No. No. B KGROUNDMUSTIFI ATIoN: The Finance Department has sent notice to property owners regarding unpaid charges incurred as part of development, In making application for a development request or in executing ar development contract, the property owner agrees to pair all fees and expenses incurred by the City in the processing f the request. The charges are required to be paid upon receipt of an invoice from the City or the City may assess the past due amount. The property owner, by signing the development application and/or development contract agrees to the City's right to assess these charges and waives any and all appears under Minnesota Statutes 429.81 City staff has verified the proposed assessment roil as accurate. I . . . ... ... . ... . .... ..... .. ......... ............. o APPROVED AS REQUESTED DENIED p TABLED a OTHER (List changes) COMMENTS4 CITY of OTSEGO COUNTY OF WRIGHT STATE of MINNESOTA RESOLUTION leo: 2012-69 RESOLUTION ADOPTING ASSESSMENT FOR UNPAID ESCROW ACCOUNTS WHEREAS, pursuant to applicable Developers Agreements an roar agreements the attached property owners have been duly billed for escrow funds due and payable to the City and have failed to inake the required payments; and WHEREAS, Owners have been notified by mail that the unpaid bills would be assessed against their property with accrued interest as set forth on the attached Exhibit A. NOW THEREFORE E IT RE SOLVED BY THE CITY COUNCIL of THE CITY of OTSEGO, WRIGHT COUNTY, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto as Exhibit A and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and the tract of land therein included is hereby found to have not reimbursed required escrow accounts. 2. Such assessment shall be payable in one annual installment, said installment to be payable on or before the first Monday in January 2012, and shall bear interest at the rate of % per annum from the date of adoption of this assessment resolution. To the assessment shall be added interest o the entire assessment from the date of this res olution until December 31, 2012. Additional interest for one year shall b e added for each additional year that the installment remains unpaid. . The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on the property, with interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and they may,, at any time thereafter, pay t the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 3 1 of the year In which such payment is made. Such payment must be made before November 15 or interest will be charged through December 3 I of the next succeeding year, . The City Clerk shall fol#thwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the propefty tax lists of the County, Such assessments shall be paid over in the same manner as other City taxes. ADOPTED by the Otsego City Council this 22nd day of October, 2012.
