RECOMMENDATION:
City staff recommends accepting a petition and setting a public hearing to consider annexation of
property within Monticello Township to the City.

BACKGROUND/JUSTIFICATION:
The City has received a petition for annexation from SR, LLC (the owners of Minnesota Native
Landscapes). SR, LLC is purchasing a 39.58 acre parcel from Dahlheimer Family Properties, LLC located
within Monticello Township for expansion of the businesses occurring on their existing property within
the City of Otsego. The parcel being petitioned for annexation is bounded on its west, south, and east
sides by parcels within the City of Otsego.
The process for annexation by petition of the property owners is set forth by Minnesota Statutes
414.033 Subd. 2(3). The City is required to hold a public hearing with 30 days notice to
Monticello Township and abutting property owners. After closing the public hearing, the City
Council will consider adoption of an ordinance annexing the subject site into the City of Otsego.
The City Attorney has drafted a resolution for the City Council to accept the petition and set a
public hearing for the meeting on 14 November 2016 at 7:OOPM to consider the annexation
petition.

RESOLUTION NO. 2016-87
RESOLUTION ACCEPTING PETITION FROM PROPERTY OWNERS REQUESTING ANNEXATION AND
SETTING PUBLIC HEARING
WHEREAS, Dahlheimer Family Properties, LLC, Owner, and Joseph and Amy Schaefer d/b/a SR, LLC,
Purchasers of that property described on Exhibit A attached hereto have presented a signed petition
and request to the Otsego City Council to annex the property as described as the Northeast Quarter of
the Northeast Quarter of Section 28, Township 121, Range 24, Wright County, Minnesota (PID #
213000281100) from Monticello Township into the City of Otsego; and
WHEREAS, the property is under 120 acres (39.58 acres) and abuts the City of Otsego and is not
presently served by public wastewater facilities and thus is subject to annexation by ordinance in
accordance with Minnesota Statute 414.033, Subdivision 2, 3; and
WHEREAS, Minnesota Statute 414.033, Subdivision 2b requires a public hearing after 30 day's written
notice by certified mail to the affected township and all landowners within or contiguous to the parcel
proposed for annexation,prior to the City acting upon an ordinance to annex the property.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Otsego, Wright County, Minnesota
as follows:
1. The City hereby accepts the property owners' petition.
2. A public hearing shall be held to consider the matter on Monday, November 14, 2016 at 7pm at
the Otsego City Hall.
3. City staff are hereby directed to serve notice on Monticello Township and the property owners
as required by statute.
ADOPTED this 10th day of October, 2016 by the Otsego City Council.
