ITEM 3.2A 1.9.2017 minutesITEM 3.2A OTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER JANUARY 9, 2017 7:00 PM Call to Order. Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Jason Warehime, Tom Darkenwald and Corey Tanner. Staff: Adam Flaherty, Interim City Administrator/Finance Director; Ron Wagner, City Engineer; Andy MacArthur, City Attorney and Tami Loff, City Clerk. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Swearing in of Elected City Council Members. City Clerk Loff swore in newly elected officials; Mayor Jessica Stockamp and Councilmembers Jason Warehime and Corey Tanner. 2. Open Forum. City Attorney MacArthur advised that the city would not be taking any comments regarding the potential truck stop as an application has not been received. He is recommending that comments regarding a proposed development are only taken at the public hearing and that members of the City Council are not to discuss potential applications outside of the meetings to avoid legal issues of the process for either party. Residents are encouraged to contact City staff with any questions or comments. Jim Sorensen, 13603 95th Street NE, Representative of the RiverRider Snowmobile Club, stated he was present if there were any concerns. Eric Lucero, State Representative, gave a legislative preview listing the following topic of discussion for this session; MNsure, transportation issues and needs, equity in education, tax cuts, prolife and pro second amendment, and MN Advocates for Children. Chris Loch, 12054 74th Street NE, spoke on a potential truck stop. Holly Schmidt, 12446 67th Court NE, said she seen in the Consumer Confidence Report (CCR) that Otsego water has a high radium count and asked what is being done about this. City Engineer Wagner and Utility Manager Neidermeier explained the CCR she referenced was from levels identified from a well on the east side of town. Staff explained that radium levels are within MDH standards due to a blending process, and further mentioned that this well is only used in the summer as the result of irrigation needs. Jerri Gisinger, 6754 Manchester Court, stated her water regularly smells of chlorine. Utility Manager Neidermeier is to schedule testing of the resident's house. Danette Robeck, 6572 Mackenzie Avenue, stated her radium reading was high and that her neighborhood is hiring a private company to evaluate the water. She further stated she first noticed this last spring and has been working with Utility Manager Neidermeier. CM Heidner requested that when that private company does test the water that the City Utility and the MDH are present as well. 11 Page 1/9/17 ITEM 3.2A Holly Schmidt, 12446 67th Court NE, asked if there is anything that residents can do individually, for example if a water softener would remove radium. City staff was not aware if a water softener would remove radium. Ed Kalenda, 7401 Large Court NE, stated he gets a lot of iron sulfite where he lives. Utility Neidermeier explained that it is from the natural irons in the wells and that when there is a larger water movement it will sometimes knock some of that build up in the pipes. 3. Consider Agenda Approval. City Administrator Interim/Finance Director stated a letter of support was distributed for Item 4.11 this evening and City Attorney MacArthur noted an updated partial release form that was distributed at the dais for Item 4.7. CM Heidner motioned to approved as amended. Seconded by CM Warehime. All in favor. Motion carried. 4. Consent Agenda. (Non -controversial items. 4.1 Approve Claims List. 4.2 Approve City Council Meeting Minutes. A. December 12, 2016 Meeting. 4.3 Authorize City Council Special Pay for December 2016. 4.4 Approve Resolution 2017-01 Adopting Official Newspaper. 4.5 Approve Resolution 2017-02 Designating Depositories and Approving Investment Brokers. 4.6 Approve 2017 Garbage Hauler's Licenses. 4.7 Approve Partial Release of Development Agreements Related to Lot 2, Block 1, Gateway North 5th Addition. 4.8 Approve Information Technology Services Agreement. 4.9 Approve Assessment Services Agreement. 4.10 Approve Public Works Shop LED Lighting Quote. 4.11 Adopt Ordinance 2017-01 Regulating Massage Services. 4.12 Approve Radio Communication Updates to Utility Sites. CM Heidner motioned approve. Seconded by CM Warehime. All in favor. Motion carried. 5. Utility: 5.1 Water Tower Logo Discussion. Utility Manager Kurt Neidermeier presented options for the water tower logo painting. The City Council concurred with the city symbol to be added. Utility Manager Neidermeier to bring back options of placement to a future meeting. 6. Public Works: 6.1 Wokson Hills and Autumn Woods A. Resolution 2017-03 Receiving Feasibility Report and Setting a Date for a Public Hearing. City Engineer Wagner presented the staff report. The City Council had previously approved preparation of a Feasibility Study to determine what needs to be completed, determine costs and allocate costs. He stated there are 60 potential assessment units at approximately $1,700 per unit. He further stated there are two parcels with the same property owner; both have access so the assessment portion includes a possible assessment for each unit. The City Council concurred that both units should be assessed. CM Warehime asked if these roads have been 2 1 P a g e 1/9/17 ITEM 3.2A overlaid before. City Engineer Wagner said no. City Attorney is recommending the city not assess MnDot. The City Council supported not assessing MnDot's portion. CM Heidner motioned to approve Resolution 2017-03 receiving the Feasibility Report regarding the improvements within the Wokson Hills and Autumn Woods subdivisions and calling a Public Hearing for residents to be presented project scope and possible assessment costs for February 13, 2017. Seconded by CM Tanner. All in favor. Motion carried. B Resolution 2017-04 Ordering the Preparation of Plans and Specifications. CM Heidner motioned to approve Resolution 2017-04 ordering preparation of Plans and Specifications for the improvement of streets within Wokson Hills (59th Street and Quenroe Avenue) and Autumn Woods (56th Street, 57th Street and Quilley Avenue). Seconded by CM Tanner. All in favor. Motion carried. 7. Annual Business: 7.1 Appoint Acting Mayor. CM Darkenwald motioned to appoint Vern Heidner as Acting Mayor. Seconded by CM Warehime. All in favor. Motion carried. 7.2 City Council Subcommittees & Liaison Appointments for 2017. Mayor Stockamp appointed the following positions. Seconded by CM Warehime. All in favor. Motion carried. 8. Administration: 8.1 Set Meeting Date for Advisory Commission Interviews. Mayor Stockamp motioned to call February 13, 2017 at 5:30 PM for the Advisory Commission Interviews at Prairie Center, 8899 Nashua Avenue. Seconded CM Tanner. All in favor. Motion carried. 8.2 Approve Claim List for Metro Appliance Recycling. CM Darkenwald motioned to approve the claim list item for Metro Appliance Recycling in the amount of $424.30. Seconded by Mayor Stockamp. Motion carried. 4-0. CM Warehime abstained. 9. City Council Reports and Updates. CM Warehime gave an update on the new Albertville fire rescue truck. CM Warehime stated he has received phone calls regarding the haircut and color sign along County Road 39; he questioned if it was allowed. City Planner Licht is not present this evening so Interim City Administrator/Finance Director Flaherty will follow up with the City Planner. Mayor Stockamp said that Otsego resident Fae Jacobs will be featured on Kare11 Land of 10,000 stories Tuesday evening. 10. Staff Reports and Updates. Interim City Administrator/Finance Director Flaherty gave an update on the City Administrator search process; the search firm is asking to meet with each councilmember for one hour on January 17 or 18. The City Council concurred on January 18, 2017. He further stated the next step would be to approve the advertising materials on January 23ra Interim City Administrator/Finance Director Flaherty said the Auditors will be here this Thursday for a preliminary review. City Clerk said she was looking for direction on scheduling the City Council photos for the City website. She stated in the past it has taken place before at City Council meeting. Mayor Stockamp motioned to call City Council photo session for March 13, 2017 at 6:30 PM at Prairie Center, 8899 Nashua Avenue. Seconded by CM Warehime. All in favor. Mayor Stockamp motioned for a short recess at 8:33 PM. Seconded by CM Warehime. All in favor Motion carried. Mayor Stockamp motioned to reconvene the meeting at 8:45 PM. Seconded by CM Warehime. Closed Session; Regarding Easements for Utility Purposes on PID 118500262100 and PID 118500352201. Meeting to be Closed in Accordance with Minnesota Statute 13D.05, Subdivision 3, c, 3. CM Darkenwald left for evening at 9:25 PM. City Attorney MacArthur stated this meeting will be closed in accordance with Minnesota Statute 13D.05, Subdivision 3, c, 3 for discussion of PID 118-500-262100 and 118-500-352201.
