ITEM 3.2D1TrEM _2 SPECIAL CITY COUNCIL MEETING OTSEGO CITY HALL November 5,, 2012 '6:00 PM Call to Order. Mayor Jessica Stockamp called the meeting to order at 5:34 PM. City Administrator 3 has n Informed the Mayor and C uncilmennb rs that this meeting was about is g 's City Code regarding hours of operation for liquor establishments in the City of Otsego. City Attorney Andy MacArthur was present via teleconference, City Administrator Johnson stated that the City has been notified that Cowboy ,hack's has been staying open and searing liquor past the allowed hours of operation. It was noted that in order for an establishment to stay open until 2am, an application for Optional 2am Liquor License needs to be applied for, signed by the City Clerk and sent to the State for approval. Cowboy .hack's does not have this license nor have they applied for one. The City Code currently does not allow tam closing time, City Attorney MacArthur stated that non -intoxicating and intoxicating malt liquors have to have the same hours of operation in accordance with State Statutes. These hours would need to be clarified in the City Code as well as to change then to allow a tam closing time, Mayor St ck mp, asked if Cowboy .hack's would be fined from the State for not having this license. City Administrator 3 has n said they could be fined up t $2,000 for this violation and that they could also be fined up to $2,000 by the City, Coundimember Sch rber asked how we know they aro serving liquor until 2 m. ounciimemb r Schroeder said that Boondox was losing customers who have said they were going over to Cowboy 3 ck's for "night caps'. Bo ndex has also sent some of their employees over to Cowboy ,hack's who have brought back liquor sales receipts that reflect the violated serving time. Mayor Stkarnp suggested getting input from all the local liquor establishments by Friday November 9, 2012 to see if they would be interested in the 2am. closing time. Administrator Johnson gill tally to Sheriff Hagerty and Sergeant Walker to get their input. Mayor Stockamp stated she would like the Police Commission to provide input to the Councils City Administrator Johnson indicated that the State will be informing Cowboy ,hack's tomorrow that they are net allowed to be open until tarn The City Council directed that this item be on the November 13, 2012 City Council Meeting for additional discussion and action. 2. Any other items. - Mayor St ckam asked about the Otsego retail group's activities. City Administrator 3ohnson y � stated the group is considering forming a Business Association with its unique name and logo The City would not be part of the Association. There is an effort to market the area during the "Black Friday" event if that fits with Target's opening tiano. Ultimately, the Business Association would like to create group banners and signs along the retail area to help create an identity. The Council indicated its support for City logo signage in the area. City Administrator Johnson stated the group is awaref the City's support of logo signage for the area and she would again convey that message to the group. It was agreed that this Business Commission should attend a future Administrative Subcommittee meeting to discuss this further before the proposal i presented to the full Council. 3, Adjourn.
