CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
A RESOLUTION APPROVING VACATION OF EXISTING DRAINAGE AND UTILITY,
EASEMENTS WITHIN LOT 2, BLOCK 1 GATEWAY NORTH 4TH ADDITION.
WHEREAS, the City of Otsego approved a final plat of Gateway North Fourth
Addition for land legally described as Lot 2, Block 1, Gateway North Fourth Addition,
City of Otsego, Wright County, State of Minnesota; and,
WHEREAS, the Gateway North Addition Final Plat included dedication to the City
of drainage and utility easements shown by the attached Exhibit; and,
WHEREAS, Duke Realty Corporation has received approval to construct a
principal building on Lot 2, Block 1, Gateway North Fourth Addition; and,
WHEREAS, the construction of the proposed building requires relocation of an
existing water main and vacation of an existing drainage and utility easement; and,
WHEREAS, Duke Realty Corporation has applied for vacation of the drainage
and utility easements as shown on the attached Exhibit; and,
WHEREAS, the City Council held a public hearing at their regular meeting on 13
June 2016 to consider the vacation, preceded by required published and mailed legal
notice; and,
WHEREAS, the City Council heard all parties interested therein and closed the
public hearing; and,
WHEREAS, the drainage and utility easements previously dedicated within Lot 2,
Block 1, Gateway North Fourth Addition shown on the attached Exhibit serve no useful
public purpose upon concurrent recording of drainage and utility easements shown on
the site and building plans for the principal building; and,
WHEREAS, the City Council having considered all information received related
to the proposed vacation and easement dedication finds that vacating a portion of the
existing right-of-way as shown on the attached Exhibit would be in the public interest;
and,
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Otsego
that Otsego hereby orders:
1. That the drainage and utility easement located within Lot 2, Block 1 Gateway
North Fourth Addition, City of Otsego, Wright County, State of Minnesota
described by the attached Exhibit is hereby vacated.
2. The City Council hereby determines that the vacation of said drainage and utility
easement shall cause no damage to any abutting or nearby property owners and
therefore no damages are awarded to any such property owners.

That portion of the drainage and utility easement lying within Lot 2, Block 1, GATEWAY NORTH FOURTH
ADDITION, Wright County, Minnesota, as dedicated in the recorded plat thereof, described as follows:
Commencing at the southeast corner of Lot 2, Block 1, GATEWAY NORTH FOURTH ADDITION,
Wright County, Minnesota; thence North 89 degrees 49 minutes 22 seconds West, assumed
basis of bearings, along the south line of said Lot 2, a distance of 32.64 feet; thence. North 60
degrees 41 minutes 45 seconds West, a distance of 62.67 feet; thence North 00 degrees 10
minutes 38 seconds East, a distance of 59.50 feet; thence North 70 degrees 11 minutes 17
seconds West, a distance of 59.52 feet; thence North 25 degrees 39 minutes 05 seconds East, a
distance of 130.33 feet; thence North 00 degrees 10 minutes 23 seconds East, a distance of
233.88 feet; thence North 44 degrees 48 minutes 27 seconds West, a distance of 86.11; thence
North 89 degrees 49 minutes 22 seconds West, a distance of 456.12 feet to the point of
beginning of the portion of the drainage and utility easement to be vacated; thence South 00
