ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No. BACKGROUND/JUSTIFICATION: No. MinnWest Bank has submitted a final plat to adjust the common lot line boundary between Lot 1, Block 1 and Outlot M Waterfront East. The proposed lot line is to be shifted 29 feet to the west so as to accommodate all of the principal building on Lot 1, Block 1 within that lot as the structure currently overlays the existing lot line. The proposed final plat is requested in accordance with a Stipulation and Order issued by Wright County District Court dated 12 August 2016 settling a lawsuit between the property owners. The lots are zoned PUD, Planned Unit Development District in accordance with the Ordinance adopted by the City Council on 10 November 2003. The PUD District does not establish minimum lot area or width requirements and setbacks are as established for the B-3, General Business District (unless modified as part of a PUD Development Stage Plan approval). The proposed final plat will provide a 10 foot setback from the existing west wall of the principal building on Lot 1, Block 1 as required by the PUD District. Outlot M will be replatted as Outlot A with the proposed final plat and is subject to future application for PUD Development Stage Plan and final plat approvals. No development fees are due to be paid for utility availability charges, transportation charges, storm water impact fees, or park dedication for the proposed final plat. Those fees applicable to Outlot A will be due at the time the parcel is platted as a lot for development in accordance with the City fee schedule then in effect. No development contract is required for the proposed final plat as there are no public improvements or private improvements being undertaken at this time. CITY COUNCIL MEETING: 12 September 2016 FINDINGS: Based upon review of the application and evidence received, the Otsego City Council now makes the following findings of fact: A. The legal description of the property is Lot 1, Block 1 and Outlot M, Otsego Waterfront East, City of Otsego, County of Wright, State of Minnesota. B. The property lies within the East Sanitary Sewer Service District and is guided for commercial land uses by the Otsego Comprehensive Plan, as amended. C. The property is zoned PUD, Planned Unit Development District in accordance with the Ordinance adopted by the City Council on 10 November 2003. D. The applicant is requesting a final plat adjust the common lot line between the two properties pursuant to a Stipulation and Order of Wright County District Court dated 12 August 2016. E. The Request for Council Action dated 12 September 2016 prepared by the City Planner, The Planning Company LLC., is incorporated herein. F. The application for final plat approval is processed in accordance with Section 21-3-3 of the Subdivision Ordinance. DECISION: Based on the foregoing information and applicable ordinances, the request is hereby APPROVED.
