ITEM 3.2B 10.24.2016 MinutesITEM 3.26 OTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER OCTOBER 24, 2016 7:00 PM Call to Order. Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Doug Schroeder, Jason Warehime and Tom Darkenwald. Staff: Lori Johnson, City Administrator; Ron Wagner, City Engineer; Daniel Licht, City Planner; Andy MacArthur, City Attorney and Adam Flaherty, Finance Director. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum. Special Presentation: Charles Vonberg Senior Center update. Senior Center Volunteer Charles Vonberg updated the City Council on current Senior Center activities. Mr. Vonberg informed the Council that the senior programs are growing and expanding. He discussed several of the current programs. Mayor Stockamp asked how the senior center markets its programs. Mr. Vonberg stated at the Prairie Festival and through word of mouth. He further stated he would like to see a senior director added. CM Schroeder asked if he had talked to Parks and Recreation Director Demant about this. Mr. Vonberg said he had not. The Council suggested he do so. CM Warehime asked whether a direct mailing to seniors to advertise the programs was sent. Mr. Vonberg said no direct mailing was done. The Council thanked Mr. Vonberg for his volunteer work with the senior center and for the update. 2. Consider agenda approval. CM Warehime asked that item 3.3 Adopt City Council Logo Wear Purchasing Policy be moved to item 7.3. CM Heidner motioned to approve as amended. Seconded by CM Schroeder. All in favor. CM Heidner motioned to approve. Seconded by CM Schroeder. All in favor. Motion carried. 5-0. 4. Public Hearings: 4.1 Benzinger Homes Vacation of portion of existing drainage and utility easement. A. Comments by City Planner. B. Mayor to open the Public Hearing. C. Close the Public Hearing. D. Approve Resolution 2016-89. City Planner Licht presented the staff report. Mayor Stockamp asked if there were any public comments submitted. City Administrator Johnson and City Planner Licht both stated no comments were received. Mayor Stockamp opened the public hearing. There were no comments. Mayor Stockamp closed the public hearing. CH Heidner asked if the house is on a pipe. City Engineer Wagner stated that it is not; this is related to a maintenance process. CM Darkenwald motioned to adopt Resolution 2016-89 vacation a portion of existing drainage and utility easements within Kittredge Crossings 3rd Addition. Seconded by CM Schroeder. All in favor. Motion carried 5-0. 5. Community Development: 5.1 Guardian Angels Riverview Landing. A PUD Concept Plan for a senior housing facility to be known as Guardian Angels Riverview Landing. City Planner Licht presented the staff report. Dan Dixon, Chief Executive Officer, Guardian Angels stated Guardian Angels is delighted to be developing in Otsego. He introduced Kris Neff, Chief Operating Officer. He stated the first phase will be a four story building. They will provide bus service for their campus; can help with the City with senior center activities, and the partnership with park amenities. He stated they will sell bonds in July 2017 and be in the ground by August. CM Darkenwald stated his Grandfather was at Guardian Angels and he is a Guardian Angels volunteer. He stated he is excited for Guardian Angels to be in Otsego. He discussed the previous zoning on this property, but stated he supports the project. CM Heidner questioned the property tax status of this project. There was discussion related to the previously approved incentives on this parcel. Mr. Dixon clarified that this $25,000,000 project will pay property taxes and yes, they do want the incentives. CM Warehime stated his pleasure with this project stating it is a win -win in this location. CM Schroeder asked about parking issues with Cowboy Jacks and who would pay for the bridge to cross the park pond. Guardian Angels will install the missing side of the street along the Cowboy Jacks parking lot an expressed that they like having a restaurant close. City Planner Licht stated that park improvements including determining who pays would be coordinated by the City. Concerns about noise and memory care patients were raised by the Council. Mr. Dixon stated they have safeguards in place. CM Schroeder motioned to provide the developer favorable comment regarding the proposed concept plan, subject to the stipulations outlined in the Planning Report dated October 18, 2016. Seconded by CM Warehime. All in favor. Motion carried 5-0. 6. Public Works: 6.1 Valerius Agreement. City Engineer Wagner presented the staff report. He stated he and the City Attorney met with the property owners today. The property owners prefer that the work is completed this year so 2 1 P a g e 10/24/16 ITEM 3.213 that the renter isn't impacted and the contractor can see where water flows to lay tile in the proper location. City Engineer Wagner recommended contracting with Burschville Construction because they can complete the project this fall. City Attorney MacArthur stated he sent the agreement to the property owners and further he recommends that the work be completed this fall. CM Heidner questioned the value of getting another quote because of the large cost difference between work in the fall and the spring. City Engineer Wagner explained possible reasons for the higher cost indicating that other quotes would include those same costs. City Attorney MacArthur stated that the low bidder may not have been familiar with state and federal project requirements including prevailing wage. CM Schroeder asked if the property owners understand that this is the main line only not the secondary line. City Engineer Wagner stated that the second line wasn't brought up by the property owners. CM Schroeder questioned Mary Valerius. Mr. Valerius stated they understood this was only for the main line and that they would be required to pay 86 percent of the cost of the second line. City Engineer Wagner stated Mr. Valerius is correct and stated that if the property owner (Valerius Meadows) wished to also include the 2"d line he would recommend 14% if the project was done now. CM Darkenwald asked for confirmation that this would be paid by MSA funds. City Administrator Johnson stated that was correct. CM Schroeder motioned to approve Minor Work Order No. 5 with Burschville Construction for the installation of a new 8" draintile from 701" Street Pond #5 to CSAH 37 ditch and an agreement between the City and Valerius Meadows, Inc., regarding the installation of the 8" draintile. Seconded by Mayor Stockamp. All in favor. Motion carried 5-0. 7. Administration: 7.1 2017 Open Book Meeting Option. City Administrator Johnson presented the staff report. After discussion, the Council felt residents preferred to deal with the local council versus County officials. CM Warehime motioned to decline the Open Book meeting option. Seconded by CM Schroeder. All in favor. Motion carried 5-0. 7.2 Fire location study_ proposals. City Administrator Johnson presented the staff report. Mayor Stockamp expressed a desire to meet as a Council then with the three fire chiefs before doing this study. She felt staff could draw the fire station location circles on a map instead using a consultant. City Administrator Johnson stated that the Council should only proceed with the study if they agreed with the methodology, were confident in the ability of the consultant, and were prepared to accept the results. The Council discussed the Public Safety Commission's task of compiling and reporting on response time results for all Otsego calls from all three fire departments. CM Warehime indicated that the study should be completed in December. Upon further discussion, the City Council concurred that the study be tabled until additional Council discussion takes place. 7.3 Adopt City Council Logo Wear Purchasing Policy. CH Warehime asked for clarification of the button shirt language and if polo shirts are included. City Administrator Johnson stated, yes, polo shirts are included and explained that the wording is meant to exclude tee shirts. CM Warehime stated in the past he has purchased clothing and had logo applied, would this be an option. City staff said yes wording can be added to clarify. Mayor Stockamp motioned to approve with change as stated above. Seconded by CM Warehime. All in favor. Motion carried. 8. City Council Reports and Updates. 3 1 P a g e 10/24/16 ITEM 3.213 8.1 Commission Liaison Updates. A. Heritage Preservation Commission Liaison Mayor Stockamp- Mayor Stockamp said the commission is finishing the park signage project. B. Parks & Recreation Commission Liaison CM Schroeder. CM Schroeder said the commission looked at Norin Landing, signage and the dog park street light request. C. Planning Commission Liaison CM Heidner. CM Heidner gave an update on the Planning Commission agenda items. D. Public Safety Commission Liaison CM Warehime. CM Warehime said the commission is working on CERT and reviewing ambulance coverage. Other: Mayor Stockamp gave an update on the ISD 728 boundary meeting she attended. CM Warehime thanked City Administrator Lori Johnson for her service. The City Council agreed. City Administrator Johnson said she appreciates it. 9. Staff Reports and Updates.
