ITEM 3.2A 10.10.2016 MinutesITEM 3_2A OTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER OCTOBER 10, 2016 7:00 PM Call to Order. Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Doug Schroeder and Jason Warehime. Absent: Councilmember Tom Darkenwald. Staff: Lori Johnson, City Administrator; Ron Wagner, City Engineer; Daniel Licht, City Planner; Andy MacArthur, City Attorney; Adam Flaherty, Finance Director and Tami Loff, City Clerk. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum. No items. 2. Consider agenda approval. CM Heidner motioned to approve as written. Seconded by CM Schroeder. All in favor. Motion carried. 3. Consent Agenda. (Non -controversial items). 3.1 Approve Claims List. 3.2 Approve City Council Meeting Minutes. A. September 26, 2016 Meeting. 3.3 Authorize City Council special pay. 3.4 Approve Resolution 2016-80 adopting assessments for unpaid utility bills. 3.5 StatutoryTort Liability Limits. 3.6 Accept City Administrator Resignation. 3.7 Approve Pay Estimates and Change Orders. A. Change Order #1 Northwood Park Trail Landscaping. CM Heidner motioned to approve. Seconded by CM Schroeder. All in favor. Motion carried. 4. Public Hearings: 4.1 Proposed Assessment for unpaid Administrative Fines and Service Charges related to Code Enforcement. A. City Clerk attests to legal notice. B. Presentation of proposed assessment roll by Finance Director. C. Open Hearing for Public Comments. D. Close Public Hearing. E. Consider Resolution 2016-81 adopting assessment for unpaid administrative fines. City Clerk Loff attested that all the proper noticing, posting and publishing has been completed. Finance Director Flaherty presented the staff report and assessment roll. Mayor Stockamp opened the Public Hearing at 7:02 PM. Hearing no public comments Mayor Stockamp closed the Public Hearing at 7:03 PM. CM Warehime asked is this list includes the commercial fines. City Planner Licht said yes. CM Warehime said he didn't notice the Boondox fine on the list and he spoke with Sandy Lindenfelser today and she said she has not seen any payment from Boondox. City staff will check on this item and bring back to the next City Council meeting. 11 P_a g e. 10/10/16 CM Schroeder motioned to approve Resolution 2016-81 adopting the assessment roll for unpaid special charges. Seconded by CM Warehime. All in favor. Motion carried. 4.2 James Addition Improvement Project proposed Assessment. A. City Clerk attests to legal notice. B. Comments by City Engineer. C. Presentation of proposed assessment roll. D. Open Hearing for Public Comments. E. Close Public Hearing. F. Consider Resolution 2016-82. City Clerk Loff attested that all the proper noticing, posting and publishing has been completed. City Engineer Wagner presented the staff report and assessment roll. Mayor Stockamp opened the Public Hearing at 7:09 PM. John Kornberg, 15159 87th Street NE, questioned how it was determined who assessed regarding accesses. City Engineer explained secondary access is only applied when the primary access is not the improved street. Mr. Kornberg said the property located behind him has an access and it running a business out of it. City Planner Licht said that would be a zoning issue. Eileen Schuck, 15170 88th Street NE, noted typo on the map. Steve Schuck, 15170 88th Street NE, stated the he is unhappy with the poor work of the connection for driveway apron. He said the pitch is fine it's the cut up to the driveway that is poor workmanship. City Engineer Wagner said that did not go unnoticed he explained the very low end top soil used and noted the contractor was not paid for $3,000 of the cost for that reason. John Kornberg, 15159 87th St, stated he has an issue with his driveway also, addressed the concern before the road was complete because he had just replaced his driveway. He said his driveway has a ridge now. He further asked on the up keep. City Engineer said the City will crack fill the road next year, in two years we will crack seal and fog seal and then in five to six years we will seal coat. City Engineer Wagner further said he will review and talk to the contractor. Steve Schuck, 15170 88th Street NE, stated he would rather the contractor not cut it out do to the quality of work they have done. He further stated he needs to replace his driveway in the next couple years. Mayor Stockamp closed the Public Hearing at 7:26 PM. CM Heidner stated the $3,000 deducted from the project divided by twenty five properties ended up making the assessment $100 less for each property. CM Warehime motioned to adopt Resolution 2016-82 assessing the James Addition Improvement project to benefited properties in accordance to the attached assessment roll for a total of $66,999.99. Seconded by CM Schroeder. All in favor. Motion carried. 2 1 P a g e 10/10/16 CM Warehime said we need to make a point in the future to the contractors the expectation of the quality of the aprons. 4.3 Martin Farms 4th Addition Final Plat and Vacation of Easement. (Resolution 2016-83 & 2016-84 City Planner Licht presented the staff report. Applicant Paul Tabone, Lennar, thanked the City Council for consideration and stated they would like to grade this fall and finish out next spring. There was no public comment. CM Heidner motioned to approve the Martin Farms 4th Addition final plat subject to the conditions as outlined in the Findings and Decision dated September 23, 2016, adopt Resolution 2016-83 vacating existing drainage and utility easement, and adopt Resolution 2016-84 approving the Development Agreement. Seconded by CM Warehime. All in favor. Motion carried. 4.4 Wildflower Meadows 6th Addition Final Plat and Vacation of Easement. (Resolution 2016-85 & 2016-86) City Planner Licht presented the staff report. The Applicant was present and had no comments. There were no public comments. CM Schroeder motioned to approve the Wildflower Meadows 6th Addition Final Plat subject to the conditions as outlined in the findings of Fact and Decision dated September 23, 2016, adopt Resolution 2016-85 vacating existing drainage and utility easement, and adopt Resolution 2016-86 approving the Development Agreement. Seconded by CM Heidner. All in favor. Motion carried. 5. Community Development: 5.1 Accepting Petition and Ordering_ Public Hearing for Proposed Annexation of Property to the City. (Resolution 2016-87) City Planner Licht presented the staff report. CM Schroeder motioned to adopt Resolution 2016-87 accepting a petition from SR, LLC and Dahlheimer Family Properties, LLC requesting annexation and setting a public hearing. Seconded by CM Heidner. All in favor. Motion carried. 6. Public Works: 6.1 70th Street Pond update. City Engineer Wagner presented the staff report. CM Warehime asked what is the additional red line between residents on the map. City Engineer Wagner stated that is the area that if the property owner wanted to; they could connect. The City would pay up to 14% of that pipe if they didn't want to have it done now or otherwise it would be up to them to put in later date. CM Heidner motioned to approve preparation of Minor Work Order No. 5 for the installation of a new 8" draintile from 70th Street Pond #5 to CSAH 37 ditch and preparation of an agreement between the City and Valerius Meadows, Inc. regarding the installation of the 8" draintile. Seconded by CM Schroeder. All in favor. Motion carried. 7. Administration: 7.1 Mayor's Monarch Pledge. City Administrator Johnson presented the staff report. This was reviewed by the Administrative Subcommittee and recommended for approval. Mayor Stockamp motioned to participate in the Mayor's Monarch Pledge. Seconded by CM Heidner. All in favor. Motion carried. 3 1 P a g e 10/10/16 7 2 Consider Revised Agreement Between the City of Otsego and City of Dayton Regarding Costs Related to the Study and Evaluation of Construction and Delivery of Emergency Water Service. City Administrator Johnson presented the revised agreement. CM Heidner asked how much the City has spent so far on this. Finance Director Flaherty said less than $500 and stated City staff is tracking and they will be billed. CM Schroeder motioned to approve the revised agreement between the City of Otsego and the City of Dayton regarding costs related to the Study and evaluation of construction and delivery of emergency water service that was approved by the Dayton City Council on September 26, 2016. Seconded by CM Warehime. All in favor. Motion carried. 7.3 Discuss City Administrator Search Process and Appointment of Interim City Administrator City Administrator Johnson presented staff report. She also distributed additional information to the City Council from the League of Minnesota Cities regarding the hiring of an Administrator. CM Heidner motioned at to call a special meeting to discussion City Administrator Search Process and appointment of Interim City Administrator on Monday, October 24, 2016 at 6:00 PM at Prairie Center, 8899 Nashua Avenue NE. Seconded by CM Warehime. All in favor. Motion carried. 8. City Council Reports and Updates. CM Heidner said that he recommends that Mayor Stockamp be paid for the District 728 transportation meeting she attended that was on the special pay this evening. The City Council concurred and this will be added to her October special pay. CM Warehime gave an update on the fire departments. He also stated that Albertville Assistant Fire Chief Tate Mills has accepted a job for the State Fire Marshall. CM Schroder gave a Northwood Park update. 9. Staff Reports and Updates. City Administrator Johnson said she will have two proposals for the fire location study on the October 24 agenda. 10. Adjourn. CM Warehime motioned to adjourn. Seconded by CM Schroeder. All in favor.
