No. No, BACKGROUND/JUSTIFICATION: The property located at 14807 95th Street (CSAH 39) is a 3.94 acre parcel zoned A-1, Agriculture Rural Service District and developed with a single family dwelling and two detached accessory buildings. To the east, south., and west of the property are single family lots zoned R-3, Residential Long Range Urban Service District. As allowed by the current zoning, horses were kept on the property. The City has dealt with complaints regarding the keeping of horses on the property from the surrounding area primarily related to manure handling. The property has been foreclosed upon and is now bank owned. With the pending change in ownership of the property, the City may want to consider amending the Zoning Map to rezone the property to R-3 District consistent with that of other properties in the area to eliminate the allowance to keep horses on the property and avoid future compatibility issues. With a rezoning to R-3 District, the property could also be potentially subdivided to create at least two lots by extending 94th Street from Ogden Avenue within the Prairie Oaks subdivision. Section 20-3-1 of the Zoning Ordinance states that the City Council may initiate action to amend the Zoning Ordinance (including the Zoning Map). The process to rezone the property would be for the City Council to direct the Planning Commission to consider the issue. A public hearing is required and notice would be mailed to all property owners within 350 feet of the property boundary as well as the current property owner. The earliest this issue could be considered by the Planning Commission would be their meeting on 7 January 2013. This item has been added to the City Council agenda for discussion on 10 December 2012 and possible action to direct the Planning Commission to consider the rezoning of the property.
