No No BAC KG R O U N DIJ U S T I F I CATION: Otsego Waterfront East 5th Addition is a commercial subdivision with public improvements including watermain, sidewalk, and infiltration pond as well as connections to public sanitary and storm sewer. The site also consisted of private parking lots, concrete curb and gutter, utility services, and storm sewer. All public and private improvements have now been completed including the final lift of pavement and final utility adjustments. An acceptable warranty period has passed and a final walk-thru with City staff was completed August 17, 2016. All items identified at this walk-thru have been completed and the As -built plans dated August 24, 2016 have been accepted. Staff recommends accepting all public improvements associated with Otsego Waterfront East 5th Addition (Accurate Home Care) and releasing the remaining financial securities. Motion to approve Resolution #2016-95 accepting all public improvements associated with Lot 2, Block 1 of Otsego Waterfront East 5th Addition. BUDGET INFORMATION FUNDING: BUDGETED: ❑ YES N NO (NIA) RESOLUTION NO. 2016-95 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR LOT 2, BLOCK 1 OTSEGO WATERFRONT EAST 5T" ADDITION. WHEREAS, the City Council approved the final plat of Otsego Waterfront East 5th Addition (the "plat"); and, WHEREAS, the City and Developer entered into a Developers Agreement February, 2015 for Lot 2, Block 1 Otsego Waterfront East 5th Addition and recorded with Wright County regarding approval of the plat and installation of required public improvements within the plat; and, WHEREAS, all public improvements, including watermain, sidewalk, and grading and erosion control have been completed; and, WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved plans within the plat; and, WHEREAS, an acceptable warranty period has passed; and, WHEREAS, a final acceptance inspection of the public improvements within the plat was conducted on August 17, 2016 with City staff and the Developer, and all remaining items have been successfully completed and the As -built plans dated August 24, 2016 have been accepted; and, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA THAT 1. The City accepts all public improvements lying within public easements and public right-of-way and these improvements shall be come City property.
