City Staff recommends accepting all public improvements associated with Riverbend South as of
October 13 th , 2016 thus starting the warranty period.

BACKGROUND/JUSTIFICATION:
All public street and utility improvements, including bituminous base and wear course paving, curb and
gutter, sidewalk, watermain and services, sanitary sewer main and services, and storm sewer have been
completed for this project. An initial acceptance walk-thru was conducted October 13th, 2016 and all
remaining items have been successfully completed including acceptance of as -built plans dated
November 2, 2016.
Staff recommends that all public improvements be initially accepted as of the date of the walk-thru,
October 13, 2016. Per the Developer's agreement for Riverbend South, the Developer warrants all
public improvements including street improvements, within the plat as of the date of this resolution
commencing the one (1) year warranty period from this date.

RESOLUTION NO. 2016-101
CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR
RIVERBEND SOUTH.
WHEREAS, the City Council approved the final plat of Riverbend (the "plat") on
June 22, 2015; and,
WHEREAS, the City and Developer entered into a Developers Agreement
October 8, 2015 for Riverbend South and recorded with Wright County as Document
No. A1300204 regarding approval of the plat and installation of required public
improvements within the plat; and,
WHEREAS, all public street improvements, including bituminous base and wear
course paving, curb and gutter, sidewalk, grading and erosion control have been
completed; and,
WHEREAS, all public utility improvements, including watermain and services,
sanitary sewer main and services, and storm sewer have been completed; and,
WHEREAS, all public improvements were constructed in accordance with City
standards, Code and approved plans within the plat; and,
WHEREAS, an initial acceptance inspection of the public improvements within
the plat was conducted on October 13, 2016 with City staff and the Developer, and all
remaining items have been successfully completed; and,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO
MINNESOTA THAT
1. The City accepts all public improvements, other than streets, within the plat as of
October 13, 2016 commencing the one (1) year warranty period from this date.
2. The City accepts all public street improvements within the plat as of October 13,
2016 commencing the one (1) year warranty period from this date.
3. Upon conclusion of the respective warranty periods and completion of a final
acceptance inspection by City staff and satisfaction of any conditions of said final
inspection, improvements lying within public easements and public right-of-way
shall be come City property without further notice or action.
