Call t Order.
Myr Jessica St ckamp called the meeting to order at 5:34 Pik,

Planner; and Sandy Lindnflsr, Special Licensing, Andy MacArthur, City Attorney via
telephone until 6:30.
1. Review Liquor License Ordinance.
City Administrator Johnson informed the Myr and C uncilmemb rs that this meeting was
about Otsego's city Code regarding hours of operation for liquor establishments in the City of
Otsego. City Attorney Andy MacArthur was present aria teleconference. City Administrator
Johnson stated that the City has been notified that Cowboy JacWs has been staying open and
serving liquor past the allowed Fours of operation. It was noted that in order for an
establishment to stay open until Zany, an application for Optional 2am Liquor License needs t
be applied for, signed by the City Clerk and sent to the State for approval. Cowboy .hack's does
not have this license nor have they applied for onel
The City Code currently does not allow tam closing time. City Attorney MacArthur stated that
non -intoxicating and intoxicating malt liquors have to have the sane fours of operation in
accordance with State Statutes. These fours gourd need to be clarified in the City Code as well
s to change them to allow a 2am closing time. Mayor Stockamp asked if Cowboy Jack's would
be fined from the State for not having this license. City Administrator Johnson said they could
be fined up to $2,000 for this violation and that they could also be fined up t $2,000 by the
City. Councllrnemb r Sch rber asked how we know they are serving liquor until 2am.
Councilmen bcr Schroeder said that Boondox was losing customers who have said they were
going over to Cowboy Jack's for "night caps". Boondox has also sent some f their employee
over to Cowboy Jack's who have brought back liquor sales receipts that reflect the violated
serving time.
Mayor Stockar p suggested getting input from all the local liquor establishments by Friday
November 9, 2012 to see if they would be interested In the tam closing time, Administrator
Johnson ill talk to Sheriff Hagerty and Sergeant Walder to get their Input, Mayor Stock amp
stated she would like the Police Commission to provide input to the Council. City Administrator
Johnson indicated that the State will be informing Cowboy ,hack's tomorrow that they are not
alloyed to be open until Zany The City Council directed that this item be on the November 1,
2012 City Council Meeting for additional discussion and action.

Mayor Stockemp asked about the Otsego retail croup's activities. City Administrator Johnson
stated the group Is considering forming a Business Association with its unique name and logo
The City would not be part of the Association. There is ars effort to market the area during the
"Black Friday" evert if that fits with Target's opening time. Ultimately, the Business Association
would like to create group banners and signs along the retail area to help create an identity.
The Council indicated its support for City logo signage in the area. City Administrator 3ohnson
stated the group is aware of the City's support of logo signage for the area and she would again
convey that message to tete croup. It was agreed that this Business Commission should attend
Future Administrative Subcommittee meeting to discuss this further before the proposal i
presented to the full C undL
