ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: A portion of the watermain and sanitary sewer main for Riverpointe 5thAddition was partially constructed in 2007. The watermain needed to be installed along 59th Street in order to connect the watermain from Pump House #2 to Watertower #3. This also required the sanitary sewer to be installed at that time. The Riverpointe 5th Addition included installation of water and sanitary main along Radford Avenue as well as all the service connections for water and sewer along the existing lines. Also, constructed as part of Riverpointe 5th Addition was storm sewer, streets, and sidewalk. The wear course has now been placed and an initial acceptance walk-thru was conducted September 22, 2016. All remaining items have been successfully completed. Staff recommends that all public improvements be initially accepted as of the date of the walk-thru, September 22, 2016. Per the Developer's agreement for Riverpointe 5th Addition, the Developer warrants; 1. all public improvements, other than streets, within the plat as of the date of this resolution commencing the one (1) year warranty period from this date. 2. all public street improvements within the plat as of the date of this resolution commencing the two (2) year warranty period from this date. BUDGET INFORMATION FUNDING: BUDGETED: ❑ YES ® NO (N/A) RESOLUTION NO. 2016-96 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR RIVERPOINTE 5T" ADDITION. WHEREAS, the City Council approved the final plat of Riverpointe 5t" Addition (the "plat") on April 14, 2014; and, WHEREAS, the City and Developer entered into a Developers Agreement August 20, 2014 for Riverpointe 5tn Addition and recorded with Wright County regarding approval of the plat and installation of required public improvements within the plat; and, WHEREAS, all public street improvements, including bituminous base and wear course paving, curb and gutter, sidewalk, grading and erosion control have been completed; and, WHEREAS, all public utility improvements, including watermain and services, sanitary sewer main and services, and storm sewer have been completed; and, WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved plans within the plat; and, WHEREAS, an initial acceptance inspection of the public improvements within the plat was conducted on September 22, 2016 with City staff and the Developer, and all remaining items have been successfully completed; and, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA THAT 1. The City accepts all public improvements, other than streets, within the plat as of September 22, 2016 commencing the one (1) year warranty period from this date. 2. The City accepts all public street improvements within the plat as of September 22, 2016 commencing the two (2) year warranty period from this date. 3. Upon conclusion of the respective warranty periods and completion of a final acceptance inspection by City staff and satisfaction of any conditions of said final inspection, improvements lying within public easements and public right-of-way shall be come City property without further notice or action.
