07-25-16 City Council MinutesOTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER JULY 25, 2016 7:00 PM Call to Order. Mayor Jessica Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Doug Schroeder, Jason Warehime and Tom Darkenwald. Absent: Councilmember Vern Heidner. Staff: Lori Johnson, City Administrator; Daniel Licht, City Planner; Ron Wagner, City Engineer; Kurt Neidermeier, Utilities Operations Manager, Kevin Lamson, Streets Operations Manager and Sandy Lindenfelser, Administrative Assistant. Absent: Andy MacArthur City Attorney, and Adam Flaherty, Finance Director. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum. Marvin Valerius, 13701 70th Street NE. stated there have been ongoing problems with a pond on 70th Street that is growing and is within two feet of the road. The pond is up and the water is not draining. He stated the water has nowhere to go, is going to seep into the pavement and create a soft spot causing a problem. He stated the City will have to deal with this and it will most likely be costly to tax payers. The large truck traffic through this area is not helping and Mr. Valerius feels that the cost for repairs should be on the contractor. Mr. Valerius said he will be back for the next City Council meeting in two weeks with a few more issues to discuss. City Engineer Wagner said he would check the water elevations, stating that sometimes it looks closer than it actually is. Mr. Valerius said if we continue to get more rain like we have been getting, the water level is going to ruin more crops. City Administrator Johnson said she is working with City Attorney MacArthur to acquire more property for the pond based on past direction from the Council to resolve the matter and will have more information for the Council in the near future. City Engineer Wagner will address the water levels. Eric Terwey, 5590 Raintell Court NE., asked what is going to be done to fix the East wastewater treatment plant odor issue and what is going to happen when additional units go in? Mayor Stockamp said there will be time for discussion on this in Item 6.1. 2. Consider agenda approval. CM Schroeder motioned to approve as written. Seconded by CM Darkenwald. All in favor. Motion carried 3. Consent Agenda. (Non -controversial items). CM Schroeder motioned to approve. Seconded by CM Warehime. All in favor. Motion carried 4. Public Hearing:. 4.1 Wellhead Protection Plan: A. Comments by Wellhead Protection Manager Kurt Neidermeier. B. Mayor opens the Public Hearing. C. Close the Public Hearing D. Adopt the Wellhead Protection Plan. (Resolution 2016-66). Wellhead Protection Manager Neidermeier presented the staff report. Administrative Assistant Lindenfelser attested that all the proper legal noticing was completed. Mayor Stockamp opened the Public Hearing at 7:11 PM. After no public comments, Mayor Stockamp closed the Public Hearing at 7:11PM. CM Schroeder motioned to approve Resolution 2016-66 accepting the Wellhead Protection Plan for submittal to Minnesota Department of Health for approval. Seconded by CM Darkenwald . All in favor. Motion carried. 5. Community Development: 5.1 Martin Farms 4th Addition. City Planner Licht presented the staff report. Applicant Joe Jablonski of Lennar was present. CM Darkenwald asked if there were any issues with flooding. City Engineer Wagner said that problem would be solved when constructed. CM Darkenwald asked if there were going to be sidewalks on both the east and west side of MacIver. City Planner Licht said the trail will go on the east side and Lennar will add a trail on the west side to allow residents from the existing Martin Farms lots to the north access to the private community building. Mr. Jablonski had nothing to add and appreciates the opportunity to work with staff. CM Darkenwald motioned to approve the Martin Farms 4th Addition Preliminary Plat and PUD -CUP subject to the fifteen (15) stipulations outlined in the findings of fact and decision dated July 19, 2016. Seconded by Mayor Stockamp. All in favor. Motion carried. 5.2. Wildflower Meadows, Outlot A. City Planner Licht presented the staff report. Jon Blattman of Hedberg Homes was present. Mayor Stockamp noted the second paragraph in Item 5.2 of the packet should be Mr. Jon Blattman. CM Darkenwald motioned to approve a PUD -CUP and preliminary plat for Wildflower Meadows Villas subject to the twelve (12) stipulations outlined in the findings of fact and decision dated July 19, 2016. Seconded by CM Warehime. AH in favor. Motion carried. 5.3 Special Event Permit for Rockwoods Jamfest. City Planner Licht presented the staff report. Applicant Katie Franashouk, 18071 Lincoln Circle NW, Elk River MN was present. CM Darkenwald was concerned about the garbage that ends up outside Rockwoods and asked who is responsible for cleaning it up. Ms. Franashouk said they have a contract with Ace along with the rental of a street sweeper. Ms. Franashouk assures everything will be taken care of and that all garbage will be cleaned up. CM Darkenwald said he is very pleased and impressed with the professionalism put into this event. Mayor Stockamp questioned the flexibility of increasing the 2,500 foot radius in notifying surrounding property owners of outdoor music. CM Warehime asked if there were any complaints from last year. City Planner Licht said the only complaint was from residents north on Parrish Avenue and they are within the 2,500 foot notification area. Based on the low number of complaints, it is decided to keep it at the 2,500 foot radii, and this will keep it fair for all businesses in the area. City Planner Licht said Rockwoods owner, David Peterson has asked for permission to use the jersey barriers as they have in the past. Mayor Stockamp asked Streets Operations Manager Lamson to get these ready if City Council approves. CM Warehime motioned to approve a Special Event Permit for Rockwoods Grill on 12 August, 2016 subject to the six (6)conditions outlined in the permit as presented including the use of the jersey barriers and the 2,500 foot notice. Seconded by CM Schroeder. All in favor. Motion carried. 5.4 Temporary Family Healthcare Dwellings. City Planner Licht presented the staff report. In order to opt out of the provisions, the City must pass an amendment to the Zoning Ordinance. The Planning Commission will hold a Public Hearing on August 1st to consider amending the Zoning Ordinance amendment to opt out of allowing temporary health care dwellings in the City. This will come back to the City Council on August 8th. 6. Administration. 6.1 Authorize Wastewater System Master Plan Study. City Administrator Johnson presented the staff report. Scott Schaefer of AE2S reviewed the projected Master Plan Study including cost range and scope. City Administrator Johnson stated the study would address long term and short term issues such as the current odor issues. She stated that several methods have been used to address the odor issue but none has been fully successful. She reiterated that the City takes this issue very seriously. There was discussion of how to get the odor issues more under control. City Administrator Johnson stated that if the Council wants to gather public input during the study, an open house for residents is recommended. At the open house, residents could meet with the City Council, staff, and engineer. They would have an opportunity provide input that could be incorporated in the study. Mayor Stockamp said input is important; we take the neighborhood concerns very seriously and this odor problem is not acceptable. Eric Terwey — 5590 Raintell Court NE, Otsego. Mr. Terwey asked whether the current solids storage would be used liquids in the future. Mr. Schaefer said that the ultimate use of that tank will be used for future growth. Mr. Terwey asked if mixing can be done during off peak hours with a several week notice to residents that this would be happening. Utilities Operations Manager Neidermeier said yes, but that during the night, residents have their windows open and in the process of mixing, gases are being released causing the odor. City Administrator Johnson said that wind speed and wind direction are huge factors in these odor issues. She stated this information has been communicated to residents several times but perhaps it did not circulate to all affected residents. Methods of a consistent communication system were discussed. Jeff Skoog, 5509 Radford Avenue NE, has heard concerns from neighbors questioning if there are any health concerns for kids playing outside and breathing in this air. Mr. Schaefer said the wastewater odors generally are safe. The perception level of odor is much lower than the level that could raise health and safety concerns, so most of the compounds you smell are lower than normal levels of what would be allowed. CM Warehime asked if the noise issue from the digester is something that can be fixed. City Administrator Johnson said that there have been some adjustments but those have not satisfied the resident concerns. She further stated this issue would be addressed in the master plan. Utilities Operations Manager Neidermeier stated, as of last check, the decibel readings were within allowable limits. Jeff Skoog, 5509 Radford Avenue NE asked if it is possible to enclose the unit with a doghouse around it to reduce the noise or does it need availability to exhaust? CM Schroeder said stated it could be enclosed with block or every other block that is filled with sand, to reduce the noise. City Administrator Johnson stated that mid-September is the probable date for the open house meeting. This meeting will be scheduled with city council and notification to residents as soon as possible. April Fuller — 5574 Raintell Avenue NE will contact City Administrator Johnson or City Clerk Tami Loff with their neighborhood facebook page and to get information for the city website. M Schroeder motioned to enter into a contract for services with AE2S for a Wastewater System Master Plan as outlined in the scope of services as presented in an amount not to exceed $78,000. Seconded by CM Warehime. All in favor. Motion carried. Mayor Stockamp thanked the residents for their patience. 6.2 Approve Resolution 2016-67 Authorizing drafting a Fire Service Joint Powers Agreement with the City of Albertville. City Administrator Johnson presented the staff report. CM Warehime motioned to approve Resolution 2016-67 Receiving Shared Service Fire Study as Prepared by Springsted and Directing Further Review and Negotiations of the Terms of a Joint Powers Agreement. Seconded by CM Schroeder. All in favor. Motion carried. 7. City Council Reports and Updates. 7.1 Commission Liaison Updates. A. Heritage Preservation Commission Liaison Mayor Stockamp City Planner Licht said the historical signs for the parks are being worked on. The historical sign for Prairie Park is already completed. The commission is working on their display for Prairie Festival. B. Parks & Recreation Commission Liaison CM Schroeder. CM Schroeder gave an update on the Parks and Recreation Commission. The Parks and Recreation Commission discussed the future Norin Landing project. Ava's inquired 5k Walk -With -A -Vision will take place the 2nd Saturday in August. They are anticipating 300-375 participants. C. Planning Commission Liaison CM Heidner. City Planner Licht said the Planning Commission discussed the three items listed on the agenda this evening. D. Public Safety Commission Liaison CM Wareheime. CM Warehime said the Commission is going to do roadside cleanup next month. There was a joint meeting with City Council last month. The Wright County Drug Task Force will be giving a presentation at a future meeting. Commissioners are working on obtaining documentation of response times for local fire departments and ambulance service and plan to have data to present to City Council by December. 8. Staff Reports and Updates City Planner Licht said they will be reviewing an amendment to the zoning ordinance allowing a dance studio to open August 1, 2016. City Engineer gave an update on the street maintenance projects in the city. Crack filling is complete, fog sealing is to start later this week, and 80th Street NE striping is planned if the rain doesn't affect this. James Addition should be complete by the end of the week with shouldering, seeding and striping remaining to take place next week. Four out of twenty eight or thirty homes have new driveways, noting they were paid by the property owner. 9. Adjourn. CM Darkenwald motioned to adjourn. Seconded by CM Warehime All in favor.
