AN ORDINANCE AMENDING THE CITY CODE REGARDING
PENALTIES FOR LIQUOR LICENSE VIOLATIONS
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES RE' BY
ORDAIN&
Section 1. Section 7-3-113. 1 of the City Code is hereby amended to read
as follows:
I . Upon a finding that a licensee of any license granted pursuant to the City's
Liquor Ordinance has failed to comply with an applicable statute,
regulation or ordinance relating to alcoholic beverages, or an
y.nuisance or
other violation off'the Cid Code resulting from its business operations,, the
City Council may issue a civil penalty not to exceed two thousand dollar*
($2,000.00) and may suspend the license for up to sixty (60) days.
Section 2. Section -3-1 f . .5 of the City Code is hereby amended to read
as follows;
5. In addition to the penalties set forth above'. the City Council may also act to
revoke e a license for non-compliance with an applicable statute, regulation
or ordinance,, includiniz re p aced nuisance or other violations o the
Code {elated to its business o e �a iox .
Section 3. Section 7-3-113.6 of the City Code is hereby amended to read
as follows:
6. If ani ci vi of � suspension or revocation of a Cfty Iiee .se is found t
be specifically related to allowed business operations after one 'lel
(1:00)AM., the Cily Council may act to suspend or revoke the sale of liquor
after; one o'clock (1:00) AM allowed by the Cily license and shall foiward
its findings and...rccommendations to theState of Minnesota for
licable action pursuant to the State permitfor operation after one
o'clock (1:00)__AM.
Section 4. This Ordinance shall become effective immediately upon its
passage and publication.
