RECOMMENDATION:
City staff recommends approval of an ordinance amending the City Code related to special event
permits.

BACKGROUND/JUSTIFICATION:
The City Council, based on review of recent applications for special event permits, directed City staff to
review the current City Code provisions for Special Event Permits. Specific consideration is to be given
to possible amendments of the notification requirements for surrounding property owners as a
condition of approval for a special event permit. Section 7-5-5.C.3 of the City Code currently specifies a
350 foot radii for notification. However, based on the circumstances for outdoor music events to be
held at Boondox Bar and Grille and Rockwoods Grill, the City Council increased the notification distance
to 2,500 feet. City staff has drafted an amendment to Chapter 7, Section 5 to address the following:
■ The application procedures originally adopted in 1998 required an application to be submitted
30 days prior to an event. To ensure adequate time for review of an application and City
Council action, City staff proposes to increase the application requirement to a minimum 90
days prior to an event.
■ The character of events requiring a special event permit can vary greatly. City staff recommends
maintaining the current 350 foot notice requirement for events occurring between the hours of
7:OOAM and 10:OOPM. Outside of these hours, the notice requirement would be expanded to
2,500 feet as more properties may be affected due to the time of day. These hours correspond
to the nuisance noise hour limits established by the City Code and also MPCA day/night hour
based regulations.
■ The City Code currently requires that notice of the event be mailed a minimum of five days prior
to the event. With the changes to the application submission requirement and possible
increases in the number of properties to be notified, City staff recommends that this deadline be
changed to 14 days prior to the event.

AN ORDINANCE AMENDING THE CITY CODE RELATED TO SPECIAL EVENT
PERMITS.
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. Section 7-5-4 of the City Code is hereby amended to read as follows:
7-5-4: APPLICATION FOR PERMIT: Written application for special event
permits must be made at least thirty 1301 (90) days in advance of the event's
proposed date in a form prescribed by the City Council. This application period shall not
begin to run until a complete application has been filed with the City. Application forms
shall be made available in the Office of the City Clerk. A fee, in the amount set by the
City's fee schedule, shall be paid to the City along with the completed application form.
Failure to provide a complete application or to pay the fee, as herein required, is
sufficient reason to deny the special event permit.
Section 2. Section 7-5-5.C.3 of the City Code is hereby amended to read as
follows:
