12 Advisory Commission Appointments. 3.5 Approve land application site at 118-500-351400. 3.6 Approve Background Check Ordinance 2013-08. 3.7 Approve Resolution 2013-13 revised Park Shelter Reservation Policy. 3.8 Approve calling for a Public Hearing to consider Tax Abatement for Family Speech and Therapy. 3.9 Approve Wellhead Protection Grant Application. CM Darkenwald motioned to approve as written. Seconded by CM Schroeder. All in favor. Motion carried. 4. Public Hearin 4.1 Street Improvement of LaBeaux Avenue from 75th Street to 80th Street. A. City Clerk attests to legal notice. B. Presentation from the City Engineer. C. Public Comments. D. Close the Public Hearing. City Clerk Loff attested that all the proper noticing, posting and publishing has been completed. City Engineer Wagner said he received a call from the Specht's and Brian Beaudry with general project questions. City Engineer Wagner presented the staff report. Mayor Stockamp opened the Public Hearing at 7:28 PM, Kathy Wurzinger, 7846 LaBeaux Avenue NE, said she has concerns with frost bolls stating they move around every year and questioned who will be responsible for repairs if the frost boils return. City Engineer said the paving of the street will help eliminate the frost boils because a new base will be put in those areas before the surface is paved. Ms. Wurzinger asked what culverts would be replaced. City Engineer Wagner said the culverts under the driveways and under 77th Street will be replaced. Ms. Wurzinger said she is concerned because the water drains but it doesn't keep up and asked what size culverts will be used? City Engineer Wagner said 15 inch. Ms. Wurzinger said she has decorative brick along her edging and questioned if it will be restored. City Engineer Wagner said that the bricks would be set to the side and the property owner could replace them or have them replaced. Ms. Wurzinger asked how mail delivery would be handled during the project. City Engineer Wagner said the street should be open for residents to get through but a bank of mailboxes would be set up along 77th Street if needed. Ms. Wurzinger said she would like to request the speed limit to be lowered on that service road. CM Heldner said State law sets the speed limit at 30 MPH. CM Schroeder recommended contacting the Wright County Sheriff to monitor. Ms. Wurzinger questioned how many years the assessment will be for. Mayor Stockamp said that has not been decided at this point. Casey McShane, 7676 LaBeaux Avenue NE, stated the speed on the frontage road is tremendous. He feels the road would not have the problems it does if it weren't for the Pleasant Creek Development. Mr. McShane said when the 77th Street was put in that has caused drainage issues on his property. Mr. McShane questioned why this project is being done. City Engineer said that some residents have contacted the city regarding drainage and street issues due to frost boils and soft areas over the past several years; the current roadway consists of gravel surface and gravel costs more money to maintain. Mr. McShane asked for the amount of money or hours staff spent to maintain. City Engineer Wagner said the Street Maintenance Supervisor would provide the information at the next meeting on this project. Mr. McShane asked if 77th Street will be wider and will the street width extend to the north or south properties? City Engineer Wagner said that the street will be wider but that the improvements will occur within the existing right-of-way. Mr. McShane questioned if this improvement would really raise his property value as stated in the appraisal information. City Attorney MacArthur 2 spoke on the appraisal information as it relates to assessment processes. Mr. McShane said he is against the project. Carol Fernholz, 7514 Labeaux Avenue NE, asked where her husband will be able to park his semi -trailers. City Planner Licht said semi -trailers are not allowed to be parked on residential property and that the existing semi- trucks are in violation of the Zoning Ordinance and could be subject to enforcement. Ms. Fernholz said she agrees the water problem started with townhouse development. Ms. Fernholz also stated it will be an inconvenience for a lot of them just to get to her property due to the access closure. She stated the ditch in front of her house has been changed so much with all the utilities that have come in. She said when the gas line was put in the pipe in her yard was left hanging out. City Engineer Wagner said he will check on this and have the provider take care of this. Ms. Fernholz said she is against the project. Mayor Stockamp closed the Public Hearing at 8:03 PM. CM Heidner asked if the project map shows additional right of way for 801h Street and 75t' Street. City Engineer Wagner said yes. CM Warehime recommended having the Street Maintenance Supervisor gather the information on the maintaining the gravel road. The City Council agreed. CM Darkenwald said the frost boils seem to be a big issue he asked the City Engineer how they will identify where those are. City Engineer Wagner said the best way is in March or April to drive a loaded truck down the road to identify the poor soil areas. CM Heidner asked if the road would be completed all at once. City Engineer Wagner said there would be a total of 3 inches of asphalt; they would install 1 1/2' and then come back and do the other 1 1/2' in a couple of weeks. Mayor Stockamp said regardless of this project that City staff should look at Mr. McShane's catch basin issue. CM Darkenwald said a few issues have been raised and recommended bringing back to the City Council in March once the items are gathered. The City Council agreed. CM Darkenwald motioned to close the Public Hearing and bring back to the March 11, 2013 City Council meeting the information requested. Seconded by CM Warehime. All in favor. Motion carried. S. Public Works. 5.1 Transportation Update. City Engineer Wagner gave an update. Mayor Stockamp asked that a letter regarding Wright County project on County Road 42 at the Elementary School also be sent to the school district office. City Administrator Johnson stated a letter had been sent to the Otsego Elementary school principal and copies would be sent to Mr. Bezek and the School Board, Mark Daleiden, Wright County District 3 Commissioner, gave an update. 6. Community Development. 6.1 HPC Historic Signs Project Grant Application. City Planner Licht presented the staff report. Mayor Stockamp motioned to approve submission of CLG Grant application related to the HPC park history sign project in the form presented. Seconded by CM Schroeder. All in favor Motion carried. 6.2 Consider Ordinance 2013-09 amending the City Code to,reviise provisions related to water and sewer avallability charges. City Planner Licht presented the staff report. City Engineer Wagner reviewed the changes on an updated development fee survey. CM Heidner motioned to adopt Ordinance 2013-09 amending the City Code to revise provisions related to water and sewer availability charges. Seconded by CM Schroeder. All in favor. Motion carried. 7. City Council Reports and Updates, CM Heidner said under item 3.6 we approved background checks for employees and City appointments and volunteers. CM Heidner said although it cannot be required he would like the City Council volunteer for a background checks. City Administrator Johnson added that staff is considering using an outside firm to conduct the background checks and that a proposal may be forthcoming to the City Council for consideration. 8. Staff Reports and Updates. 8.1 Schedule the Board of Appeal and Equalization Meeting, City Clerk Loff said today she received from Wright County a tentative meeting date of April 22, 2013 at 5:30 PM for the Board of Equalization meeting. City Council agreed. CM Heidner recommended the City Council meeting that night be kept as light as possible in case the Board of Appeal and Equalization meeting runs long. 8.2 Change of Classification for Finance Clerk 11 Position. City Administrator Johnson reviewed the request received today from Sue Frisch, Finance Assistant II, to reduce her hours from 40 to 25. Ms. Johnson stated that the approval if granted gives management the right to set the work schedule, benefits are prorated per the personnel policy, and that the position can't be changed back to full time without City Council approval. She recommended the Council accept the request and reclassify the Finance Assistant 11 position to part time effective April 1, 2013. CM Darkenwald motioned to approve Sue Frisch's request effective April 1, 2013. Seconded by Mayor Stockamp. All in favor. Motion carried. 9. Adjourn. CM Darkenwald motioned to adjourn.
