City staff recommends approval of a resolution extending the preliminary plat and PUD-CUP approval
for Pleasant Creek Farms 5th Addition to 13 January 2018.

BACKGROUND/JUSTIFICATION:
The City Council approved a Preliminary Plat and PUD-CUP for Pleasant Creek Farms 5th Addition on 13
January 2014. The proposed development is a replat of Pleasant Creek Farms 4th Addition with 47 single
family lots. Under Minnesota Statutes 462.358. Subd. 3c approval of a preliminary plat is valid for one
year, but Section 21-3-2.K.8 of the Subdivision Ordinance allows the City Council to extend the
preliminary plat approval for an additional period. The City has previously extended preliminary plat
approvals when performance standards applicable to the development have not changed and neither
have the existing conditions in the area. The current property owner, The Excelsior Group, is requesting
another one year extension of the project approvals to 13 January 2018. City staff supports the request
as Zoning and Subdivision Ordinance regulations applicable to the subject site have not changed and
characteristics of the neighborhood have also not changed.

Dear Mr. Licht:
ON Pleasant Creek, LLC hereby requests a 1-year extension to the Preliminary Plat and PUD CUP
approval for Pleasant Creek Farms 5`h Addition, which currently expires January 13, 2017. Our plan
to develop the site has been delayed due to the existing supply of residential lots in the Otsego
market. We continue to monitor absorption within the market so that we may respond when
appropriate.

COUNTY OF WRIGHT, MINNESOTA
A RESOLUTION EXTENDING THE PRELIMINARY PLAT AND PUD-CUP
APPROVAL FOR PLEASANT CREEK FARMS 5T" ADDITION.
WHEREAS, the City of Otsego approved a Preliminary Plat and PUD-CUP
application on 13 January 2014 for a development to be known as Pleasant Creek
Farms 5t" Addition; and,
WHEREAS, the developer has not submitted application for final plat approval or
otherwise initiated construction as allowed by the project approvals as of this date; and,
WHEREAS, Minnesota Statues 462.358 Subd. 3c provides that approval of a
preliminary plat application is valid for one (1) years; and,
WHEREAS, Section 21-3-2.K.8 of the Subdivision Ordinance provides that the
City Council may extend the validity of a preliminary plat approval beyond one (1) year
at its discretion; and,
WHEREAS, the property owner has requested an additional extension of the
PUD-CUP/preliminary plat approval; and,
WHEREAS, circumstances have not changed significantly that would make the
project as approved not comply with the City's Comprehensive Plan, Zoning Ordinance
or Subdivision Ordinance; and,
WHEREAS, the characteristics of the area have not changed in any way that
would make the project as approved incompatible with the area.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Otsego
that the approval of the Preliminary Plat and PUD CUP of Pleasant Creek Farms 5tn
Addition shall be extended to 13 January 2018.
