RECOMMENDATION:
City staff recommends vacation of an existing drainage and utility easement to allow for the planned
expansion of the Blu Dot building within Gateway North.

BACKGROUND/JUSTIFICATION:
Duke Realty received approval for construction of a 150,000 square foot warehouse building on Lot 2,
Block 1, Gateway North 4th Addition on 22 September 2014. The proposed building was to be built in
phases with initial construction of 116,200 square feet and second phase of 33,800 square feet. Duke
is now proposing to expand the building 33,800 square feet to accommodate the spatial needs of the
tenant Blu Dot sooner than anticipated. The proposed building expansion requires only administrative
review. However, a waterline was placed adjacent to the west wall of the building and overlaid by
drainage and utility easement where the expansion is to occur. The water line will be relocated as part
of the building expansion and any additional drainage and utility easement recorded to allow for City
access and maintenance if needed. As such, Duke has applied to vacate the existing drainage and utility
easement as it no longer serves a public purpose. City staff has drafted a resolution approving the
vacation, which the City Council may adopt following the required public hearing.

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
A RESOLUTION APPROVING VACATION OF EXISTING DRAINAGE AND UTILITY
EASEMENTS WITHIN LOT 2, BLOCK 1 GATEWAY NORTH 4TH ADDITION.
WHEREAS, the City of Otsego approved a final plat of Gateway North Fourth
Addition for land legally described as Lot 2, Block 1, Gateway North Fourth Addition,
City of Otsego, Wright County, State of Minnesota; and,
WHEREAS, the Gateway North Addition Final Plat included dedication to the City
of drainage and utility easements shown by the attached Exhibit; and,
WHEREAS, Duke Realty Corporation has received approval to construct a
principal building on Lot 2, Block 1, Gateway North Fourth Addition; and,
WHEREAS, the construction of the proposed building requires relocation of an
existing water main and vacation of an existing drainage and utility easement; and,
WHEREAS, Duke Realty Corporation has applied for vacation of the drainage
and utility easements as shown on the attached Exhibit; and,
WHEREAS, the City Council held a public hearing at their regular meeting on 13
June 2016 to consider the vacation, preceded by required published and mailed legal
notice; and,
WHEREAS, the City Council heard all parties interested therein and closed the
public hearing; and,
WHEREAS, the drainage and utility easements previously dedicated within Lot 2,
Block 1, Gateway North Fourth Addition shown on the attached Exhibit serve no useful
public purpose upon concurrent recording of drainage and utility easements shown on
the site and building plans for the principal building; and,
WHEREAS, the City Council having considered all information received related
to the proposed vacation and easement dedication finds that vacating a portion of the
existing right-of-way as shown on the attached Exhibit would be in the public interest;
and,
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Otsego
that Otsego hereby orders:
That the drainage and utility easement located within Lot 2, Block 1 Gateway
North Fourth Addition, City of Otsego, Wright County, State of Minnesota
described by the attached Exhibit is hereby vacated.
2. The City Council hereby determines that the vacation of said drainage and utility
easement shall cause no damage to any abutting or nearby property owners and
therefore no damages are awarded to any such property owners.
